HomeMy WebLinkAboutMinutes 11/07/1966Q_ X MINUTES OF MEETING OF CITY COUNCIL PETALUMA, CALIFORNIA November 7, 19'66 Council Meeting Regular meeting of the Council of the City of Petaluma called to order by Mayor Helen Putnam at the hour of 7 :30 o'clock p.m. Attendance Present: Councilmen Brainerd, Cavanagh, Jr., Colin, Joerger, Lipman and Mayor Putnam. Absent: Councilman Battaglia. Invocation The invocation was given by Reverend Father Paul Devine, St. Vincent'',s Church. Approval of The - minutes of October 24, 1966, were approved as Minutes recorded. It was requested that the minutes of November 1, 1966, show that Councilman Battaglia was present at the executive session held after the special meeting. The minutes of November 1, 1966, were then approved. Comments by Mayor Putnam spoke about Veterans' Day to be ob- the Mayor served on Friday, November 11th. She also re- minded everyone of their responsibility to our country and to those who serve our country to go to the polls tomorrow and vote. S Summons Summons - Argonaut Constructors versus City of Petaluma, submitted filed. The City Attorney stated that said summons is a follow up of a. claim previously filed against the City, and he felt that the matter is deserving of discussion at an executive session at such time it becomes pertinent. r- , C, Curbside Delivery of Letter, dated October 24, 1966, from Congressman Maid Don H. Calusen that the regulation banning door- to -door mail delivery service for new residential areas has been rescinded by the United States Postmaster General, read and filed. In answer to Councilman Lipman who wanted to know when curb- side delivery of mail will be discontinued and door -to -door reinstated on a local level, Planning Director Byrd stated that those areas now receiving service'on the street will continue to do so and will be phased out only when the local post- master finds it economically feasible. Mr. Don McKinnon of the Argus- Courier added that in dis- cussing the matter with Postmaster Smith, he was advised that the change will be made when the bud- get at the local post office is capable of handling the extra expenditure involved. The staff was asked to Check with the local postmaster on further details. U: S..- .Corps of U. -S. Corps of Engineers' notice of public hearings Engineers to be held-on San Francisco Sacramento -San Joaquin Delta, California, Water Quality and Waste. Disposal,-submitted and filed. The City Manager stated that this-matter has been referred to the Director of Public Works who will arrange to have someone attend. November 7, 1966 Entrance Signs Letter.. ;.dated October 24, 1966, from the Chamber of Commerce that the bid for the welcoming signs .for Petaluma has been awarded to the Barber Sign Company, read and filed. Mr. Richard Lieb, mem- ber of the Chamber's Board of Directors, stated that weather permitting, January lst has been..set as the deadline date :for the completion of the two signs -.one at the southern entrance and one.at the northern entrance to Petaluma. Chamber of Commerce Chamber of Commerce memo regarding activity as accomplished July - September, 1966; submitted and filed. The City Manager stated that he has been, contacted by the Chamber for consideration s mit:ting a 6 -month report instead of a quarterly report: After a brief discussion, it was de tided that the Chamber continue with the qua rtter= ly report as stipulated in the "Chamber of , Commerce Contract for Funds." Audit - City of Petaluma Financial Statements and Auditors' City of Petaluma, Report, June 30, 1966, prepared.by Wadsworth, Smith and Mohrman,, submitted and filed. Mr. Delos Smith of the auditors' firm, suggested that the liability coverage of the City be increased. The C,i,ty Manager .was asked to check into the possibility of addi'tion- al coverage as indicated by Mr. Smith. Personnel Rules Letter, dated November 3, 1966, from Everett A.. and Regulations Matzen, Chairman of the Personnel Board, recommend- ing that the Council take action to adopt the Personnel Rules and Regulations in accordance_ with the Personnel Ordinance, read and filed. The City Attorney suggested that the Council thoroughly re: view said rules and regulations because of the minor changes that were made since the rules were "studied by the Council. He also added that the subject rules and regulations be posted by the City Clerk and the matter of adoption be scheduled for the. next Council meeting. At the request_of Council- man Joerger, the City Manager was asked to furnish the Council with a list of the changes that were made.. Claims and Bills In answer to Councilman.Brainerd, the City Manager Res. #4626 NCS stated that he will contact the firm who installed the microphones in the Council Chambers about correcting the interference problem. Resolution #,4626 N.C.S. approving claims and bills Nos 9 to 9909 inclusive and Nos.. 680 to 694 'inclusive, was introduced by Councilman Lipman, seconded by Councilman Brainerd,, and adopted by 6 affirmative votes, 1 absentee.. Presentation of Director of Public Works David 'Young presented dip - Certificates lomas to Roy Kelly, Public Works Superintendent, and Dave Fettes,, Sewer -Plant Operator, for comple- tion of a one -year course entitled "Bio- Chemcial Roy Kelly Fundamentals of Wastewater Treatment" sponsored Dave Fettes by the Redwood.Section of the California Water Pollution Control Association. Floyd Dodson Mr. Young then presented a certificate. to Floyd Dodson, Chief Sewer Plant Operator, for success- fully completing an examination for Grade I'TI Sewer Plant Operator's license,. adding that this certificate is issued by the California Water Pollution Control Association. Robert Byrd City Manager Robert Meyer presented a certificate to Director of Planning.­rRobert Byrd for success- fully completing an 11- months' course sponsored by the International City Managers' Association. 1 5 November 7, 1966 Presentation of All four employees were congratulated and highly Certificates commended for their accomplishment and for their { �_ (Con`inued) service to the community. Mayors', and Council- The City Manager reminded the Council of the sub - men' ject meeting to be held in Healdsburg on.Thursday. Councilmen Brainerd and Lipman indicated they would not be attending. The City Manager's office was asked to contact those who plan to attend re- garding transportation and departure details. Annual Christmas The City Manager asked that the Council set aside Party December 17th for the annual Christmas Party, adding that details will follow later. Petaluma City Manager Robert Meyer reported that on Halloween Citizens' Band night the Petaluma Citizens' Band performed an out - standing service to the community in assisting the Police Department. He requested the Council to consider at the next Council meeting the possibility of a donation to this group for purchase of equip - ment, etc. Overlay Project - At the suggestion of the City Manager, the Council. Petaluma B1vd.No. directed the City Attorney to prepare the necessary legislation for the next Council meeting for payment to the County of Sonoma of the overlay work done on the portion of Petaluma Blvd. North uiith'in the City Limits. l�l Golden Concourse Councilman Colin, Chairman of the Downtown Redevelop - ment Committee; gave a•brief progress report on•the Golden Concourse. A meeting was held this morning, he added, and Mr Rimov was instructed to proceed with the project. It is expected, he said, that the Concourse will be completed before Christmas except for the installation of the electrical signs. The Downtown Redevelopment Committee, consisting.of Chairman Colin, Councilmen Brainerd and Lipman, was commended for their fine work on the Golden Con- course project. - For information of the press and downtown merchants, Director of Planning Robert Byrd stated that an attempt will be made to complete by Thanksgiving any work that in any way•will impede the Vehicular - pedestrian traffic in the area. Downtown Redevel- Councilman Colin stated that the,subject Committee opment Committee is concerned about other problems in the downtown area, and mow'that the Golden Concourse is nearing completion, another step toward revitalization of the.�business district will be considered. In answer to Councilman Joerger; Councilman Lipman said that the next step mind is the study of providing additional in the downtown area. Mr. Richard Lieb informed. the Council that Owen Fredericks has been appointed chairman of the Chamber's Downtown Merchants Committee. The City Manager and •Councilman Colin were asked to contact Mr. for coordination of the parking program. University of The Mayor spoke of a county -wide committee formed California Campus to work on the matter of locating a University of California campus site in Sonoma County. The mayor of•each city has been invited to serve on this committee and given the responsibility of selecting two other members. Mayor Putnam announced that she h appointed Mrs. Melvin Neilsen and Bill Soberanes. 1. 6 10 November 7, 1966 ABAG Mayor Putnam.reported on the Fall General Assembly of the Association of .Bay Area Governments held in Berkeley last Friday. Those attending from. r Petaluma were - City Manager Robert Meyer, Planning Director Robert Byrd, Councilman_ Cavanagh,.Cou:ncil- man Joerger, Mr..Floyd Wynne of the Argus - Courier and Mayor Putnam. The Mayor stated that the ing session was devoted to the-presentation of a preliminary Regional Plan. Director of Planning Robert Byrd told the Council that represeritatwes of ABAG will be present at the Planning Commission meeting on December 20th to discuss the Plan. He invited the Council and all interested parties to attend. Report of the Goals' and Organization Committee',to the General Assembly entitled "Regional Home Rule and Government of the. Bay Area" was the topic of discussion at the afternoon session. 'The Mayor read the resolution that was proposed and adopted. After a brief discussion by the Council, the City Attorney was asked to prepare for Council review an amendment to the "Regional Home Rule and Govern- ment of the Bay Area" as suggested by Councilman Cavanagh, Jr., which, in essence, would provide that if the voting procedure is changed'in any way, the entire concept should be declared null and void. The amendment th6h will be submitted to ABAG for consideration.at its meeting on Dec- ember 16th. Upon.the suggestion of Councilman Colin, the City Manager was asked to contacttthe County regarding the possibility of holding a' county -wide meeting during the�week of December- - 5th for the purpose of discussing the proposed amendments, etc., and then mention this at the Mayors' and Councilmen's meeting next Thursday. Extra Work - Water Following an explanation, by Director of .Public Pollution Control Works David Young for the extra work involved. Facilities, 1966 in the subject project and the need for 'a con- Project Unit #2 tingency fund to handle the extra work items,, Res. #4627 NCS Resolution #46,27 N.C.S. establishing a cont gency fund of $30,000 in Water Pollution Control Facilities, Project #2, was introduced..;by .Councilman Colin, seconded by Councilman Joerger, and adopted by 6 affirmative votes, 1 absentee. Taxicabs - Ordinance #856 N.C.S. amending Chapter 24, Time of Operation Article II, of the Petaluma City Code of 1958 Ord. #856 NCS by amending Section 24.36.thereof, to add a subsection "E" thereto, establishing the time of operation of taxicabs, was introduced by Councilman Cavanagh, Jr., seconded by Council- man Lipman, and ordered posted by 6 affirmative votes, 1 absentee.... The Clerk was directed to maid a copy of said ordinance to each of the taxicab companies. Establish Quorum - Ordinance #855 N.C.S. amending Chapter 2, Recreation, Music & Article IV, Section 2.48 of the Petaluma City Parks Commission Code of 1958, to govern meetings of the Rec Ord. #855 NCS reation, Music and Parks Commission and est-ab li'sh a quorum thereof, was introduced by Council- man Brainerd., seconded by Councilman Lipman,, and adopted by 6 affirmative votes, 1 absentee'-. Circus - Resolution #462`8 N.C..S. granting the 20 -30 Res. #4628 NCS Luncheon Club of Petaluma authority to conduct a circus ,in the City of Petaluma on April 9, 1967, ` was introduced by Councilman Joerger', s.econded.by Councilman Colin, and adopted by 6 affirmative votes., 1 absentee. Marina Councilman Cavanagh, Jr., was informed that if an individual is interested in the Marina development, advise him to send a letter to the City Manager explaining his proposal. November 7, 1966 Purchase of Surplus The City Manager explained the procedure involved Federal Property in purchases of surplus federal property and Res- 446 °29 NCS that the a•cquisi•tion.cost would be limited by the Charter, whereupon Resolution #4629 N.C.S. designat- ing Robert H. Meyer; City Manager, John C. Cahill, Assistant Director of Finance, and Warren Knieriem, Captain -Fire Department, as the representatives of the City of Petaluma authorized to sign for and accept surplus federal property, regardless of - acquisition cost, was introduced by Councilman Joerger, seconded by Councilman Lipman, and adopted by 6 affirmative votes, 1 absentee. Assistant Civil Resolution #4630 N.C.S. appointing Joe Ellwood, Defense.Director Assistant Fire Chief, as Assistant Civil Defense Res•.: #4630-NCS Director, was introduced by Councilman Lipman, seconded by Councilman Joerger, and adopted by 6 affirmative votes, 1 absentee. Boat Ramp In answer to Councilman Colin with regard to the status of the City's application with the State on the boat ramp, the City Manager stated that the request for funds is recommended to be a part of the Governor's budget in the new legislature convening in January, and.one. way to expedite the boat ramp facility would be to move ahead on securing the land for the site. He added that a meeting is scheduled on November 18th with the McNear's in regard to their land, which will be followed-by a report to the Council thereon. Marina. In answer to Councilman.Cavanagh, Jr., the City Manager.stated.that he has informed that the Division of.Small Craft.Harbors' meeting on November 20th and.21st does not include any matter concerning Petaluma. FHA. -.Re Sewer I•n.reply to Councilman Cavanagh, Jr., Director of Connection Fees Planning Robert Byrd said that he has written to FHA regarding the subject matter but a reply has not been received as yet. Weed`Abatement In response to Councilman Cavanagh, Jr., the City Clerk advised that the Fire Department is presently making a survey of the lots in the City-which con - tain weeds and that legislation will be presented to the Council either on November 21st or December 5th. Capital Outlay and Answering Councilman Cavanagh, Jr., the City Manager Personnel Classif- stated that the subject will be ready for cations Council study on November 28th and action in December Abatement Some discussion was held on the abatement procedure Procedure carried out by the Building Department. Councilman Cavanagh, Jr., that the program is "getting out of hand" and that a meeting should be held with the staff to clarify questions that have.been raised and to fully inform the Council of action taken by the Building Department. After some con - sideration, it was decided that the City Manager prepare the procedure that is being followed, the manner in which'properties are being abated, the different time elements invo.lved,, etc., and then. -/ it appears feasible, furnish copies of correspondence to the Council. American Little Mr. Bob Hammell of the American Little League League addressed the Council regarding turfing the in- field at Lucchesi Park. Following a brief ds- 13 - 8 cussioii, he was referred to the Recreation Com- mission for their consideration and recommendation of the matter to the Council. He was informed that their request appears on the Commission's} agenda for next Thursday night. Rhythmn Club Mr. Sullivan., owner of the Rhythmn Club, appeared before the Council regarding violations he had received from the Building'Departmen*t in connec- tion with his building. He, was asked to meet with Building Coordinator Robert Byrd and staff members regarding his problem. Market Councilman Joerger reported that the site plan for the proposed Lee, Bros. Market at west Pay,ran St reet and Petaluma Blvd,. North has been rejected by the Planning Commission because of the open drainage ditch through the property, and he felt that the Council should make a firm indication whether an open drainage ditch is desirable in areas close to major ,thoroughfares. It`was noted that the City Engineer and Flood Control recommended that the drainage problem be solved before a build - ing permit is issued. City David Young stated tha t a meeting is scheduled next Wednesday with representatives from Lee Bros., the'realtors, Flood Control, Zone 2A and staff, members to each a possible solution to the problem. Counc Joerger was asked to attend this meeting. The Mayor asked. that the Council be kept informed on the matter.
