Adjourned meeting of the Council of the City of Petaluma called
to order by Vice - Mayor Colin at the hour of 7:30 o'clock p. m.
Present: Councilmen .Battaglia, Joerger, Lipman, and Vice -
Mayor Colin..
Absent: Councilmen Brainerd, Cavanagh, Jr. and Mayor
Putnam.
Councilman Cavanagh, Jr. ,. entered the meeting during the read-
ing of the first letter on the agenda. The time was approximately
7 :32 p. m. �l
Letter, dated July 19, 1966, from Lou Abos & Lounibos regarding
injuries sustained by Floyd G. Mahan on Hopper Street and that
as a result of these injuries, he has sustained general damages
in the amount of $50, 000.. 00 and special damages in an amount
not presently ascertainable, read and filed. Resolution #4572
N. C. S. denying claim of Floyd G. Mahan, was introduced by
Councilman Lipman, seconded by Councilman Battaglia, and
adopted by 5 affirmative votes, 2 absentees.
Local Agency Formation Commission notice of public hearing
regarding the subject annexation (area near Maria Drive) to be
held at 3:00 p,, m. on August 4, 1966, at the Board of Supervisors'
Meeting Room, 2555 Mendocino Avenue, Santa Rosa, - Calif.,
submitted and filed.
City Man agerRobert Meyer stated that the subject audit has

been filed and that the matter will be discussed at the next
Council meeting: He asked. the Council to review the audit and
let him know whether or not it will be necessary to have the'
auditor present.
The City. Manager stated that he :received a request from the
Retail Committee of.the Chamber of Commerce to
delay commencement of work on the Keller Street Parking Lot
until after August 8th so: that :the lot will be available for parking
during Sidewalk Sales Days on August 6th and 7th. Because of
this. request, Mr:. Meyer added, the Keller Street Parking Lot
project wily , star.t after August 8th.
Moore Bu "sil'iess The .City Manager reported. that -the Chief of Police received a
Forms, Inc, letter of gratitude from the subject company for the quick re-
covery their stolen car.
Sales +Tax The City Manager noted' :that a :report has been submitted by
Transactions Director.of'Finance Cecil Grealta.regarding sales tax transactions
for. the.frst calend`ar.quarter of .1966 (January, February and
March) -and that the: total Taxable'Sales increased 8.77 over the
same quarter the prior year. •as cornpared with a statewide in-
crease of 7. 67 .

Sewer Bonds In answer to the City Manager, Councilmen Cavanagh, Jr.
Joerger and Vice- Mayor 'Colin stated they plan to attend the
lunch as guests of Stone & Youngberg in San Francisco on
Tuesday after the $2',�350, 000 check for the sewer bonds has
been issued by the'.Bank of..A merica.

The City..Manager.at this time told about•his discussion- with
the -Federal Govern-ment-,a-nd they reaffirmed that if a contract
is awarded for all-parts,,-:.even though subject to cancellation
ands subject to the receipt of -federal funds, a federal grant
would not be avaHable: uiider'•such conditions for those parts
which done at this •time with the f unds available now
and *if we intend; .to secure any federal funds, it would be
necessarys;for to readvertise for bids after obtaining
approval of. a grant. The staff, ii - i discussing the matter this
afternoon,- added, recommends awarding a con-
tract, for part of the project now (Portions A & F).
In discussing--the legal points of awarding Portions A and F
to. Charles J. -. Dorfman, who is the low dollar bidder for
those two portions the GUy. -Attorney stated that under the
Notice to Bidders and the Specifications, the City Council
has the -opportunity - ,and ability award a part, parts, or all
of the and has :the right toiwaive -irregularities. He
- suggested four -possibilities , for Council consideration:

It was his opinion that the low responsible bidder was
Charles J. Dorfman and that the Council should accept his
ret-raction of the condition-s,on the original bid by considering

After consideration of all thMacts presented, a motion
was made by Councilman Lipman to insert. the, name of
Cha-rle °s.J. Dorfman in the resolution awarding contract
for Portions A & F. The motion died for lack of. a
second. A motion was then. made by Councilman
Battagl •a,, 'and ' seconded by Councilman Cavanagh, Jr. , to
'insert th_e nam�of McGuire `& Hester in the resolution
awarding contract for Portions A & F. Roll call on this;
motion carried by the following vote:
Ayes: Councilmen Battaglia, Cavanagh, Jr.,, 'and
Vice -Mayor Colin.
Noes :. Councilmen Joerger and Lipman. .:
Absent' Councilman Brainerd" and Mayor Putnam.
Councilman Joerger, stated he voted "no" because he
thought the whole project should go out to bid again.
Councilman stated he voted "no "because he felt that
the award of contract•.to the Dorfman firm would save
the' City $14,•000 : and if the Council didn't accept the
low Md for the' two o _portions, the whole project should.
be readvertised'for. bids. =The councilmen voting.. "yes"

Boat Launching
Mr. *V. M. (Bob) Moir, Chairman, of the Sonoma County
Ramp
Harbor Commission, accompanied by Commissioner
Rutherford Putnam appeared to discuss the needs of a boat
launching ramp�on the`Petaluma River. He outlined fo'r.
Council' consideration, the procedure to follow in .obtaining
State funds for the project:
1. ' Send"a letter of intent as soon as possible to
the Division of Small Craft Harbors applying
for this facility and requesting them to finance
this type. of facility and giving them the approx
i�imate location.
2. That the Engineering, ,Planning and other de-
apartments start developing plans and es"timafe
of costs.for the project.
Mr.. Moir advised the Council that he.-and his staff will be
available for any assistance in the project. He .added
that the deadline date this type of an application .for,

, fund,8' is August 22nd. As a mattes of clarification 'he
pointed • out that this project and application for funds is
entirely separate from the Petaluma Small `Craft Harbor
program., In line- with Mr. Moir's suggestion, ,a motion
was made by Councilman Jo"erger, acid seconded' by
Councilman Lip man, to. send a letter of intent to the.
Division of Small Craft :Harbors in Sacramento,. Roll
call on 'this motion carried by 5 , affirma'tive votes, 2
absentees. The matter was referred to the City Manager
for attention.
High School Vice -Mayor Colin .recognized' the high school students in
