May - 12,:1969 Council Meeting Adjourned'meetng of the Council of the City of , Petal:uma was called to order by Mayor Putnam at the hour 7:30 o'clock p.m. Attendance Present:- Councilmen Battaglia, Brainerd, Cavanagh, Jr Colin, Joerger, Lipman and Mayor Putnam. Absent: None. Compact Car - Notice to bidders on the subject vehicle was duly Park Dept. published. City Manager Robert Meyer reported Res. #5221 NCS that - the.following two bids were received at the bid opening for the subject car on May 7, 1969: Trade -In Sanderson Motor Co. $2,132.3.6 $200.00 $1,932.36 Western Motors 2,026.05 300.00 1,726.05 Mr. Meyer recommended acceptance of the low bid whereupon Resolution #52 -21 N.C.S., awarding contract for purchase of one .(1) 1969 Four -door Compact - Sedan :to Western Motors, was introduced by Council- man Lipman, seconded -by Councilman Brainerd, and adopted by 7 affirmative votes. Appeal - Appeal filed by Heath and Company on behalf of Harold Butler Enter- Harold Butler Enterprises, Inc. of Planning Com- prises regarding mission decision denying variance to permit an over - Denny's Sign . _ - -sized sign at ;4986 .Petaluma Boulevard North (north - Res. 15222 NCS easterly corner - Petaluma Blvd. North and Industrial Avenue) for proposed Denny's Restaurant, read and filed.. All the required documents were duly filed,. Director of-Planning McGivern briefly reviewed the application fo-r a sign 58 feet in height and a total aggregate area for two signs of approxi- •mately 3,16.2 square feet which exceeds the maxi- mum and .area for all signs on the site. In conclusion, Mr. McGivern stated that the staff - recommended the sign because of the number of signs erected in the immediate area. He added that a study of an ordinance regulating signs along the Freeway should be studied. Mr. Thomas Speer of Harold Butler Enterprises, Inc. was present support of the appeal pointing out that the sign is designed to pick up Freeway ve- hicular traffic and that the height is necessary to overcome :obstructions in the area. Following consideration of the facts presented, Resolution. #5.222 N.C.S. of findings of fact and action taken.by the Petaluma City Council on the appeal -of Heath-and-Company on behalf of H,arold.Butler Enterprises, Inc. from the Planning Commission's den•:al of their appli- cation for a..vari.arice, -was introduced by Councilman Battaglia, seconded by Councilman Cavanagh, Jr: and adopted by 7 affirmative votes. May 12, 1969 Resignation,- In recognition of the of Leigh Shoe= Supervisor Leigh maker as Supervisor of the Second Supervitbrial Shoemaker District of Sonoma County, a,motion was made by Councilman Colin and seconded by Councilman Joerger, that an appropriate letter of commenda- tion be sent, to, Mr. Shoemaker and that a formal resolution be prepared for presentation as soon as possible. AB 135.6 City Attorney Robert reported that Ass'embly'Bill 1356 - Placing Firefighters in cities under the Employer-Employee Relations Act is designed to clarify the question whether firefighters em- ployer - employee 'relations in Cities are covered by the Government Code or by the,Labor Code and cause firefighters to be covered by the Employer- Employee Rela:tions.'Act as embodied in Senate Bill 1228. Councilman Cavanagh, Jr. stated that he voted "No" because of, the questions raised regarding Section 5 (g) and -felt' some changes could be made therein. Councilmen Colin and Joerger abstained and both stated that they are financially interested in service stations.
