Box 3603, Santa Rosa, Calif. 95402, to renovate the Petaluma Swim 20 Center Bath House. 21 22 RECOMMENDATION: 23 24 Recommend Approval 25 26 BACKGROUND: 27 28 The Petaluma Swim Center project includes the complete renovation of the shower - restroom 29 facility. The Bathhouse does not comply with the American's with Disabilities (ADA) Act, 30 including access into the building restrooms and shower facilities. The access for spectators 31 and swimmers alike required transit through the showers in order to reach the pool deck. 32 These inadequacies are to be addressed by the renovation project. The restroom facilities 33 were not commercial grade resulting in numerous problems during the swim season, 34 especially during periods of heavy use. The project will increase the size of the sanitation line 35 leaving the building and install commercial grade fixtures. 36 37 In addition, due to the wet environment around the Swim Center, a great deal of dry rot has 38 occurred, especially at the front entry, interior walls and the lifeguards' office. These 39 deficiencies will also be corrected. 40 41 KNE Construction, the third low bidder submitted a letter (exhibit A) stating that both the low 42 and second low bidders had not filled out the bid submittal forms appropriately. Also, in their 43 letter of protest, KNE Construction questioned the subcontractors who would be performing 44 the work. Staff spoke to the low bidder and has received a letter (Exhibit B) from them 45 confirming which subcontractors would be doing the required work. Staff believes that the 46 letter from C.G. Builders adequately identifies who will be doing the various portions of the 47 project and the sloppiness in filling out the bid form does not affect the project bid submittal 48 (see attached memo, Exhibit C, to Rich Rudnansky dated 2/10197). Staff recommends that 49 the City Council waives the minor bid irregularities. 50 51 The project's bid proposal was divided into the base bid, alternates 1,2, and 3, in order to 52 provide for award flexibility in case bids came in high. The base bid includes all minimal work 53 to renovate the bathhouse. 54 55 Alternate one includes running additional hot water lines to the pump room's; Alternate two 56 involves replacement of an existing 4" sanitation line with a 6" line; Alternate three substitutes 57 aluminum doors and frames identified in the specifications with steel doors and frames. 58 59 Staff recommends awarding the project for the base bid, plus alternates two and three. 60 61 The following is a summary of the bids: 62 63 Name Base Bid ALT 1 ALT 2 ALT 3 64 65 C.G. With staffs 72 recommendation of base bid and alternates two and three, the total contracted amounted 73 would be $233,977. 74 75 To make up the shortfall, staff recommends reallocating $50,000 currently appropriated for 76 Wiseman Park, to the Swim Center Project. The Wiseman Park funds were to be used 77 towards tennis facilities at the park. The Recreation, Music and Parks Commission, as part of 78 their long range plan for the Kenilworth Junior High Athletic Fields, are looking to combine 79 tennis court efforts at both Kenilworth and Wiseman Park as part of their overall master plan. 80 Sufficient funds for this endeavor are appropriated for Wiseman Park next year (1997 -98) to 81 meet this need, so there will be no adverse effect to the Wiseman Park area. 82 83 ALTERNATIVES: 84 85 1. Award the contract to the second low bidder Hamilton Enterprises, in the amount 86 of $250,000. 87 88 2. Not award the contract and rebid the project. 89 90 CONSEQUENCES OF NOT ACTING: 91 92 The renovation of the Petaluma Swim Center Bath House would be delayed, impacting the 93 opening of the Swim Center for the 1997 Swim Season. 94 95 ACTION FOLLOWING AUTHORIZATION: 96 97 The contractor would enter into an agreement with the City of Petaluma, a notice to proceed 98 would be issued, and construction started. 99 100 101 JC /ss / #68:kswimctr 102 103 104 105 EXHIBIT "A" r Ir Ir CONSTRUCTION IMC• Lk. We are protesting the low and second low bidders proposal due to irregularities in their bid documents. BID SCHEDULE; CG Builders Inc.'s Bid Schedule is not completely filled out in the Total Bid category, per Addendum # 1, item 7. "The Bid Schedule (Bid Form 13ID -6A) provides a line for Lump Sum and a second line, Total Bid: under the heading of Base Bid. Both of these lines should have the some amount when filled .4Vi ,," The upper lime was left blank in the CG Builders, Inc. Bid Schedule. M LIST OF SUBCONTRACTORS CG Builders Inc. has missed labeled their entire list. The names of the Subcontractors are incomplete, no addresses or phone numbers are provided and are placed in the wrong category. 1030 Second St. • Santa Rosa. Carpentry, Rough or Finish We would expect that CG Builders Inc. would provide their own forces to complete these phases of the work, i.e. paid on CG Builders Inc. payroll, at the Prevailing wage for each category and not be paid as a Subcontractor via a 1099 payment, this includes the owner CG Builders Inc., as well. Hamilton Enterprises' Subcontractor's list is also incomplete and did not list the following Subcontractor Classifications: I. Concrete demolition and Soft demolition. 2. Excavation 3. Concrete forming, steel placement, finishing and sealing. 4. Masonry 5. Carpentry Rough or Finish 6. Tile Setting 7. Roofing, cleaning or repairs 8. HVAC and sheetmeal 9. Plumbing 10. Electrical Again, we would expect that Hamilton Enterprises would provide their own forces to complete these phases of the work. i.e. paid on Hamilton Enterprises payroll, at the Prevailing wage for each category and not be paid as a Subcontractor via a 1099 payment. Builders (low bid) was non - responsive for not properly filling out the bid documents. I have met with Fleming Nguyen, Associate City Engineer with the City of Petaluma regarding the allegation. Fleming and I concur that the irregularities are inconsequential, and do not affect the overall bid proposal. I have listed each allegation below with our findings. Allegation A) The bid schedule provides a line for lump sum and a second line, "Total Bid ". Comment: Addendum No. 1 specifies that; "Both of these lines should have the same amount when filled out." Since the line item is for the base bid, and C.G. Builders did fill out the "total bid" item, staff believes this omission is inconsequential. Allegation B) C.G. Builders missed label their entire bid list. Comment: C.G. Builders did list description of work under the heading "Name of Subcontractor; names of subcontractors under "Address of office Mill or shop;" address under "Description of work..." Again, staff finds this point inconsequential to the bidding of the project. -.. I . C) C.G. Builders did not list a number of job classifications required for the project: 1) Excavation 2) Paving 3) Striping 4) Concrete forming, steel placement, finishing and sealing. 5) Cabinetry 6) Cabinetry, rough or finish Comment: On the advice of Mr. Nguyen, I have obtained a letter (attached) from C.G. Builders where they identify each task area and their response regarding responsible party, as required by law. With the letter Mr. Nguyen and I believe the City has enough clarification to award the contract to C.G. Builders. I notified Mr. Keith Norman of KNE Construction of my recommendation, and upon his receiving a copy of the C.G..Builders letter regarding job categories, Mr. Keith indicate "I will not be hearing from him again regarding this subject." I have placed this item on the February 18, 1997 City Council Agenda. If you believe I am in error with my findings, please notify me by Friday, February 14th, 1997. JC /ss / #68:sclet
