February 9, 1970
Council Meeting Special meeting of the Council of the
City of Petaluma was called to order
by Mayor Putnam at the hour of 7:30
o'clock p.m.
Attendance Present: 'Councilmen Battaglia, Brainerd,
Brunner, Cavanagh, Jr., Joer-
ger, Mattei, and Mayor Putnam.
Absent: None.
Notice of the Call Notice of the special meeting called for
Feburary 9, 1970,; the Certificate of the
City Clerk of delivery of said notice;
and, the Consent of the members present
of - the holding of said meeting, submitted
and filed.
Purpose of The meeting was called to consider and
the Meeting' act upon following items - air pol-
lution, ABAG, construction of public
improvements, and revision of the Animal
- Control Ordinance.
Air Pollution Mayor Putnam briefly reviewed the State
Res. #5405 N.C.S. law- establ- ishing the Bay Area Air Pol-
lution Control District for the purpose
of suppreasIng'and controlling air pollu-
tion. On -the effective date of the
Chapter 'of the State law creating the
D;istrLct, the ..law states that the Dis-
tr;ict, is . to begin to transact business
and to,exercise its powers in the Coun-
ties. of, Alameda, - Contra Costa, Marin,
San Franc is`. Co, . San Mateo, and Santa
Clara; but not in,the Counties of Napa,
Solano; and-Sonoma until or unless the
Boards of Supervisors of such counties
determine that there is a need for the
D;- strict to function in such counties
and declare this.fact by resolution.

The.May continued by saying that in
order for action to be taken by Sonoma
County, the Mayors' and Councilmen's
Association of Sonoma County appointed
four mayors from Sonoma County cities -
Healdsburg, Santa Rosa, Sebastopol, and
Petaluma to work.with city managers from
each of.these four cities, plus the Assis-
tant City Manager of Santa Rosa, to meet
'and explore what_ the cities might do
J,ointly•. Several Committee meetings
followed - one with rep - resentation from
the Bay Area Air Pollution Control Dis-
trict and another with mayors of the
four remaining cities in Sonoma County.
.It was generally - concurred that Sonoma
County was a -part of the pollution pro-
blem. It was .a.l,s'o the feeling that
- joining the BAAP;C District would be the
most acceptable: method of controlling
air pollut`ion.in..Sonoma County and
would be -less costly ($63,000 for 1970

(continued) and it was also felt that the cities
by individual ordinance could adopt reg=
ulations. However, it was decided by
the Mayors that the matter be brought
before each City Council of the eight
cities in Sonoma County for their views
and opinions. She requested an expres-
sion from the Council which could be
related to the Sonoma County Mayors'
and Councilmen's. Association Agenda
Meeting on February 12, 1970.
Mayor Putnam also made reference to a
letter from Supervisor Vella to Sonoma
Mayor Talbert W. Bean, President of the
Sonoma County Mayors' and Councilmen's
Association reporting on the air pol-
lution, measures taken by the County of
Sonoma since 1967 and the investigat-ion
by a committee on the possibility of
handling .air ,pollution, on, a local level
rather than &.distr.ict level. It
was noted that in:`the letter a public
informational meeting on air pollution
will Ibe by the Sonoma County Board
of Supervisors'at 3:00 p.m,. on February
16, 1970. Copy of said letter submitted
and filed.

sider the idea of recommending that
Sonoma County join the BAAPC Dist
or of hearing the Sonoma County pro-
posal of'forming a County Agency. Mr.
A. E. Poole, 1.4 Nob Hill Terrace, Peta-
luma,, addressed the Council regarding
details of pollution problems and recom-
mended against j.oini-ng the:'BAAPC District.
Mf. Robert Day 'of.' Rohnert Park suggested
that the Board of Supervisors be asked
to, present a definite and specific pro-
posal o:f'a county program.
Upon conclusion of the deliberation,
Resolution.No. 54'05 N.C.S.,. recommend-
ing that the County of Sonoma join
the , B ay Area Air Pollution Control
District, was' introduced by Councilman
Battaglia, seconded by Councilman Joer
ger,.and defeated by the following vote:
AYES.: Councilmen Battaglia, Joerger,
and Mayor Putnam.
NOES: Councilmen Brainerd, Brunner,
Cavanagh, Jr., and Mattei..
ABSENT: None .`
In response�t'o Mayor Putnam's request
for p.ositi've action, a motion was,made
by- Couricilman,Mattei and seconded by
Councilman Joerger that the cities of
Sonoma County be afforded an opportunity
to hear a presentation of the Board', o
Supervisors' air pollution program and

Air Po- llution no action be' taken by the Board at its
Res'. #5405 N.C.S. hearing on February 16, 1970, so that
(continued) th'e cities may 'react to the Board's pro -
gram before a decision is reached:
Motion carried unanimously. The City
Clerk was asked to , furnish the Mayor
with - the Council's action for the meet-
ing on February 12, 1970.
ABAG Mayor Putnam stated that at her request
Res. #5406 N.C.S. the matter of the of Bay
- Area'Governments was included on the
agenda for possible.consideration of
action a this time rather than for fur -
'ther review at a�•study session.
In the discussion that followed on the
possibility of again joining ABAG (City
of Petaluma withdrew from the organiza-
tion on April 15, 1968), Councilman
Joerger' reiterated his reasons for
strongly objecting to membership. He
particularly expressed concern about
the possibility of ABAG being designa-
te'd a's_a regional government and thus
creating another layer of government
with taxing powers and the right of
eminent domain. 'He requested that
the Council hold the matter over for
further study. After careful consid-
er,ation, Resolution No. 5406 N.C.S.,
authorizing and directing -the Mayor
to execute an' agreement to provide
for membership of the City of Petaluma
in the Association of Bay Area Govern-
ments, was introduced by Councilman
Brainerd, seconded by Councilman Battag-
lia., and adopted by the following
vote:
AYES: Councilmen Battaglia, Brainerd,
Mattei, and Mayor Putnam.
NOES: Councilmen Brunner, Cavanagh,
Jr., and Joerger.
ABSENT: None.
Councilman Brunner stated that he was
not qualified to vote until he actually
observed the Organization in action.
Councilman Cavahagh, Jr., felt that
the Council wars rushing into the matter.
Construction of Councilman Battaglia., Chairman of the
Public Improvements_ Council Committee on Public Improve-
ments; reported that a recommendation
on the subject matter will be presented
at "the next Council meeting. He re-
quested Committee and staff members
to be present at a meeting on Wednes-
day morning at 8 :00 a.m., noting that
included for-consideration will be the
request made by T. W. Higgins to amend
Ordinance No. 711 N.C.S.

Animal Control Mr. Bill Mathews, Animal Control Officer,
Ordinance appeared before. the Council to review a,
proposed draft of. revisions to the Ani
mal Control Ordinance. Charts we're used
_ in his:pre_sentation to illustrate the
proposed fees - Submitted and filed was
a report,, dated February 6, 1970, pre-
pared by Finance Director Cecil Gealta,
comparing present and proposed fees.
Aiso� present was• Sonoma County Animal
Control Officer. Wallen who of re-
lated..comment.s. -A number of changes
were discuss:e:d, and it was agreed by
the Coun.cill to continue the study with
City Attorney Robert after his return
from Europe.
Adjournment There� being no further business to come
before the Council, the meeting was :ad-
journed-at 11:15'o'clock p.m.
