Council Meeting
Adjourned meeting of the Council of the City of Petaluma
called to order by Mayor Helen Putnam at the hour of 7:30
o'clock p.m.
Attendance
Present: Councilmen Brainerd, Cavanagh, Jr., Colin,
Gans, Joerger, Lipman and Mayor Putnam.
Absent: None.

Ordinance #820 N. C. S. amending Zoh'ing Ordinance #662
Prezoning
N. C. S. by amending Section 21 -1200 to provide for pre-
zoning of unincorporated territory, was introduced by
Councilman Gans, seconded by Councilman Colin, and
adopted by 7 affirmative votes. q
'Washington Street-
Ordinance #821 N. C. S. authorizing .purchase of lands for
Bodega Avenue

Clarence C. Baal, Jr.
Petitions containing 974 signatures submitted and filed. Mr.
Res: #4467 NCS
John Waner, Attorney for Clarence C. Baal, Jr., Fire Chief.,
appeared before the Council and questioned that an executive
session to hold a private hearing is authorized under the
Brown, Act. He read Se c tion 54950 and referred to Section
54957 of the Government Code, which states a precise ex-
ception that in the case where a public officer is involved, it
does authorize an executive session to consider a personnel
matter provided that that public officer does not request a
public hearing. After studying said sections, the City
Attorney verified the exception. He commented that under
the City Charter and existing ordinances, there are no
-
hearing provisions and that the public hearing is a matter
of discretion of the Council. He suggested. three alternatives
for Council consideration:
'-
1. Hold no hearing
2. Hold an executive hearing and conceivably be
subject to the provisions of the Brown Act.
3. Hold a public hearing and the Council can exclude
the witnesses.
Following a brief discussion, it was the Council's decision
to hold no hearing. At this time Councilman Joerger re-
quested permission to read his statement. However,
Councilman Gans suggested that the statement be postponed
to a later meeting or be given to the press as he felt that
reading the statement at this time would open up a public
hearing. The statement was withdrawn. Resolution #4467 `
N. C. S. approving the discharge of Clarence C. Baal, Jr. ,
Fire Chief, was introduced by Councilman Gans, seconded
by Councilman Cavanagh, Jr., and adopted by 7 affirmative
votes.
Adjournment
There being no further business to come before the Council,
the meeting was adjourned.
