MINUTES OF MEETING
OF CITY COUNCIL
PETALUMA, CALIFORNIA
September 30,, 1968
Council Meeting Special meeting of'.the Council of the City
of Petaluma called to order by Mayor Putnam at
the hour of 7:30 o'clock p.m.
. Attendance
Present: Councilmen Battaglia, Brainerd,
Cavanagh, Jr., Colin, Joerger,
Lipman and Mayor Putnam.
Absent: None.
Notice of the Call
Notice of the Special Meeting called for
September 30, 1968, the certificate of the
City Clerk of the delivery of said notice and
the consent of the members of the holding of
said meeting, submitted and filed.
Purpose of the
The meeting was called to consider and act

upon the matter of additional costs for diking
required for the Petaluma River Dredging
Project and to adjourn to an Executive
Session.
Additional Diking
Director of Public Works David Young reported
Costs
to the Council that the dikes for the Petaluma
Res. #5091 NCS
River Dredging Project constructed by the
City's contractor, Paul Respini, were
spected_by the L Corps,of Engineers' dredging
contractor, Shellmaker, Inc., and not approved.
He read a letter from,the Corps regarding
inspection. Said letter submitted and filed.
Mr. Young explained that the' Corps does no:t
issue specifications for dike construction;
however, they were built in accordance with City
specifications and basically the same as for
past dredging projects. He referred to a
clause in the agreement between the Corps and
Shellmaker indicating that the dredging con-
tractor is fully responsible for the adequacy
of the levees. Mr. Young continued by saying
that in order to provide acceptable dis-
posal area levees, the dredging contractor is
requiring additional compaction and leveling
work. He read a quotation from Shellmaker,
Inc., for $2500 for-the work and also stated
that he received a quotation from M. Amaral
Company f,or $2350. Shellmaker, Inc., bid
submitted and filed. Mr. Young recommended
that Shellmaker's bid be; accepted despite
the fact that it is slightly higher than the
low bid, pointing out that the work would
then conform to the dredging contractor's
requirements for adequate levees as work done
by any other contractor would still be subject
to Shellmaker's inspection and could possibly
involve further expenditure and work. Mr.
Young suggested that in order to avoidccon-
fusion in the future that contact be made
with the Corps to consider inclusion of dike
construction in dredging contracts as an,alter-
nate and the cost therefor be paid by the
local agency.

Additional Diking Considerable discussion followed and Council -
Costs man Colin again emphasized that the City
Res. #5091 NCS Manager contact Congressman Calusen to urge
(Continued) the Federal Government to take care of the spoil -
age areas for maintenance of the River, and as sug-
gested' by the City Manager, also initiate the
ass stance ,o,f the County since most of the work
being done is located outside of the corporate
limits of the City. The City Manager was so
directed.
The: City. Manager was also directed to communi-
cate with the Corps of Engineers calling their
attention.to the points raised regarding the
problems encountered with,the dike construction
and•ther.suggesti,ons made to- better the procedure
in•the future.
Upon conclusion.of the discussion, Resolution #5091
N.C.S. authorizing additional work on diking
required to be constructed for dredging of the
Petaluma River to Shellmaker, Inc., was intro -
duced by- Councilman Colin, seconded by Council-
man Joerger -, and . adopted by.7 affirmative
votes. Councilman Cavanagh, Jr., voted a
"reluctant" aye,., stating that he was not
opposed to the diking but disapproved of the
way it is being - done.: Councilman Colin-requested
the minutes to show that the additional.work
was ,awarded to Shellmaker, Inc., the high
bidder,.as,,pointed out by the Director of
Public Works.

Adjournment There being no further business to come before
the Council,, the meeting was adjourned at 8:00
O'clock p.m.•to an.Executive Session.
