Council Meeting -Regular meeting of the Council of the City of
Petaluma•called to order by Mayor Putnam at
the hour of T :30 o'clock p.m.

_Attendance Present: Councilmen Battaglia, Brainerd,
Cavanagh, Jr., Colin, Joerger,
Lipman and Mayor Putnam,
Absent: None.
' Invocation Due'to the absence of Reverend James F. Cog-
burn, Church of God of Prophecy, no invocation
was given.
Approval of Minutes The minutes of February 19 and February 26,
1968 were approved as recorded.
Scouts in Letter, dated February 16, 1968, from David
Government Day A., Rice, District Scout Executive, Sonoma-
Mendocino Area Council, Boy Scouts of America,`
thanking the officers and staff of the City
of Petaluma for cooperating again in Scouts in
Government Day, read and filed.
.Poke'r Parlor Resolution #2437 of the City Council of the
Table Tax City of Gardena, California, opposing proposed
legislation regarding poker parlor table tax,
read and filed. The City Manager briefly ex-
plained the proposed dregislation for the
Council's information.
D: stribbtion of Letter, dated February 16, 1968, from Floyd
Students by Race L. Wakefield, Assemblyman, 52nd Assembly
District, re distribution of students by race
and requesting support of his bill in the
Legislature, AB 231, which states that no
child may be bussed from his neighborhood
attendance area without the written permission
of his parent or guardian, read and filed.
The City Clerk was asked to furnish a copy of
said letter to each member of the Council.

Harold D. Cutler, owner of property located

tions existing thereon and that the letter
constitutes a legal notice to abate said
conditions within ten days, read and filed.
It was noted by the City Manager that the
Council will be kept informed on the matter.

requesting reduction in specifications as set
forth by the Inspection Department of the
City of .Petaluma in order to use the 'building
at East "V' and Copeland Streets (315 Copeland
Street), Petaluma, read and filed.
Letter, dated March 4, 1968, from Robert_B:'_
Chapman, Director Adult I Education Division,
Petaluma City Schools, stating that if said
building in-.question has been inspected and
found to be unsafe, he wished to go on
record that neither the Department.of Adult..
Education, nor any other department of the €',
Petaluma High School District:, is requesting
the City Council to make a decision permitting
said building to be used as , a classroom for
students of an organized educational program,

-inspection of the Northwestern Pacific
Steamer Gold Freight Building located 'at.
315 Copeland Street, listing fifteen defi-
ciencies and an explanation of the Uniform
Building: Code sections applying to the in. -,
spection, submitted and filed. Councilman
Cavanagh, Jr.,'reviewed the deficiencies
with Mr. Oberto. • A discussion was also held
with,,Mr. Oberto on the Uniform Building Code
sections involved.
Letter, dated February 19,. 1968, from Fire
Chief.Benton to Director of Planning Mc.
G'ivern listing certain conditions to be
complied with relative to the building to
- .it llacatdd"at East, "D" and Copeland Streets being
considered for use as an E -3 Occupancy, Sub-
mitted and filed. City Manager Robert Meyer'
pointed, out to the Council the possible
effect on the City's fire rating if such a
building were occupied with the existing
conditions and inspected by the Board of
Fire Underwriters.
Mr. Pracchia was present to discuss his re=
quest with the Council, and in reviewing the
list of deficiencies with Councilman Colin,
Mr. Pracchia indicated compliance with all
.of the items except the item requiring, in-
stallation of a sprinkler system.
Following a general discussion on the matter,
a motion was made by Councilman Joerger,:and
seconded by Councilman Colin, that notwith-
standing the7Code deficiencies, Mr. Pracchia
be granted permission to use the building at
315 Copeland Street for the purpose of and
r.esi,tticted to the teaching.of boat building
with the following additional stipulations:

Councilman Joerger explained his motion to be
made in light of ,the isolation of the building,
said'isolation being such that fire would not
spread and that the use was for adult educa-
tion, a use to be commended, and that he
considered this action not to be a precedent
setting matter. Motion carried by the follow-
ing vote:
Ayes': Councilmen Battaglia, Cavanagh, Jr.,
Colin and Joerger.
Noes: Councilmen Brainerd, Lipman and
Mayor Putnam.
Councilman Lipman qualified his "no" vote by
stating that he did not think the action
taken was in the best interest ofrzpublic
safety. He suggested that the staff work
with Mr. Pracchia to give him some guidance
to make the building as safe as possible.
The City Clerk 'was asked to send a letter to
the Petaluma City Schools of the Council's
action. fo

U. S,. Corp's of Engineers of public hearing
on flood control and allied purposes on
the Petaluma River.and its tributaties,
Sonoma and Marin.Counties, at the City Hall,
Petaluma, California, on March 21, 1968, at
8:00 p.m., read and filed.
Letter, dated February 9, 1968, from H.
Harvey Hunt, President, California Water
Pollution Control Assn'., regarding the 40th
Annual Conference of said Association to be
held April 24 -27, 1968, in Santa Rosa, and
hoping that some of the personnel will be
able to attend, read and filed. Director
of'Public.:Works David Young 'indicated that
some members of the staff plan to attend.

Claim filed by the City of Santa Rosa against
the City of Petaluma in connection with the
collision on December 6, 1967, of the City
of Santa Rosa 'fire engine and the City of
Petaluma police "vehicle, submitted and filed,
whereupon Resolution #4936 N.C.S. denying
claim of of Santa Rosa, was intro-
duced by Councilman Lipman, seconded by
Councilman Brainerd, and adopted by 7 affirm-
ative votes.

�PUC Petition before the Public Utilities Comm-is's ion of
Pacific.Air Lines, Inc., - for Leave to Intervene
in the matter of the application .of Let'-s F;ly,
Inc:,., for a certificate of public convenience,
and necessity as a passenger air carrier between
Sonoma County Airport, Petaluma and San Francisco/
Oakland International Airports, submitted and
filed. 'The.Mayor requested that the City Clerk
obtain additional information regarding the two
applications involved.

Petaluma has, applied for a Department of Army! -
permit to install a pile guard for the protect on"
of an.existing cutfall sewer in the Petaluma
River.at Petaluma and,that interested parties
may submit in writing any objection within thirty
days., read and filed.

Oppurtunity
League of California Cities' bulletin., dated
February 21, 196'$, informing City officials
that the Office of Economic Opportunity has an -'
nounced that cities must declare their intentions
of transferring local antipoverty programs to the
control of city halls and county courthouses by
March 15, 1,968, read and filed. Councilman Colin
was appointed to accompany City Manager Robert
Meyer to the Sonoma County.Board'of Supervisors
for discussion of the County's intentions on the
matter. It was indicated that i-fr-any Council
action is required, a special meeting would be
called.
Council Invitations KIn response to the Mayor's inquiry, Mr;. Wm.,
Wendland, 735 Cindy Lane, Petaluma, stated that
he had received an invitation to attend the.
Council meeting. As a, resident of Petaluma for
three ,years, Mr. Wendland offered to serve on a
commission or a committee.

inclusive, was introduced by Councilman Brainerd.,
seconded by Councilman Lipman, and adopted by 7
affirmative votes...
Lt. Henry Eslick,Jr., Chief of Police Larry Higgins presented a Cer=
Aif.icate of Completion to Lt. Henry Eslick., Jr.,
Lt, Goo, Wagner,Jr. and Lt... George Wagner, Jr.., of the Petaluma
Police Department for completion of a fifteen -,
week course on Police Management and Organi
tion at the Sacramento State College. Both,,
officers were complimented by Chief Higgins
for the high grade§ achieved and the fine manner
in which they.rep:resented the City of Petaluma
and the Police. Department. On behalf of the
Council, Mayor _Putnam congratulated Lt. Eslick
and Lt, Wagner for their accomplishment.

League of California
City Manager. Robert Meyer reported on the
Cities Spring,kMeet-
highlights of the subject conference held
, ing of City Managers
in Palm Springs on February 27 -March 1 1968.
He noted that the matter of cigarette tax
allocation was discussed and suggested that
an ind'ieation of the City's position be
sent to Assemblyman Bagley. It was
generally agreed that the Council favors
the formula proposed by the League of
California Cities and that Assemblyman
Bagley be so notified.
'Royal Tallow Co.
City Manager Robert Meyers reported that
complaints were received by his office last
week of odors from the Royal Tallow Company
and that on Thursday, Councilman Battaglia
investigated the plant's operation -_.:.

.Study Session
City Manager Robert Meyer stated that the
following matters will be discussed at the
study session on March 11, 1968: Manning
emergency vehicles with Fire Department
representatives, County of Sonoma proposed
ordinance re flooding and drainage ditches;,
and a demolltion permit policy. He noted
that a copy of the proposed demolition per
mit will be furnished to each member of the
Council.
Zone 2 - A Meeting
The City Manager announced that the Zone 2 -A
Flood Control Advisory Committee will meet
at the City Hall on Wednesday, March 13, 1968.
Sewer- Assessment
It was noted by the City Manager that Super -
Districts
visor Shoemaker has engaged the Council.
Chambers for a Sanitary Sewer Assessment
District meeting on Tuesday, March 12, 1968.

Airport Study
Mr. Owen Fredericks, Chairman of the Chamber
.Committee
of Commerce Board of Directors, appeared
before the Council requesting recognition by
the City of Petaluma and appointment of a
Council representative as a liaison on a
special airport study committee formed by
the Chamber of Commerce. He introduced Mr.
Wm. Perry and Mr. Ralph Azevedo, two members
of the Airport Committee. Mr. Fredericks
also invited staff participation in the
study. In - response to Mr. Fredericks' re-
quest,� Councilman Colin was appointed as the
Council'ls liaison to the-Airport Study
Committee.

.., Chamber of Commerce
Councilman Lipman ,reported that at the
. of Commerce Board of Directors meet -
ing today,, it was indicated that the Industrial
Brochure will go to the printers soon; and,
that April 25th is the annual Chamber dinner
at the Veterans' Memorial.

ABAG. Councilman Joerger suggested that the Council
discuss to reaffirm its position regarding
the concept of the Association of Bay Area
Governments. The matter was referred -to
the City Manager for a topic of discussion
at an early meeting.
Petaluma- Sonoma Mayor Putnam,, Councilmen Cavanagh, Jr.,
Expressway /Freeway Joerger, and Colin indicated they would ac-
(Route 116) company the City Manager and City Engineer
to the California State Chamber of Commerce
meeting Tuesday night in Santa Rosa to urge
planning priority and location studies on
the Expressway /Freeway be commenced at the
earliest possible opportunity.

.District Agricultural Councilman Lipman reminded the Council
'Fairs about a measure again being introduced
into-the State Legislature to put the
District Fair funds back into the general
fund, which same measure was defeated
last year. He noted that Senator Collier
very actively opposes the proposal.
Adjournment There being no further business to come be-
fore the Council, the meeting was adjourned
at 10:10 o'clock p.m. to an executive
session.
