HomeMy WebLinkAboutMinutes 02/02/197041 MINUTES OF MEETING OF CITY COUNCIL, PETALUMA, CALIFORNIA February .2 , 1970 Council Meeting Regular meeting of the City Council of the City.of Petaluma was called to order by Mayor Putnam at the hour of 7:30 o'clock .p.m.. Attendance Present: Councilmen Battaglia, Brainerd, Brunner, Cavanagh, Jr., Joerger, Mattei, and Mayor Putnam. Absent: None. Invocation Due to the absence of the Reverend Kenneth Russell, St. James Church, no invocation was given. Approval of.Minutes Minutes o January 19, 1970 - the follow- ing words were added at the top of page 4 to carry on from page 3: "- mended that the Council approve the ". Also, at the request of Councilman Joerger, the follow - ing.was added on page 8 under the item "ABAG" after the words "Federal Granting Authority ": "Upon questioning by Council- man Joerger; it was stated by Mr. Baget that it was-not absolutely necessary to belong to ABAG in order to receive Federal funds. He also stated that from a prior- ity standpoint,, it was an advantage to belong. "-. The minutes of January 19, 1970 were then approved. -The minutes of January 26, 1970 were approved as recorded. Boy Scout Mayor Putnam welcomed the many Boy Scouts Government Day in the audience who were present to observe Council procedure in preparation -for Boy Scout Government Day on February 10,,1970. Jeff Cohen - Mayor Putnam recognized Jeff Cohen, Senator Senator-Collier's Collier's local representative, present Representative in the audience. ABAG Mr. J. Julien Bag:et, Executive Director of the Association of Bay Area Governments (ABAG), introduced Mayor Talbert W. Bean 5/ of Sonoma, elected official of ABAG repre- senting the cities of Sonoma County. He spoke to the Council from the standpoint of an elected official of the Association and a member city of the Organization. He discuased_ the functions of the Association, particularly in the areas of regional planning, open space in parks, airport planning, solid waste disposal, air pollution.and transportation studies. He spoke of the benefits of membership and of the increasing importance of ABAG in the Bay Area counties.—Mayor Bean pointed.out that in ABAG's role to review Federal grant applications for recommenda- tion to the.Federal Granting Authority, a.footnote.is included if the applicant February 2, 1970 ABAG is a non - member. He added that membership (continued) in ABAG I -s not manditory; however, the amount of Federal funds to cities-are often limited, and the fact that the applying city is a .non- member-, could have .some :- effect on the decision of the grant application. Upon.conclus'ion of Mayor Bean's presenta- tion,_ it was decided by the Council to fur- ther discuss ABAG at the study on Monday, February 9, 1970. Mayor Putnam thanked both Mayor Bean and Mr. B'aget for their information and for the material furnished to the Council and staff on ABAG. Petition - Pe.tition,'da.ted January 24, - 1970, from W. Georg and W. Georg, and Mary Isaak, 4245.Petaluma Mary Isaak Boulevard North, Petaluma, requesting suspension of certain requirements of the Master Sewer Plan with respect to the sewerage of their property located within the boundaries of Ass,essment,Dis- trict #6 N.S.(in which they participated) in order to make more feasible the sale of their property, read and filed. Mrs. Isaak was present and explained that it was their-understanding direct access to the sewer line would be available across the street at. ,a distance of '1.75 200 yards, but that Sewer Master Plan requires connection to the line on Corona -Road . at a distance of 400 yards. Follow- ing a brief review of the request w ith Director of Public Works David Young,, the matter was referred to the sstaff. for a. complete report thereon at the Council �( meeting on February 1.6, 1970. Parade Letter, dated_ February 2., 1970., from J. Res.. #5400 N.C,S. Hayes Hunter`of the Petaluma Junior. High School, requesting a joint parade. with Kenilworth Junior High School on Febru- ary 13, 1970, read and filed. Report, dated January 2'9, 1970, from Chief of Police Larry Higgins, stat.ng` that the request has been_ cleared - with the Traffic Committee and that he recommends Council approval of the event; whereupon, Resolu- tion No. 5400 N.C.S., consenting to a parade to be held - jointly by the Petaluma Junior High School and Kenilworth Junior High School on February 13, 19'7'0, was introduced by.Councilman Joerger, seconded by Councilman Brainerd, and adopted by 7 affirmative votes. Regulations re Letter, dated Jan•u_ary 16, 1970, from J. Construction of W. Higgins, requesting that Ordinance Public Improvements No. 711 N.C.S., regulating the construe tion of curbs, gutters, sidewalks, and driveways within.the City of Petaluma, be amended in favor of a proposed ordi- nance change recommended by the City Attorney in 1969 with regard,to bond requirements, read and filed. At the re- quest of Mayor Putnam, it was agreed by the Council to withhold action on the subject matter until a report is received from the.Mayors' and Council - men's Association. of Sonoma County with its recommendations. Appeal - Letter, dated.January 28, 1970, from Conditions re Herbert W. of Bundesen Real Bundesen's Estate, advising that the subject Parcel Map appeal is .being withdrawn, read and filed.. e c1q Use of Copy of report, January 21, 1970, Wickersham to the Parks and Recreation Commission Park from City,Attorney Robert, stating that, i-n his opi -pion, it is permissible to install a bocce ball court in Wicker - sham Park, submitted and filed. As explained in the opinion, Wickersham Park. was received-as a gift in the will of Mrs. Maclay with no restrictions in the will except that the park be used as a park.forever. TOPICS Letter - , dated January 23, 1970, from Program James A. Moe, State Director of Public Work that an apportionment of $62,988 to the City of represents the City's share in California 1969 . - 1970 fiscal year's allocation of Federal TOPICS funds, w-th.a list attached of rules regarding use of said funds, read" and fi.led._ Director of Public Work's David Young reported that a meet- ing will be held in Santa Rosa soon with representatives of the State Di- -vis;ion.of.Highways and the Federal agency involved.for information and details on the program. Mr. Young was asked.to keep. the Council informed on the matter.; Employees' Health Resolution -No. 2836.7 of the Board of Insurance Plan Supervisors of_Sonoma County, authoriz- ing.the:City_of,;Petaluma to participate in the Sonoma County Health Insurance' Plan under certain. conditions, sub - mitted and filed. The City Clerk was d - irected to send a letter of apprecia- tion to the Board of Supervisors. `�I s t f 33 � 1413 r 420 February 2, 1970 Land Conservation Contract 41 Letter dated January 22, 1970, from Lillian Novak; Assistant Clerk, Sonoma County Board of Supervisors, giving notice that on February 24, 1970, the Board inte -nd's to enter into or authorize execution of a land conservation contract with respect to certain lands within one mile 'of the City of Petaluma; namely, Asses'sor's Parcel, ;No. 20.- 060 -01, 245 -.62 acres owned by W.. M. Pacheco,.read and. file(!. Director of Public Works David Younq presented a location map of the parcel involved;; whereupon, a motion was made by Councilman Battaglia and seconded by Councilman Joerger that the City _Counci.l of -lie City of Petaluma has no objection to -lie Board•of Supervi- sors executing a land conservation con - tract.for thel parcel involved. Motion carried unanimously. PUC PUC Order instituting investigation into requirements for a General Order on siting of electric generating plants and certain electric transmi -s- Sion facilities of all electric' public utilities in the State of California, submitted and filed. Claims and Bills Councilman Brainerd complained about Res. #54 N.C.S. the large holes in the "Welcome" sign at the south.f're'eway entrance to Peta- luma.' Adding to this complaint, Direc- tor-of Finande Gealta also noted that' the lights on the sign have been out for the past several months. As main - tenance of the "Welcome" signs at both the north and south entrance is under contract with the Barber Sign Company.' through the Chamber of Commerce, Coun- cilman. Cavanagh, Jr., Council liaison with the Chamber, was asked to contact .the Chamber about. the proper maintenance and necessary immediate repairs of the sign. Re olution No. 5401.N.C.S., approving Claims and Bills Nos. 5007 to 5066 inclusive; and Nos. 2 to 2871 'inclusive, was introduced by Coun- cilman Matte:i, seconded by Councilman Brainerd, and adopted by 7 affirmative votes. McGregor Avenue City Manager Robert Meyer referred to Safety Problem a letter received from Mrs. Richard G. Cook, 1713 Kearny Street, Petaluma, that the McDowell School PTA Board has asked her to start a drive to correct the McGregor Avenue safety problem. Said letter submitted and filed. Mr. Meyer stated that the letter will be referred to the Traffic Committee for its consideration. t Sonoma County City Manager Robert Meyer referred to r Wate=r Agency - a letter :received from Mr. Gordon W,. Sena- tor Collier informed the City that a bill was.prepar.ed as proposed but declared unconstitutional - •._ Animal Control City Manager Robert Meyer referred to a Ordinance draft of a proposed Animal,Control Ordi- nance distributed to the Council and suggested that.the matter be discussed at a•study•s.ession. It was agreed to include this at the study session on February 9, 1970, together with fur- th,er, consideration of ABAG and regula,- _ tions concerni -ng construction of public improvements'. As observed by. Mayor Putnam,,'the general concern of the Council is actually not an objection to the disclosure of assets, but to the ambiguities - of'the law, thus creating con - fusion as'•to the requirements. in- volved. Regional Water 3n answer to Councilman'Brunner, Dir- Quality Control _ ector of Public Works David Young Board. reported on the recent television newscast that the City, of Petaluma was include.d,in the list of ten lead- ing offenders of, polluting the Bay waters.
