OF MEETING OF CITY COUNCIL P'ETALUMA,, ,CALTFORN'IA January 6, 1969 Regular meeting of the Council of the City of Petaluma called to order by Mayor Putnam at the hour of 7:,30 o;' clock p.m. Present: Councilmen Battaglia, Brainerd, Cavanagh, Jr., Colin, Joerger, Lipman and Mayor Putnam. Absent: None. The invocation was given by Reverend Glenn W. Schafer, Church of the Nazarene. The minutes of December 16, 1968 and December 23, 1968 were approved as recorded. X3 In order to review the subject matter, the City Clerk.read the Council minutes of Septem- ber. 16, 1968 and October '8, 19.5.8 concerning the W. J.:Petersen Minor Subdivision Map for property located at 7.55 Cherry Street, filed by J. W. Combs, and their appeal to one of the four con_di:tions set forth, i.e., to dedicate a 10,0 foot radius at the.. curve for future street widening, purposes-.,. Mr.'. Robert .Mackey, representing Mr. J. W. Combs, appeared before. the-Council requesting reconsideration of the requirement, pointing out that p,re,sently the City does not have any plans for s >treet . deve- lopment in the area, and that when the street is constructed, possibly a 100 foot radius would not be needed. He stated that in checking,with the Planning Department, Mr. Combs could build without com- plying with the requirement; however, such pro- cedure would not ,provide clear title to Mr. Combs', parcel which is required by the particu- lar-financial institution involved. In order to facilitate development of the parcel, Mr. .Mackey proposed that the Council consider dedication of the right -of -way by Mr. Petersen at the time the street is to be constructed. He further added that Mr. Petersen is willing to comply with.the three..remaining conditions. Director .of Publi -a Works David Young showed a sketch of.the.parcel, indicating the alignment o the required 100, foot radius. He added that there are no guide lines -for over -all street improvements in the vicinity at this time but that a,recommendation for funds to set up an assessment district in the Cherry Street and surrounding area is. -to be considered by the Council in , its-review of the Capital Outlay_.program, for 19,68- 1969. After some discussion,,a motion was made by Councilman Battaglia and seconded by Councilman Joerger, amending, the-Council's previous action and direct -ng the, City Attorney to prepare an agreement between the- 'C -i and Mr. Petersen, that when the.0 ty - builds the street, or an _assessment district is ,formed, a curve radius not to exceed 100 feet will be dedicated at no charge to the City. Res.. #5143 NCS 31 ABC Letter, dated December 26, 1968, from John Nolan, Recording Secretary'of the Mayors'.and Council - men's Association of'Sonoma County, requesting that the'Council determine if any member of the Council i.s, iriteres;ted in being designated the Association's representative on the Board of Directors of:the Golden Gate Bridge and Highway District, read and filed.. It explained by the Mayor that nomination of a Council,member would be forwarded to the Mayors' and Councilmen's Association for - consider-"ation at its meeting on hext'Thursday along with other nominees from various cities in Sonoma County for designation of one repre- sentative:from this area. Councilman Joerger nominated Councilman- Colin. Said nomination was seconded by Councilman Battaglia. Council- man Lipman-then nominiated Councilman Brainerd and Co Cavanagh, Jr. Said nomination was seconded by Councilman Battaglia. Following some discussion on the proper procedure to follow, both motions were withdrawn and a secret ballot taken to select one of the three names resulted i-n choosing Councilman Colin. The Mayor stated that Councilman Colin's name will -be submitted as a nominee. Assessment District Resolution #5147 N.C.S. finding and determining zoom- #6 N.S. - Surplus in that there is a surplus in the -fund provided for Fund the improvements made in Assessment District #6 Res. #5147 NCS N.S., City o-f Petaluma., County of Sonoma, State of California was introduced by Lipman, seconded by Councilman Cavanagh, Jr., and adopted by 6 affirmative: votes, l abstention. Councilman Joer.ger'abstained and stated that he owns property in the subject area.
