MINUTES OF MEETING - OF CITY COUNCIL PETALUMA, CALIFORNIA November 3, 1969 Regular meeting-of the Council of the City of Petaluma was called to order by Mayor ,,,,Putnam at-,the hour of 7:30 p.m. :Present: Councilmen Brainerd, Brunner, Cavanagh, Jr., Joerger, Mattei, and Mayor Putnam. Absent: Councilman Battaglia. Due to the absence of the - Reverend Charles O'Leary, S.t. James Catholic Church, no in- vocation was given. The minutes of October 20, 1969 were approved as recorded. Letter, dated October 21, 1969, from James "Ed" Reed, resigning from the Petaluma Plan- ning Commission, effective November 3, 1969 as business 'interests make it necessary to relocate to the State of Florida, read and filed. Resolution No. 5355 N.C.S., accepting resignation of James E. Reed from the Plan- ning Commission was introduced by Councilman Brunner,.seconded by Councilman Mattei, and adopted by 6 affirmative votes, 1 absentee. The City Clerk Was-directed to send an approp- riate letter of regret to Mr. Reed and also wish him every success in his new business. Petaluma - Sanitary, -, Le.tter_,:dated October 30, 1969, from Dario Disposal Company A. Calegari, President, Petaluma Sanitary Disposal Company, requesting that a Council Committee be appointed to meet with represen- tatives of their company to discuss refuse removal service in the City, read and filed. �j It was generally agreed by the Council to grant the request; whereupon, Mayor Putnam appointed the following Council members to the Committee: Councilmen Brainerd, Joerger, and Mattei. Councilman Joerger was asked to serve as Chairman of the Committee. The City Clerk was directed to notify Mr. Calegari of the Council's action. P. U. C. Public Utilities Commission Order extending time to Walter Henricksen in order to com- ply with the provisions of Decision No. 75945 authorizing.oper.ations as a passenger stage corporation, read and filed., Agenda A motion was made by Councilman Mattei and seconded by Councilman Brainerd adding con - s1de'ration of a claim for personal injuries to the Agenda. Resolution No4 N.C.S., approving Claims' and Bills Nos 4.452 to 4522 inclusive and,Nos 2714 to 2'731 inclusive, was. introduced by Councilman Brunner,, seconded by Councilman, Cavanagh,, Jr., and adopted.by 6 affirmative votes, 1 absentee. Annual-Reports Annual Reports for 196`8- 1969'wer.e submitted and filed 'by :the. Finance Department, City Attorney, and Recreation, M is!ic and Park +s Commission. The staff was commended for the excellent reports. In reviewing the reports,, which are - required by the City .Char- ter., C'ounc'ilm_en Cavanagh, Jr., and Joerger' commented on the elaborateness o.f the reports and.questioned the value, expens'e.and staff time involved. Upon conclusion of constructive comments heard, the City Manager was I asked to,explore the possibility of modifying the present system of preparing annual reports. City Manager Robert Meyer referred to a letter dated October 30, 1969, received from Fitzgerald & ' - Von Der Mehden, Attorneys at.Law, requestin.the Council schedule a hearing to allow protestant Mrs. Georgia Cort an opportunity to present evidence regarding a protest-concerning a non-con- forming rental use of property at 8:4.62 D Street, Petaluma. Said letter submitted and filed. Mr. Meyer noted that the Coun- cil has received a memo from the City Attor- ney on the matter together with all reports and correspondence relating thereto. Said memo and attachments submitted and filed. Mr. Robert added that City ordinances do not provide any appeal procedure from the issu- ance of the building permit; however, he recommended that the Council listen to the protest, but take no action. Following con- siderable discussion, it was agreed by the Council to hear the matter, and the City Attorney was directed to notify Fitzgerald and Von Der Mehden that a hearing is scheduled for thp C'oun,cil meeting of November 17, 1969 at'7:3;0 p:m. with a time limit of thirty min - utes. Study Session Mayor Putnam reminded the Council that one November 1969 of the items for-'discussion at the subject study session will be the Downtown Core Area Plan and the Faustman Parking Report. The City Manager was requested to furnish the Faustman Report to those Council mem- bers who do not -have a copy. California Marine Confirming Mayor Putnam's appointments, Reso- Parks•'& Harbors. Assn. lution No. 53 -58 N.C.S., appointing Vice -Mayor Res. #5358`N.C.S.. City Attorney Robert reported that no word has been received from Santa Rosa City Attor- ney John Flitner-,- ,representing the City Attorneys of Sonoma County, regarding ,qu'es- tions to be asked the Attorney General's office concerning the subject matter, and adding, ;that ,i.t .appears from a recent news - paper arti.cle., -the Attorney General has not definitely decided whether or not to file ,a suit. He stated that there is no need. to pass any legislation at this time: Mr. Robert was asked to keep the Council in- formed ,on any developments regarding the matter. Planning Commission Resolution #34 -69 of findings -, report and recommendation of the Petaluma - Planning Commission relative-to proposal to establish precise plan lines for East Washington Street ,from Baylis Street to.Hopper Street, submitted and filed. Dir ector,of Planning McGivern..reported that following two public hearings and delibera- tions.by the Planning Commission of the five plans submitted for consideration, Plan A -2 -1 is being recommended to the Council. Proposed, Mr. Hayes Planning Consultant Community representing Young America Homes, appeared Development before- the Council with a proposal of a concept for a planned community development combining single - family homes with multiple structures on a 11°0' -acre .parcel located on North.McDowell Boulevard. The development would require-modification of the existing = Zoning Ordinance to provide for lots less than 6,000 square,feet minimum and higher dens, zies., Mr. Ron Simpkins of MacKay & Sotps engineering firm and Mr: Robert O'Neal, - ­President Young America Homes, were pre - 'sent and-also spoke on the proposed develop - ment. Upon conclusion of the presentation, a request was made for a response from the - Council whethe °r or not to pursue the matter• with the - Planning Commission. The Council generally indicated that the proposal should -be. studied -by the Planning Commission. Mr. .`,Hayes-was referred to the Planning Commis- sion-for consideration of the development. 'Planni-ng Director McGivern noted that such a-proposal ;would' require a comprehensive "study and its priority among the items currently under study.
