HomeMy WebLinkAboutMinutes 10/24/1966MINUTES OF MEETING OF CITY COUNCIL PETALUMA, CALIFORNIA October 24, 1966 Council Meeting Ad journe'd meeting of the Council of the City of Petaluma called to order by Mayor Helen Putnam at the hour of o p.m. Attendance Present: Councilmen Brainerd, Cavanagh, Jr., Colin., Joerger, Lipman and Mayor Putnam. Absent:. Councilman Battaglia. Invocation The invocation - was given by Reverend John Jaster, St. Johnfs Lutheran Church. Approval of The minutes of October 3 and October 17, 1966 Mai' -nutes were approved as recorded. ABAG­ Special notice from'the Association of Bay Area Governments that the 1966 Fall General Assembly will be held the Hotel Claremont, Berkeley, on Friday,.November 4, 1966, at 8:45 a.m., read and filed. Assistant City Manager Robert Byrd noted the importance of the meeting and urged the Council to attend. Mr. Byrd added that Councilman Cavanagh, Jr., the City Manager and he will be attending and requested others who are interested to notify Mrs. Wilson in the City Managerts office as soon as possible so that reservations may be forwarded. Proposition 2 - Letter, dated October 6, 1966, from Ambr se R. November 8th Ballot Nichols, Jr., President, Sonoma State College, giving information on Proposition 2, the State - wide Bond Issue for Higher Education, which measure will be on the November 8th ballot, read and filed. Councilman Joerger felt that endorsement of this measure was not within the scope of the Council. The Mayor requested that the letter be filed for reference. .Pre-emption of the _ Letter, dated September 23, 1966, from the Fi -eld of Building Advisory Commission Intergovernmental Re- Code's: lations, Washington D.C., explaining the Commission's recommendations contained in its report entitled "Building Codes:, A Program for Intergovernmental Reform," submitted and filed. Assistant City Manager Byrd summarized the letter and suggested that the City maintain its stand as indicated in the recent resolution adopted by the Council opposing the proposed federal and state pre - emption in the field of building codes. zing P'UC Public Utilities Commission Order author Petaluma and Santa Rosa Railroad Company to construct at grade an industrial track across Copeland Street, Petaluma, submitted and filed. Assistant City Manager Robert Byrd commented that this Order is a modification of the re- quest originally presented by the Railroad Company to the Council sometime ago, County -Wide Flood Letter, dated October 11, 1966, from Supervisor Control Advisory Leigh S.'Shoemaker, requesting an appointee to Committee serve on the subject Committee to replace former Mayor Norman Van Bebber, read and filed. It was expressed by Councilman Colin the same representative on the Sonoma County Zone 2 -A Advisory Committee serve on the subject Committee, whereupon a motion was made by Councilman Colin and seconded by Councilman Cavanagh, Jr., October 24, 1966 County -Wide Flood appointing Councilman J.oerger as the official Control Advisory City appointee .to said Commission. Roll call Committee on this motion carried by 6 affirmative votes, 1 absentee. In answer to the Mayor, Assistant City Manager Robert Byrd stated that Mr. Oberto has received a copy, of said letter, Governors Traffic Invitation from Governor Brown to attend Safety Conference the Governor ' s Traffic Safety Conference to be, held in the State Capital, Sacramento, on. November 17 and 18, 1966, read and filed'.. Assistant City Manager Robert Byrd stated , that Mr. Meyer would like two staff members of 'the .Traffic Committee to attend th.i's Con- ference, possib the Chief of Police and the City Engineer. The Mayor lalso suggested. that Co'dricilman Joerger, ex- officio member of the Traffic Committee, attend. Mr. Byrd asked those who will be attending to notify= Mrs. Wilson in the City Manager's office so that necessary arrangements can be made. Assistant City Mana,ger Robert Byrd briefly explaine the general idea of the census tract plan. IN October 24, 196 Population Letter,,da.ted October 18, 1966, from the Division of Highways that an official: certi f icate of estimated population for the City of Petaluma received from the State. Departmert of Finance indicates that as of Sep- tember 1, 1966., the population was 20,250 read and filed. ;Mosquito Abate #en,Notic.e from the Local Agency Formation Commission of merit District the County of Marin that a resolution for the annexa- tion of certain te-rr;ito_ry to the Marin County Mosquito Abatement District has been filed and that the public hearing has „been fixed` for November 3, 1966, at the hour of 7:30 p.m. in the Board of Supervisors Chambers, Civic Center, San Rafael, Calif., read and filed. Assistant City Manager Robert Byrd noted that the Sono - ma County Board of Supervisors will forward maps and data on this matter to us for our review prior to the public hearing date. Upon the suggestion of Council- man Joerger,. City Manager's office was asked to re- mind the Council of this date. Assistant City Manager Robert Byrd stated that he was advised by the County office that this District has never been in effect and that the proposed action is a formality to remove it from the records. _ Gas, Tax Fund Assistant City Manager Byrd reported on a meet- ing w h_ich he and Director of Public Works David Young attended in Santa Rosa today called at the request of Senator Collier to review and discuss modifications of the procedures of the gas tax fund. He added that ex- pe.rience with the Collier -Unruh Act proved that the administrative costs and paper work seem to be exces- sively high, and the purpose of this meeting wa_s to discover ways to make reasonable modifications to this legislation in o r_der to expedite the projects and help various communities who are having problems in this re- gard. Mr. Byrd and Mr. Young outlined the basic recom- mendations suggested for presentation at a future pub - li.c hearing,to consider modifications of this legisla- tion. �z Sv Annual Report Assistant City Manager Robert Byrd commented on the City A.ttorneyts Annual Report, adding that this com- pletes submission of annual reports by the'departments and that it is the intention of the City Manager to assemble these into one overall City of Petaluma Annual Report for 1965 - 66. The Mayor commended City Attorney Robert for a fine report. Study Session Progress on the Codes Enforcement Program was reviewed November 14th by Assistant City-Manager Robert Byrd. He pointed out 'that the Lakeville area is the major problem at the present time and that Councilman Joerger has requested a progress on particular area. In order t< move ahead with the enforcement of the requirements for this area, Mr...Byrd suggested that the Council review this specific problem at the. study session on November 14th so that the staff c -an receive Council direction or procedures. It was generally agreed by the Council to discuss this subject at the next Study Session. Outside Sewer Memo, dated October 24, 1966, to the City, Application - Manager from Director of Public Works David Robert Hayden Young that the proposed parcel to connect into Res. #4624 NCS the City sewer systemfronts on an existing City main and has- an existing IAtera;l that has never been used and tecommend'i;ng approval of this application, read and filed. Resolut ,on #4624 N.C.S..granting the application of'Robert H. Hayden connect one residential connection at premises located at 501 Sunnyslope Avenue, was introduced by Councilman Joerger, seconded by Councilman Colin, and adopted by 6 affirma -tive votes, 1 absentee. Establish Quorum - The City Attorney explained that when the Recreation, Music & subject Commission was reduced from 7 to - Parks Commission 5 members, the quorum was not changed and Ord # 855 NCS that the proposed ordinance established .a,. quoru of three members, whereupon Ordinanp.e #855 N.C.S. amending Cahpter 2, Article IV; Section 2.48 of the Petaluma City Code of 1958, to govern meetings of the Recreation, Music and Parks Commission and establish`a quorum thereof, was inttgduced by Councilman Brainerd,, seconded by Co Lipman, and ordered posted by 6 affirmative votes,, 1 a.b =. sentee. Taxicabs - Time of The Mayor stated that action on the sub;�ect Operation ordinance has been delayed until a later date. Rezoning Sanderson Ordinance #853 N.C.-S. amending the Zoning Property Ordinance #662 N.C.S. by rezoning the Sanderson Ord #853 NCS property from an M -L zone to a C -H zone,,,, was introduced by Councilman Battaglia, seconded by Councilman Cavanagh, Jr., and a,dopted'by 6 affirmative votes, 1 absentee. Sewer Connection Fees Mr. E. Rapoport, Pres1dent of C. B. & D. Cor- Ord. #854 NCS poration, subdividers of Petaluma Gardens Subdivision,- addressed. the Council regarding the proposed increase i.n sewer connection fees. He re.ad a letter he had received from the Feder -al Housing -Administration in response to their inquiry concerning the level of. sewer cconnectionfees being charged ,in the Northern California territory, which stated, that a review of data indicates two - thirds. of the cities s_urveyed.have seder connection charges of $28 to $165 and that the $3`00 fee �1 ZF 1 October 24, 1966 Sewe'r' Connection Fees being con.s'id.ered by Petaluma ranks among the Ord.; #854 NCS highest imposed by any community. Said letter (Continued) was submitted and filed. Mr. Rapoport then read a letter from his firm requesting post - .ponement of any increase in the sewer connec- tion fee, or if an increase is decided upon, exempt any Planned Unit Development. Said .letter was submitted and filed. Following a brief discussion period with Mr. Rapoport, a motion was made by Councilman Cavanagh, Jr., and seconded by Councilman Joerger, to delay action on the subject ordi- nance until next Council meeting on Novem- ber 7th. Motion was defeated by the following vote: Ayes: Councilmen Cavanagh, Jr., and Joerger. Noes: Councilmen Brainerd, Colin, Lipman and Mayor Putnam. Absent: Councilman Battaglia. Ordinance #854 N.C.S. amending Chapter 19, Section 19..40 of the Petaluma City Code of 1958 to establish connection fee schedule for the privilege of connecting to the sanitary sewer system of the City of Petaluma, was introduced by Councilman Lipman, seconded by Councilman Brainerd, and adopted by 6 affirmative votes, l absentee. In line with Councilman Cavanagh's concern of FHA s information regarding sewer connection fees which indicates that Petaluma is out of line, Mr. Byrd was asked as a matter of top priority to review this problem fully with FHA for a report back to the Council and for Mr. Rapoport's information. North Petaluma At the request of City Attorney Robert, the Sanitation District subject legislation was postponed for action at a later date. Sale of Scrap Resolution #4625 N.C.S. finding personal prop - Copper and Brass erty of approximately 300 pounds of scrap copper Res. #4625 NCS and brass is surplus, no longer required, and directing the City Manager to dispose of and sell the same, was introduced by Councilman Lipman, seconded by Councilman Colin, and adopted by 6 affirmative votes, 1 absentee. S.ewe.r Connection Mr. Carl W. Petersen, 815 East Washington Stree Fee Petaluma, commented on the sewer connection fee increase and felt that the individual property owner should not have to pay the same fee as subdividers. Golden Concourse At the request of Councilman Colin, Assistant City Manager Robert Byrd stated that-the matter of costs for the subject project will be dis- cussed soon with the Council. The Mayor announced that the meeting will not be adjourned to a study session but to an ex- ecutive session. Adjournment There bei - ng no further business to come before the Council, the meeting wasa djourned at 9:40 o'clock p.m. to an executive session to discuss pending litigation.
