Attendance
Regular meeting of the Council of the City
of Petaluma called to order by Mayor Putnam
at the hour. of 7:30 o'clock P.M.
Present: Councilmen Battaglia, Brainerd,
Cavanagh, Jr., Colin, Joerger,
Lipman and Mayor Putnam.
Absent: None.
Invocation
Reverend Fred Rusk of the First Presbyterian
Church invited the Council and the community
to attend joint communion services at the
Presbyterian Church on Thursday at 8:00 p.m., "
Good Friday services at the Evangelical Free
Church at 1:00 p.m., and Easter Sunday
services at any of the churches in the
vicinity. Following this announcement, Mr.
Rusk gave the invocation.

The minutes of February 27, March 6 and March
13 1961, were approved as recorded.

change of Rhodes Lane, off Petaluma- Valley..Ford Road,
west of Thompson Lane, Petaluma, to the new name
of "'Rohde Lane," submitted and filed. The
Director of Planning noted that this matter was
referred to the City for its information in.

Appeal - Jim Lutz
Letter, dated March 9, 1967, from Jim Lutz -by
P. Douglass Schwobeda, his attorney, appealing
the decision of the Planning Commission made
on March 7, 1967, granting a Use Permit to Tom
Gaffey to allow a service station in'a C -N
Zone, read and filed. 'Mr. P. Douglass Schwobeda
addressed the Council, and in reply to.hi,s re-
quest, the Council delayed the subject t +ter
until after the next agenda item regarding.

Mr. P. Douglass Schwobeda, representing the
Service stations
Petaluma Service Station Dealers, appeared
before the Council to discuss the problem;o >f
construction of new service stations in
Petaluma and to ask for legislation to pro-
vide for some measure of order. He sub-
mitted a ,petition dated March 2, 1967, signed
by thirty service station operators w.ho'are
members of the Petaluma Service Station: Dealers
and the Sonoma County Independent Service :Star
tion, Dealers Association requesting Counc.i -1
consideration of regulating new service sta-
tions in Petaluma. Mr. Schwobeda read several
sections of an ordinance adopted by the City
of Napa setting forth certain conditions with
respect to service stations.and also recited
various limitations and zoning restrictions'in
a :=- , number of other cities.. Mr. Bob Acorne,
President of the Petaluma. Service Station
Dealers', was also present in support of their
request. In conclusion, Mr. Schwobeda asked
the Council to study and enact legislation
similar to that referred to and futther asked
the Council to hold in abeyance any action on
the Use Permit or any zoning change until. such
a study is complete and a determination .has
been made by the Council. Planning Director
Robert Byrd commented that the Planning Co_.m-
mission for some time has indicated interest
in establishing some type of legislation - to
control new 'service stations in the C''ity.
After some discussion, a motion was made "by,"
Councilman Colin, and seconded by Councilman,.
Battaglia,, to refer this matter to a study.

Appeal - Jim Lutz
Mr. P,., Douglass Schwobeda requested that the
matter of the appeal filed by Jim Lutz be post-
poned iri order to,provide more time for re-

search on the subject. He pointed out that
upon notification from the City Clerk that
Tom Gaffey and his attorney had decided to
be present at the meeting tonight after being
notified earlier that they would be unable to

his presentation. Mr, John Fitzgerald, attorney
representing Tom Gaffey`, objected to Mr.
S.chwobed'a's request and asked that the Council
proceed with the appeal, After considering Mr.
Schwobeda's request and learning that both the_
applicant and appelant would be able to attend
the Council meeting on April 3rd, a motion was
made by Councilman.,Lipman, and seconded by.
Councilman Brainerd,. to delay the appeal until
8 o'clock p.m. on April 3rdc Motion carried_by
the.following vote:
Ayes: Councilmen Battaglia, Brainerd,
Cavanagh, Jr., Colin, Lipman and Mayor
Putnam =. .
Noes.- Councilman Joerger.
Claims and Bills
In discussing Claim #1.0612 covering repairs to
Res, #4.699.NCS
window damages at :the swimming pool by vandals, c
and at the request.of•Councilman Colin, the City
Manager stated he,would ask Finance Director
G'ealta to refer the matter of possible glass cover
age for the City buildings to the insurance cony:_.,
sultants recently appointed by the Council for a
report thereon,. Referring to Claim #10624 in pay-

ment for a step.bumper for one of the new trucks,
the City Manager stated that such items will-be
:included in the specifications in the future.
Resolution t4699 N.C.S. approving claims and bills
Nos. 10543 to 10659 inclusive and Nos. 883 to918
inclusive, was introduced by Councilman Battaglia,
seconded by Councilman Lipman, and adopted by 7
affirmative votes.
701 Program Funds
The City Manager read a letter from Associate Dir-
ector Howard Gardner of the League of California
Cities requesting an answer from the Council with
regard.to its reaction of the League's adopting
as �a matter of .policy the concept that the city.-,
contribution for a 701 project be increased from
the present one -third of: the total cost to half
of the total, cost, which procedure would spread
available federal funds among more cities and
activate more programs at an earlier date. How -
ever, it noted by Mr. Gardner that upon check-
ing with'the State Planning'Agency, it indicates
that Petaluma is one of about thirty cities which
have approved projd cts.awaiting the release of
additional federal funds before the program can
be started. Following a brief discussion, the Cit]
Manager was directed to notify Mr. Gardner that
the Council favors the city contribution remain.

..Collier-Unruh
The City Manager referred to a League of Califor-

nia Cities' bulletin wherein city officials of
cities within Senator Collier's district are asked
to personally contact him or adopt resolutions urg-
ing elimination-of the matching requirements and
the. combination of the administration of the two
gas tax funds which are now separately administerec
and - allocated - to cities under the Collier -Unruh
program.. At the request of Councilman Colin, the
Council directed the City Attorney to prepare a
resolution urging the elimination of the matching
r,equi cements as , set forth by the State, said
resolution to be sent-to Senator Collier.

Candidate's Statement
Upon a question from the City Clerk, the'
of Qualifications
Council approved the procedure f.or.the City
Clerk to collect $50 as a deposit at the time
nomination papers are-obtained if the `cand -
date wishes to file a:'"'Statement of Qualifi .
cations:. " . It-was noted'. -that the deposit is
to cover expenses involved in printing the
statement which is mailed with the sample_
ballot.

Zone 2A Flood Control
Councilman Joerge,r reported on a recent meeting
Advisory Board
of the subject Board which was actually unofficial
due to lack of a quorum.,"but many items were
discussed regarding erosion and drainage problems
in the area, adding . thatit the County Counsel has .
indicated a possible probtlem because of pending
litigation concerning Linda Del S ubdivision.
However, City Attorney Robert told of being
contacted by the County Couns'el's officersub-
sequently to this meeting and charif, ed 'that
the ��City''s litigation has- no bearing on what
the Sonoma County Flood Control District� does:
After a 0,'rief discussion-on the problems 'in-
volved and the apparent,-,,lack of action by the
agencies involved, ' -the Ci Manager w asked
to compile the nece'ss information to ,bring
the'Council up to date,:and schedule a study
session to discuss ,these ,matters .
Dredging -
The City Manager referred`to a communication

from Mr. Wolfe " of the N,avi ga_to?•i Department
of the Corps of Engineers to the City Engineer
that survey crews were here on Wednesday and
Thursday to take soundings and that the Corps.
does not know when they wi,ll.be able to do any
dredging,, if at all After the .findings are.
analyzed -a report will .be made to Washington,
if dredging seems to be necessary and that
any requests for- funds will have to compete
with other areas.' Mr. 'Wolfe added that. he
cannot begin to estimate when the channel-.will

be cleared, but did state. that they could ,not
possible have it cleared -by the yachting season
next month..

Swimming Pool
Detailed plans - and .des : ign of the proposed

shelter for vending machines were presented to
the Council by Director of Public Works` David
Young. Copy submitted and filed. Mr. .Ernie
Jensen,.local representative of the Coca -Cola
Bottling Company of San Jose, Industrial Vend-
ing Division, approached the Council with a
propos °al to building the structure for 5% of
the 10,% guarantee on ,vending machine sales .
(not. including °soft .drink vending machine sale's)
on a.•3 - year contract. After some discus ;s, on,,
a motion was made by Councilman Colin, and
seconded by Councilman Battaglia, approving
the construction of the subject structure by
the vending machine firm on "a 3 - year contract
for 5% of the gua rantee, and authorizing the
Mayor to enter into an agreement. Motion
carried unanimously.

The Director of Public Works reported on the
test taken after repairs were.made to the - swimming
pool and that said test indicates the leakage loss
has been corrected -. i
Director of Public Works David Young spoke to
Council about the expansion of joints in the con -
crete slab around the pool which have appeared
,after the leakage problem developed. He said
that this matter has been discussed with the ,
Recreation Driector, the Swimming Pool architect
and contractor. In accordance with the architect':
recommendation, which Mr. Young read, a- motion
was made by Councilman Battaglia, and seconded
by Councilman Joerger, to issue a purchase order
to W. R.. Grace Company for the caulking of the
deck for an approximate cost of $1000 - $1200.
Motion carried unanimously. Mr. Young added that
determination has not been made at this time_wheth-
er or not the contractor is responsible for the
joint problem. Councilman Cavanagh, Jr., re-
quested that.the contractor be notified of the
Council's action..

Report, dated March. 15, 1967, to the City Manager
from Fire Chief Ross Benton regarding the condi-
tion of the radio equipment at the Fire Department
submitted and filed. Fire Chief Benton addressed
the Council regarding the immediate need for new
radio equipment and Mr. Lang Yee, radio technician
confirmed the deterioration of the unit. A'motion
was made by Councilman Lipman, and seconded by
Councilman Colin, to purchase new radio transmitter
and receivers for the Fire Department, said pur-
chase to be paid out of the Conctingency Fund.
Motion carried unanimously.
Ordinance #863 N.C.S. prezoning Assessor's Parcel
#136-080-6 (- northwest corner of intersection of
Ely Road and E. Washington Street) to an R =M -1500
zone, was introduced by Councilman Joerger, .
seconded by Councilman Lipman, and adopted by 7
affirmative votes
Ordinance #864 N.C.S. authorizing the execution
of a Quitclaim Deed'•to a portion of'Mary Street
in' exchange: for a portion of land lying between
Kentucky Street and Petaluma Boulevard North, was
introduced by Councilman Lipman, seconded by
Councilman Colin., and adopted by 7 affirmative
votes.
Resolution #4700 N.. establishing a Civil
Defense add - Disaster Organization of the City of
Petaluma and naming and appointing the duties and
positions of certain :members of the City staff,
was.=introduced by.Councilman Colin, seconded by
Councilman Brainerd, and adopted by 7 affirmative
votes.

Councilman Joerger, and seconded by Councilman
Battaglia, setting-a policy that the color of all
future fire equipment be red, including the
subject sedan to be purchased and the Fire Chief'
present sedan. Motion carried by the following
vote
Ayes,: Councilmen Battaglia, Cavanagh,�Jr.,
Colin, Joerger and Lipman.
Noes: Councilman Brainerd and'Mayor Putnam.
Councilman Z rainerd qualified his "no" vote by
stating; that'he did not approve of spending tax
payers money to paint the Chief's car•when color
difference is of no consequence. Mayor'Putnam
stated she voted. "no" because at the time white.
was set as a policy, she was voting on a staff
recommendation and it seemed an - 'ate
policy decision. For clarification purpos;es,,.it
was agreed that the speci;ficat_ions for the subject
sedan to be purchased be changed from "pure white"
to "red" and that the City Manager be given at
least six months to repaint the Fire Chief "s
present sedan from white to red.

Sewer °'Request -
to req uest an outside sewer connection for a

mobile home development to be located at 4535
Redwood Hwy. South, Petaluma. In his presentation
to connect to the sewer system at no expense to
the City, Mr. Geokgedes outlined the tax structure
on a 20 -ye:ar projection plan as it relates to the
Petaluma area and referred to a study of mobile
homes made by the County Supervisors'Association
of California. Georgedes' engineer, Charles
Marshall, spoke of�the engineering plans for the
sewer line, and,Mr. Robert W. Wilson, of the
Financial Center Realty of San Francisco, address-
edd the council stating that his firm is pre -
pared to provide all the necessary funds for the
development. Director of Plaiming Robert F3yrd
pointed out that such a development would be in
conflict with fhe general plan and interfere •wi -th
Petahuma's long -range expansion plans. After
discussion ,on the matter, it was decided that cer-
tain matters required review by the staff and
further study by the Council, whereupon Mr.
Georgedes was informed that he would be notified
if some conclusion,,had been reached.
Adjournment
There being no, further business to come before
the, Council, the- -mgeting was adjourned at 11:45
p.m.
