Absent: Councilman.Battaglia.- Invocation The invocation was given by the Glenn W.-Schafer, Church of the Nazarene, Supervisor Joerger. (second reading): DEFEATED Chief - of Police Larry Higgins noted ;that the'proposed,ord- inance provides authority for the Chief of- Police grant permits` for parades without. Council Be- cause .of - . , the, .pos"s.ible hazard. of the admin, -, istrative officer becoming involved in; discriminating action when.solely 're.spon -. sible for issuing permits,.he recommended that- Council continue-the present pro- cedure o>f - considering the Chief's , recom - mend'ation.regarding a permit .'appli.cation.. Mayor declared the hear.ing,open Chevrolet Variance on the appeal f iled_by William Hilligos.s Res.-#,5646 N.C.S. of Western Chevrolet of the,Board of Zoning Adjustments,' decision on November 17,,1970, denying a variance to allow a 40 foot -high (ordinance allows 30 -foot height- maximum),. free- standing sign at 1,9 Lakeville Highway. All the sary documents. relating to. the appeal, submitted and filed.. Planning Director McGivern showed.a map. of the location of the proposed sign and reviewed. the staff report presented at the' Board ..of Zoning Adjustments' meeting, which indi,ca.ted.that the'requested variance does not meet variance standards,. and that.a confo-rming'sign would identify the�use adequately... He submitted'pic- tures illustrating two:,points;. (1) No need for :a large sign because:of. the un -. obstructed�view.of the property; (2) Th sign would -be too far ,from the.. freeway to attract motorists... from Mc-:- Givern•further stated that the Board of Zoning. Adjustments .did not grant the variance. Mr.. William ,Hilligoss, of Western Che - ro.let and Mr.. Stansbury of Nelson Neon were:present and-spoke in support of the requested variance. Mr. Hilligoss stated that X30 ,foot; high sign would not be visible from the freeway due to the elevated,highway..and the guardrail. He claimed,that.the bulk his busi -' nes:s is freeway oriented.._ Cons.iderable•discus;sion followed in which it was-observed that a study the sign ordinance-.is required for .pos- sible.revision.!
