COUNCIL PETALUMA., CALIFORNIA February 19, 1968 Council:- Meeting Regular meeting of the Council of the City of Petaluma called to order by Mayer Putnam at f.the- hour of 7:30 o'clock p.m. Attendance Present! Councilmen Battaglia, Brainerd, Cavanagh, Jr,., Colin, Joerger, Lipman and Mayor.Putnam. Absent: None. Invocation The invocation.was given by Reverend Ray Reed, First Southern - Baptist Church. Approval of Minutes The minutes of February 5 and February 12, 1.968, were approved as recorded. Petaluma City Jail Letter, dated February 9, 1968, from E. A. Veit, Field Representative of the State Board of Cor- rections complimenting the City Administrators and Chief Del Maestro on conditions in the jail, adding that the Sonoma County Department of Public,.Health's report indicates that-the facility is incompliance with.all State and.Local condi- tions and regulations, read and filed.. Air_ Taxi Service Letter, dated February 8, 1968, from Sonoma County Airmen's As;sociation the initia- tion of an air taxi service from County Airport via Petaluma Airport to San Francisco International by Let's.F'ly_of Sonoma County Air - port, read and filed. Notice before the Public Utilities Commission in the matter of the application of Let's Fly, Inc., for a Certificate of. Public Convenience and Necessity, read and filed. Insanitary Condition- Letter,-dated February '2, 1968, from Walter C. 100 Douglas Street Glowers, M. D., Sonoma County Public Health Officer regarding insanitary conditions at premises located at 100 Douglas Street and owned by Miss Lenora Hutchings and requesting assistance of the City Attorney to correct said conditions, read'and filed. City Attorney Robert reported on the gradual progress being made by Miss Hutchings' niece and attorney to clean the premises. He requested the Council to consider granting more time to clear the problem. Upon the suggestion made by Councilman Colin, the matter was tabled for several weeks. William Perry Appraisal Work Washington, St. Bridge' It was noted by the City Clerk that Mr. William Perry had reconsidered and decided not to resign from the Planning Commission. Letter, dated February 13, 1968, from Marvin Casa - lina, 77 Jack London Square, Oakland, California, containing three proposals for appraisal work in the-Washington Street-Petaluma Blvd. North - Western Avenue area, read and filed. Discussion was held on a question raised concerning the appraiser appointed by the City not being con- tacted to submit proposals for the work covered by Proposal A and B which involves the downtown redevelopment area,. Councilman Cavanagh, Jr., stated that he based .his "no" vote on the fact that he has full con- fidence in the appraiser appointed by the City, .and until another appraiser is needed, he.:could see no reason for accepting said Proposal C., Councilman Joerger asked to•have the same reason recorded. Councilman Battaglia stated he .- voted "no III because he felt that the City ap- praiser should be used for the work. The Mayor indicated that thought be given to defining the scope of.the Petaluma River Committee responsibilities. Storm Drainage Ma ster Plan Res. #4932 NCS C;Lf 0 Letter, dated February 15, 1968, from Super - visor Leigh Si Shoemaker requesting an indica- tion from the Council pertaining to the hydro- logical survey of the Petaluma f16.6d plain,, which work to be done was substantially as'.` concurred - by the Zone 2 -A Flood Control District Directors and recommended by them in 1967, read and filed. Di rector o Public Works David. Young explained the three or four-phases of work involved in the flood control 'study of the Petaluma River to be accomplished within the next two years and that the first phase in- volves a contract for the hydrological survey for•an amount not to exceed $:20,000. He noted that zudh a study will be beneficial in securing future Corps of Engineers' projects, adding that the Corps will hold a hearing on March 21,146.8, in Petaluma regarding flood control and.water 1 1 Appraisal Work - an appraisal for the Washington Street Bridge Washington Street approach property covered by Proposal C. It•� Bridge (Continued) was indicated.byethe City Attorney that it is' advisable to have two appraisals in the event the property involved in the'Washington;Street '. Bridge project is condemned and is subject to court proceedings. In answer to Councilman Cavanagh, Jr., the City Manager.sta.ted for the record that he recommended to the Council two appraisals.be secured' the matter of the purchase of the prope on the corner of ;Wash — i ngton Street and Petaluma. Boulevard North , be - cause by having two appraisals, the City would have all the information needed_ in case any. questions are raised as to the pjr.chase Qf the property. After further discussion, which in -. chided comments made by Mr. King, a motion was made 'by Councilman Colin, seconded by Council- man Brainerd, accepting Proposal C submitted by Marvin Casalina. Council Invitations The Mayor.welcomed those present who received invitations to attend the Council meeting. They were: Mr—and Mrs. Claude L. Hineline, 1737 Pine Street, and Mrs. Clem McCorkel, 25 Brainerd Ave. �;. The Mayor: noted that Mrs. Gustav Zitlau, 232 Liberty Street, had phoned expressing thanks for the invitation and regretted that she and'her husband were unable to attend. Boy Scout Govern Two Sea Scouts who participated in the subject ment Day Day last week were recognized by Councilman Cavanagh, Jr. Claims and Bills Resolution #4.933 N.C.S. approving claims and Res, #4933 NC'S bills Nos., 440 to 559 inclusive and Nos. 1711 to 1741 inclusive, was introduced by Council - man Lipman, seconded.by Councilman Brainerd, and adopted by 7 affirmative votes. Street Letter, dated February 9, 1968, from Carl W. Petersen, 815 E. Washington Street, compli- menting the - Street Department for the good repair work done on the street in front of his residence, read by the City Manager and ** _,(See Page 460) submitted for filing. Assessment City Manager Robert Meyer read a letter from District ` #9 NS Bundesen Real Estate requesting lot segregation Lot Segregation_ for a owned by Aubrey Sanderson and located in the subject Assessment District. QQ Mr. Meyer reported on a meeting held by the .A' staff with the District's Engineer of Work and Attorney to discuss procedure for lot segregation, adding,hhat legislation will be presented to the Council at its next meet- ing for consideration of the procedure and fees involved. 'Mr. Norm Rollins.of Bundesen Real Estate was present and requested the Council to act on this matter as soon as possible because of a pending sale. Standby Pay City Manager Robert Meyer noted that the matter of standby pay for sherifffinspectors, animal control officers, etc., will be dis- cussed.at the.Sonoma County Board of Super- visors' meeting on Tuesday, 11:15 o'clock a.m., whereupon the Council approved his request to attend said meeting. Study Session Aw City Manager Robert Meyer listed the following as matters for study session: Capital Outlay, Underground Utility Ordinance, proposed ordinance to be considered for adoption by the Board of Supervisors of Sonoma County for the purpose of regulating natural watercourses in the unincor- porated areas of.Sonoma County, demolition per - mit and Police and Fire Department personnel requests regarding ambulance time and court time. It was agreed to hold an adjourned meeting on Monday, February 2'6, 1968, to con- sider Capital Outlay and the Underground Utility Ordinance and to review and discuss the remaining matters at the'March 11th study session. Councilman Battaglia reported on•a' meeting Pollution held in Rohnert Park recently regarding the Su :ect matter noting th at a nother meeting is planned a`t which time the Bay .AiraP:ollution Control Board will present some facts and f;i.gures . . Pioneer Shell Co. Councilman Battaglia reported that a,scheduled meeting with 'the operators of - the subject firm was postponed and wil-1 be held soon to dis- cuss dust control for the Pioneer Shell Company plant 5 Planning Technician Planning Director William C. McGivern in- troduced Joseph Radosevic, Planning Tech - nician. Traffic Committee re' Councilman Brainerd reported that the Traffic Spring Street Committee held ,a public hearing at 4 :0,0 p, =m: this afternoon to consider the request of- property owners in the Spring Street area ® to make said Street one -way from Douglas to "B" Streets, and following deliberation of the request, came to the conclusion of a compromise to recommend to the Council the:. elimination of parking the street from 9 a.:m. to 6 p.m.-daily except on Sundays and holidays, and the elimination of truck (more - than 3 /41/ton) traffic, except garbage.. r' trucks, adding that consideration for further study would be the matter ,of- tie i possibility of limiting right turn from i Douglas Street to Spring Streets. Dor•,othy Gilstrap, 15 Spring ,Street, objecting to one -way traffic'on Spring Street, read.and.filed. After considerable discus- sion,•a motion was made by Councilman Ba_ttag- lia and seconded by Councilman -Colin to elim- inate traffic on Spring Street and clarifying that two -way traffic' and parking be allowed. The motion carried by 6'affirma- tive.and.l`neg4.tive votes. Councilman Brainerd cast "the negative vote and stated . t h at- he voted " no" because he fel that when such a decision is made, the other people involved. w were present at the i p u bl ic hearing „abut not, at the Council-• - meeting, should be represented, and that the matter should'` be referred to the Tra-ffis for `recommendation, adding that he was not opposed to the elimination of truck t- raff^c;. The Mayor 'asked the people of. Spring Street. to - try the .method of elimination: of -truck ........ traffic to determine if it helps the tra'ffi ; c problem.. :The Mayor stated that she felt, `the matter '`merits continued study, and a , 'broader' study; "and because of the general problem generated by "Spring Street, she'requested Councilman-Brainerd continue .a study of the problem in terms of the area as it develops.. The'Mayor appointed�Councilman Cavanagh, Jr., as liaison with Cotati and Rohnert Park for the Redwood'Empire Sect.ion,, League of California Cities' meeting in April to be hosted by Cotati, Rohnert Park and Petaluma. q� F City Attorney Robert referred to memo, dated P ®� February 16, 1968, to the Council regarding failures in the subject subdivisions which appear to be covered by maintenance bonds filed by the subdi- vider and furnished by the Hartford Accident In- demnity Company, and that no response has been re- ceived for a demand to correct said failures, adding that the subdivision agreement provides for collection of. attorney fees in the event suit is brought to endorse any part of the agreement. Mr. Robert recommended that a suit be filed on the maintenance bonds for the full amount of said bonds, whereupon Resolution #4934 N.C.S. author- izing'and directing City Attorney to file suit on the maintenance bonds relating to Cader Subdivisions No., 3 and No. 4, was introduced by Councilman Brainerd, seconded by Councilman Lipman, and adopted by 7 affirmative votes. Director. of Public Works David Young reviewed .3701 portions -of letters received from the U. S. Corps of Engineers regarding maintenance dredging of the Petaluma River wherein it was requested that the City of Petaluma furnish disposal areas which are diked and which can satisfactorily contain the dredged material. He then read letters in regard to Gerwick's permission to deposit spoils material on their property with the provision that dikes be furnished. Mr. Young continued by saying that the Chamber of Commerce committee appointed to assist in locating spoils areas, was able to secure Mr. Smith's property and that the dikes constructed for spoils expected some years ago require some remedial work but that Mr. Smith is unwilling to pay for any cost involved. Mr. Young estimated $20.00 for dike construction and repairs for the properties, whereupon a motion was made by Councilman'Lipman, seconded by Council- man Battaglia, authorizing the dike construction for the 1968 Petaluma River Dredging Project. As discussed, the City Manager was asked to write a letter to the Sonoma County Board of Supervisors for County participation in future Petaluma River Dredging projects. ,34 4 Ordinance #890 N.C.S. amending the Zoning Ordinance #662 N.C.S. by rezoning that area containing Monarch Pacific Subdivision on South McDowell Boulevard from an "A" (Agricultural) zone to an R - 1 -6000 ( dwelling) zone, was.intro- duced by Councilman Joerger, seconded by Council - ,man Colin, and adopted by 7 affirmative votes., . .2oS Director of Public Works�bxplained that the pro- posed legislation'is in preparation for the State Chamber of Commerce meeting on March 5th to urge the California Highway Commission to consider a 60 February 19, 1968 Petaluma- Sonoma higher priority for the subject route for,a. ! Freeway %Exp'ressway much - needed highway link in the east -west Route 116 direction, whereupon Resolution #4:935 N.C;S..'- Res. #4.935 NCS urging the California,Highway Comm=ission to give a planning priority to the Petaluma= Sonoma Route 116 Freeway /Expressway,- and further urging location studies on the Freeway /. Expressway be commended at the earliest- possible opportunity', was introduced by Councilman Lipman,: seconded by Councilman Battaglia, and adopted by 7 affirmative votes'. Boat Launching City Manager Robert Meyer reported that a. , Ramp Facility resolution was received today from-the Sonoma County Board of Supervisors approving" the con- cept of the City of.Pe.taluma development of a marina on the Petaluma River which involves land transfer. Copy of resolution submitted and filed. Recreation Director Shollercberger then told the Council that the State has announced it will provide an engineer to do the pre liminary engineering work for the boat launching' ramp facility and that a private engin to b hired by the City is required for theef;inal_' engineering plans, In order to proceed with the land exchange with the State, the City' Manager pointed out that necessary negot.iations'� are involved with the County,, whereupon.a motion- . -was made.by Councilman Joerger, seconded by Coun- cilman Colin, authorizing the staff to proceed with negotiations with the Sonoma County Board. of Supervisors for the pruchase of five acres of -land. Motion carried unanimously. California Marine Councilman-Colin reported that at the subject meet- Parks and Harbors ing held last Friday, he submitted a letter on Association the status of the boat launching ramp facility and the marina for the prupose of bringing the Association members up-to date on these matters. He added that the letter met with the approval of said Association.
