The minutes of May 11, May 16, and May 23, 1966, were
approved as recorded.

Planning Commission Resolution #U.10 -66 denying Use Per-
mit application filed by Mrs, Frode Svendsen, 415 Prospect
Street, to .allow 4 non - ambulatory retarded children in her
home (R -M -1500 zone) , submitted and filed. Appeal,
dated May 23, 1966, from Mrs. Svendseiz of Planning Com-
mission decision. and a request to bring the, case - before the
Council, read and filed. Mrs. Svendsen was present and
asked for a two -week extension of the hearing to allow more
time to. prepare. material for,her case. Mr. Robert
Mackey, attorney representing opponents in this matter, re-
quested the Council to proceed with the hearing inasmuch, as
a group was _present to protest the appeal. After a brief
discussion, a motion was .made by Councilman Joerger, and
seconded by Councilman. Battaglia, that the hearing be con-
tinued until the next regular Council meeting on June 20,
1.966. Roll on this motion carried by 7 affirmative
votes,
U. S. Army Corps of Engineers Public Notice #66 -70 that
the City of Petaluma has applied for a Department of the
Army permit to install two force mains and an outfall sewer
in the Petaluma River at Peta- luma., California, and that any
objections should be ;fo:rwarded in writing to the Corps of
Engineers not later , than :3.0 days, submitted and filed.
Letter; dated May 23, 1966, from Homer Oliver, President
Petaluma Pony League, thanking the Council and staff for
the wonderful, cooperation; and kindnesses in the past and re-
questing a heavy oil or armor coat be put on the access road
to the park,. read and filed. The City Manager stated that
the Director of Public' Works has indicated the base on this
road is-- adequate to. place an oil treatment over the surface.
The Council decided that this was a reasonable request and
asked- the City Manager,-to take care of this matter as soon
as .possible in or -der, to. the dust problem, and to
inform the Pony League ofi the Council's action.

Budget. Request "
The Gity Manager commented that good news w.as
received today and read a letter, dated. June 3 1966
.from the Federal Water Pollution ,Control Administra-
tion that our request for consideration of a ten per
cent increase in the amount of grant for the Water---,
Control Facilities project has been approved. Sub-
ject letter was submitted and filed. Planning
Director Robert Byrd wa's commended forYfis, fine .
work in preparing and submitting the application
for this grant.
City- Manager Robert Mey' r sated that a letter had
been, received from 1the Chamber of .Commerce re-
quest ng..a contract for the :sum of a $10, 000 budget
for the 196.6=67 fiscal year promotional activities.
Copy. of letter was submitted and filed. It was
noted' that this: request w111 be considered during
budget study. '
Executive Session The City. Manager :requested that an, executive

study to discuss several litigation matters,

June 6,, 1.966:
American. Hotel City Attorney Robert stated' that in answer to the May 27th
Property letter received from the Leppos' attorneys (copy of which
was furni8 the Council), quotes received for the
demolition of the American Hotel building and a copy of a
letter from the California Division of Housing were for -
warded to them, .further adding that he has advised them
that if their clients have not expressed an intention to act
- on their own by June .10, 1966, the City will proceed to
award a demolition contract to the low quote and that it
was his understanding the Council will continue to order
summary proceedings under the Building' Code. Mr.
Robert said that if the Leppos do not act, the Council
meeting should then be adjourned to June 13th to consider
award of the contract and a special resolution reciting the
facts of the situation and an indication that the abatement
is necessary and should be collected by special assessment
under our contract with the County to collect our taxes
Councilman. Colin expressed .concern about thewal'1 be-
tween the American Hotel and the adjacent building. How -
ever, the City Attorney pointed out that no prediction
could be made with regard to this matter. In reply to
Councilman Joe rger, the City Manager stated that 'a
recommendation will be made to the iCouncil of employing
a firm to document all evidence in connection with the
subject property for future information.
Budget Study The City Manager explained the new procedure for review -
ing the 'budget this year. However, after a short discussion
on the budget, Councilman Cavanagh,. Jr. ; requested ad-
ditional time to study the budget, whereupon the Council
agreed to devote part of the time at the June 13th Council
meeting to continue with the budget review. A repre-
sentative of the Chamber of Commerce was asked to be
present at the 13th meeting and a representative of the
Library Board at the 20th meeting to discuss their budget
requests.
Personnel A motion was made by Councilman Colin, and seconded by
Ordinance Councilman Joerger, that the Council vote on the subject
Ord. 4837 NCS ordinance. Roll call on this motion carried by 7 affirma-
tive votes, whereupon Ordinance #8'37 N. C. S. amending
Chapter 2 of the Petaluma City Code of 1958 by adding
thereto Article IX, Sections 2. 88 through 2. 103 to estab-
lish a personnel system, was introduced by Councilman
Cavanagh, Jr., seconded byCouncilman Colin, and ordered
posted by 7 affirmative votes.
Adjournment There being no further business to come before the Council-,
the meeting was adjourned to an executive session and to
Monday, June 13th, 1966 at 7 :30 o'clock p, m.
