Council Meeting Regular meeting of the Council of the City of Petaluma called to order by Mayor Helen Putnam at the hour of 7:30 o'clock p.m. Attendance Present: Councilmen Brainerd, Cavanagh, Jr., Colin, Gans, Joerger, Lipman and Mayor Putnam. Absent: None. Invocation The invocation was given by Reverend O. V. Mag- nussen, Elim Lutheran Church. Pledge of Allegiance At the request of Mayor Putnam, everyone in the Council Chambers joined with her to give the �. Pledge of Allegiance to the flag. Approval of Minutes The minutes of January 17, 1966, were approved as recorded. Councilman Lipman requested that the last sen- tence under "City of Orange Resolution of the January 24, 1966, minutes be changed to read- : "It was Councilman Gans' opinion that expression of support could be better done by individuals : in•various ways Frather than by a resolution." Minutes of the meeting of January 24, 1966, were approved as corrected. Following a brief review of the modifications by Director of Planning Robert Byrd, Resolution #44.41 N.C.S. adopting certain modifications�to the General Plan, was introduced by Councilman Colin, seconded by Councilman Cavanagh, Jr.., ..and adopted by 7 affirmative votes. McDowell Blvd, Water City Manager Robert Meyer reported that 16 bids Main Extension were received at the bid opening on February 2,,. Res. 1,4442 NCS 1966, for the subject project and that Director. of Public Works David Young recommends the low bid of Argonaut Constructors, Santa Rosa, Calif., ;ZO be accepted,, whereupon Resolution #444:2 N.C..S. ' awarding contract in accordance with the plans and specification entitled "'McDowell Blvd. Water Main Extension, McGregor 'Avenue to Casa• Grande Road., Project W65 - to the low bidder, was introduced by Councilman Brainerd, seconded' by Councilman Joerger, and adopted by 7 'affir- mative votes. Purchase of 1 Sedan Breakdown of bids received at bid opening-on and 3 Compact Cars February • 3., 1966, for the subject purchase,," Res. #4443 NCS submitted and filed. McDevitt Company, 511 Francisco Blvd,., San Rafael, petitioning the Council's approval of sewer main extension to „Assessor's Parcel 5- 06,0 -20 (located southwe.s;ter1y side of Lakeville Highway near Lindberg Lane) and -;pro rata•repayment of the line, read and filed. This ,request was referred to the staff for reparation of, a.n agree- ment for Council consider "a ion at a later- date February 7, 1966 ; 31 James B. Oberto and suggesting that Mr. Oberto be permitted to attend the Western Plumbing Officials meetings regardless of where they are held, read.and filed. 93 Assessment District Before the opening of the public hearing, Council - #.9 man Joerger. stated, that he would have to abstain from any voting that might take place and refrain from.any conversation regarding the subject matter because of being a property owner in the district. The Mayor announced that the hearing will be adjourned at 10 o'clock to a specified date and-- - time. This being the time set for the hearing of pro- tests on the proposed improvements and acquisi- tions,for Assessment District #9 N.S., the City Clerk announced that written protests had been received from each of the following four pro- perty owners in -the- district: 1. Joseph,Lorenz, 276 Corona Road, Petaluma. .2.. O. Malacredi; 81 Ely Road, Petaluma. - 3. Sanderson Properties, 13 Petaluma Blvd. South, Petaluma. 4. Howard Heggum and College Park Associates. Before hearing any,.oral protests, Mr. Edwin Ness of Sturgis, Den -Dulk, Douglass & Anderson, bond attorney, for the :subject district, briefly re- viewed the legal,aspects connected with the dis- trict. Mr..Bev Whitlow, principal in the firm of ,Whitlow, .Hoffman,...and Albritton, Engineer of Work for the .subject district, generally .out - Lined the basic data.of the cost of the district. He .stated that the cost of the work at the time the notices were sent out was approximately $898 thousand dollars which will be reduced about $76 thousand dollars due to the low bid received at the. bid •opening on January 31, 1966, for the proposed improvement,work of the district. A new estimate of cost has been prepared and re- wised notices will be sent out soon reflecting an _ overall-reduction in cost of about based on the bids received. Mr. Whitlow then explained in- detail th'e proposed installation of the im- p•ovement work.and the breakdown of costs with use of.the following - exhibits: 0' February 7, 1966 Assess. Dist. #9 NS 1. Areas of Benefit, Sewer and Water (continued) Facilities. 2.- Areas of''Benefit, Street and Drainage Facilities. 3. Unit Assessing Costs for Sewer, Water, Street and Storm Systems. Mr. Whitlow pointed out that the costs have.been revised based upon the bid received 'for the work. A 5- minute recess was declared,. The meeting was called back -to order at approximately Mr. John Lounibos, attorney with the firm Louni- bos & Lounibos,.Petaluma, representing protest- ants Joseph Lorenz, O. Malacredi, and Sanderson properties,- reviewed the protests subm tted them and raised questions relative to the'work, cost and procedure, which questions were mainly directed at Mr. Whitlow. Upon question regard- ing the change of the bonds from 191.1 to 1915, Mr. Ness read his letter, darted November 29 1965,,•addressed to-City AttorneY Edouard Robert setting• forth -his recommendation, for the use .of the. Improvement Bond Act of -19...15 for _Assessment District #9 N.S. rather than the 1911 Act 'bond. Mr. John Waner, attorney with the firm of DeMeo, DeMeo, -Foster. & Waner, Santa Rosa, Calif., re- presenting protestant Howard Heggum and CO31eg,e Park Associates; commenced reviewing the protest submitted by them and raised questions regarding the work, dost and procedure.. He was granted permission to mark the exhibits displayed by Mr. Whitlow as the following protestant exhibits: Exhibit #1 - Areas of Benefit, Sewer and Water Facilities. Exhibit #2 - Unit Assessng' Costs .for Sewer, Water; Street and Storm Systems. Exhibit-#3 - Areas of Benefit, Street and. Drainage Facilities. During Mr. Waner's presentation, copy of - petition of the•wbrk and resolution of intention were pre- sented and marked as protestant exhibits as follows: Exhibit #4 - Copy of petition of the work Exhibit #5 - Copy of Resolution of Intention #42103 N.C.S. These exhibits were submitted to the City Clerk for filing in a separate file entitled "Protest Hearing - •As District #9 N.S." The time being 10 10Vp.m. , the Mayor delcared the hearing on Assessment District #9 N.S'. adjourned to 7:30 p.m. - on Thursday, February 17, 1966.. Claims and Bills Resolution #4444 N.C.S. approving claims and bills Res. #4444 NCS Nos'. 8313 to 8458 inclusive and Nos. 255 to 269 inclusive was introduced by Councilman Joerger, seconded by Councilman Lipman, and adopted by 7 affirmative-votes. Boy Scout City Manager Robert Meyer polled the Council to Government Day find out who would' be able to attend.the -Boy Scout Government Day on February 8, 1966, at 9:00 a. m•. _City of Petaluma After contacting a'number of firms to perform the Audit audit for the City of Petaluma, the Mayor recom- mended that the,Council consider the firm of Wadsworth, Smith and Mohrman be employed for 'this C work, whereupon a motion was made by Councilman � Gans, and seconded by Councilman Lipman, that the Mayor's recommendation be accepted. Letter from Wadsworth, Smith and Mohrman regarding thoir qualifications and fee for the work was submitted and filed. North'Bay Division Councilman Joerger stated that he would hold Leagu& of Calif. over his report on the subject meeting until Citries''-'Quarterly the next regular Council meeting. Meeting Airpgrt,Site Study Director of Planning Robert Byrd reported that progress is being made on the subject study, and it is expected that it will be another two months before the final report is submitted to the Counci,l.. 701.Planning Grant Director of Planning Robert Byrd reported that Application formal application has been made for a conference on the subject application, which has been scheduled for next week. It has been indicated " that.it will require approximately five months for processing. Therefore, actual costs will be carried over into the next fiscal year. Outside Sewer Permit Director of Public Works David Young report, Application - dated February 3., 1966, re subject outside sewer Philip ,Justis appli-caton.for connection of seven single - family residences Iodated at Paula Lane and Paul's Lane., read and filed. A map locating the area and.showing the sewer line was shown by Mr. Young.. Mr. Young explained that a gravity main has been constructed through Mr. Justis' property which will. 'some day connect into Line A -1 of the Sewer Master Plan, and until the construction of Line A -1, Mr. Justis requests to pump by private force main into the existing City system at Paula Lane and West Street. Mr. J ustis, has also;: - indicated that he will maintain the force:. main. without cost to the City. Mr. Justis was present.and spoke in support of his application, also stating that plans for annexa- tion are being prepared by his engineer at the r' present time. Mr=. Young commented that the seven connections include two other property owners in addition to five for Mr. Justis, and recommended that a condition be required that all: parties receiving connections sign the peti- tion for annexation. During the discussion that followed it was pointed out that the area does not conform entirely to City standards, which, Mr Young added, is due mainly to the fact that the County of Sonoma does not have a good lot sp.lit.ordinance. Mr. Dal Pagetto ,representing Dave Cader, developer of nearby Cader�Subdivision #3,._addressed the Council, requesting that care- ful consideration,bd.given to annexation of substandard areas.. Mr. Cader added they are simply asking that all subdividers receive the same treatment.. Considering the facts presented, it was decided that''more information was needed _- on the matter, a motion was made by Councilman Joerger and seconded by Councilman : Gans, that the subject application be delayed until the next Council meeting. Roll call on this.mo.tion carried.by 6 affirmative and 1 negative vote. The negative vote was cast by Councilman Cavanagh, Jr., who desired to act upon.the applicati.on:at tonight's meeting. The City Manager was.asked to provide the Council with more information and to arrange for the Council to visit the site. Tom I'saak•,• Student Body vice- President of', the Petaluma High School 7spoke to the Council. about the Governor's Conference on Youth held last semester in• Sacramento for the purpose of developing communications between adults and youth and that now,a' conference is being or- ganized on-a local leve1%-by the County S :uper- intendent of Schools >. He added that the chief. goal of this conference is to propose� action on. the, problems of youth in Sonoma. Co.
