Some members of the CounciLremarkied that they were still not thoroughly satisfied with the work Which had been done in this project. Council- nia,n Van.Bebber stated that he did not wish to hold up this contract any longer, but did wish to point out to the Council. that he believes there are certain things that were not done inawbrk.m manner in the subject project. He Went on to say that he was cer-tainly not happy with the project, and belipved that it appbars to be 'a patch: deal.. Councilman Van Bebber felt that the City should be very careful in future projectsi and, if possible, cQrta.in faulty spots in the project should be corrected to the satisfaction of the property owners. Councilman King noted that he had been informed by a representative of the contractor that some of'the rough -spots in the streets would become smogth'after being exposed xposed to the heat of the summer sun. The resolution was then adopted as follows: Res,, - #2185 N. Co S. introduced by C6uncilrfian Gustafson, seconded by Councilman Ellis, entitled, "RESOLUTION ACCEPTING COMPLETION OF CONTRACT FOR THE RECONSTRUCTION Of CERTAIN STREETS IN THE CITY OF PETALUMA KNOWN AS PROJECT NO. 39e' adopted by 7 affirmative votes. ,Bleachers 7 McNear Park Report of Dir. of TU Works & City Engineer dated Jan. 16, 1959, re bleachers at McNear Park,. submitted 'arid - filea, The report'contained , information reizai'ding to the bleachers - at MCNd,'qr Park and stated in part,, !"Total cost of a minimum reha:bilitation program by City forces will be around 1$400. If work is done on contract, the cost will be about-$500." In order to determine if the majority - of the Council wished to have the bleachers removed or repaired, - a poll was taken. Six 'Members of the Council voted for removal of the bleachers; Counc'ilma-n-King-ypted "no..", indicating- that he favored repairing the bleachers. .CONSiOERATION OF NEW BUSINESS; Resolution Recommending . 1 -Renaming of Petaluma Creek Mayor Parent noted that abill, changing the name of the Petaluma Creek to "Petaluma River,, " had been introduced - last week by Congressman Miller. He stated that when - a :stream is referred to as 'a river, it receives much more consideration nsideration than when it is .called 'a creek; whereupon, - Res. #2,186 N. C. S. introduced by Councilman Matzen,. seconded by Councilman Van -Bebber, entitled, "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA RECOMMENDING TO THE UNITED STATES CONORESS'THATTHE NAME OF I THE . PETALUMA CREEK BE CHANGED TO PETALUMA RIVER. Was read and adopted by 7 affirmative votes. (3) 4 January .19y 1959 Mr... Frank reminded the Council of hearing which was ,being :arranged for next Monday night at 8 os °cloc;k, relative to the report - on the County Road Plana He urged members of the .Councils and the various organizations in the City to 'attend This meeting in order to get `a better understanding of'the plane = With the consent of the Council, Mr.- Frank stated ;that he Would 'send notices'.of the meeting to the various organizations in th -e City. ; Hearing.. re Appli ation of; Mann °s :Nursery for: filar ance..from.-I 958y Edition of. Leiser- d bo a. M'annes Nursery, had filed a formal applt, ation and paid his r filing fee as required by section 204 of 'the Building coded Letter dated jano 5 19$9, signed by Walter Lo Le ser owner of Mann's Nursery, requesting that he be granted a variance from the Uniform Building Code, subfnitted and filed° Report of Diro , of Public.Works dated Jan, 15 1959; "recomm'ending that the subject variance be granted, read a nd filed° Affidavit `of Posting of notice'of` subject h6d"r- ng, 'signed by the Dir, of Public :Works, submitted and filed - = A. resolution on the varianee was read by the City. Attorney.° Councilman Crinel ,s,uggested that 'a clause be to the resolution to the effect 'that the variance shall exist only iso long -as the building is not used fo"r' the stora °ge of�inflamable materials° Mr. - Leis,er "` "stated that he would have no objection to suc Ic clause being added °to the resolution Disco sion was held reative to City reguaations governing he storage of inflamable materials° Councilman Matzen - stated that he Was very much opposed to - the procedure of granting variances to the Building Code This being the first time for the'Cduncil 'to sit as a Board of Appeals relative to_ a Building Code ce he .felt, that them _ g varian , titter should be . one into very thoroughly before any action was taken. Mayor Parent" noted that a .decision need not be made in this case for 30; days After further discussion on the subject,, and at the request -of Councl man Matzen the resolution on this matter`was ;vvithdrawn.'by the introducing ,and seconding - Councilmen... and the matter was held over until the next. regular :meeting° ADJOURNMENT.
