Adjourned meeting of the Council of the City of Petaluma called to order
by Councilman King, Acting Mayor,

Present: Councilmen Crinella, Ellis:, Gustafson, King and Bebber
Absent:. Councilman Matzen & Mayor Parent.
APPROVAL OF MINUTES:
Minutes from the 'meeting of April 20, 1959 were approved as recorded.

Copy of application for transfer of Alcohol. Beverage License, Bridge
Club, 'S. Washington - Street, submitted and filed. The application had. been
approved by Chief of Tolice Del Maestro.
Letter from Lt. Col James .B. Keegan of the Calif.. Army National Guard,
dated April 20, 1959, expressing appreciation for 'assistance given Company - "B
579th..Engi.neer Battalion in their efforts to secure an Armory in Petaluma, read
and filed.
Letter from Capt. Dona P. Uhr 'dated" April 13, 1959, thanking Mayor
and Council. for interest'and'ass,ista.nce at the Arnnory dedication, read and filed.
Letter from Mayor Parent dated April 27, 1959, re proposed annexation

Copy of resolution recommending 'granting of the subject rezoning,
submitted `and filed.
Letter from City.2lanning Commission dated April 27, 1959, outlining
the Commission's reasons Ior voting 7 to 0 y in favor of the subject rezoning,
read and filed.
To a question h Acting Mayor King, the City Attorney 'answered that
the agreement, setting forth .ce.rtain requirements in .regard to the improvements
in ;the area, had been approved by Kenilworth Enterprises, (the developers).
The 'City. Clerk ex-plain.ed that there was not a written resolution on this
matter before her 'at this time; whereupon, a:n ordl resolution authorizing the
Mayor and City Clerk to enter into an agreement with Kenilworth Enterprises
was introduced by Councilman. Van.Bebber and seconded by Councilman ,Gustafson.
- Discussion was held relative to the widening of Ellis :Street, the future
annexation of adjoining property, etc. Questions on these subjects, which were
Presented by the Council and rriem:bers of the audience, were answered by City
Planner Dick Coleman - and Mr.. Harry Gossagp.

TO ENTER INTO AN AGREEMENT WITH KENILWORTH
ENTERPRISES., "
INTRODUCED BY COUNCILMAN Norman P. Van. Bebber at an adjourned -meeting
of the City Council of the City of- Petaluma, on the 27th day of April, 1959,
WHEREAS, Kenilworth Enterprises propose to develop a certain area
of this City which _it is felt should come within City control as expressed in
Chapter 22 of the Petaluma City Code., 1958, and
WHEREAS, Kenilworth Enterprises have requested a certain rezoning .
in order to carry out a development plan of a certain - a:rea within this City, and,
WHEREAS, . Kenilworth - Enterprises have indicated their willir g less to
comply, insofar as is applicable, with - provisions of Chapter 22 of the
Petaluma City Code, 1958,
NOW, THEREFORE, BE IT RESOLVED that the - Mayor and City Clerk
be, and the. are, hereby directed and authorized t

with Kenilworth Enterprises on behalf of the City of Petaluma.

City, Attorney Ed Robert stated that he found it difficult to bring the.
ordinance on this rezoning within the meaning of the City Charter on
emergency ordinances,
Acting Mayor Ding felt that this should be - considered 'an emergency
ordinance considering the housin , situation in Petalum

display truck in front of his store on Kentucky St.. for 2 days during his
grand opening
Police Chief Del Maestro stated that he was not in favor of granting
the use of these 2 parking spaces ,for the benefit of - an individual -- lie felt
that this could lead to the Council's receiving many similar requests from
other individual businesses in the City if permission granted, -
- The City Attorney called attention to 2 .sections of the City Code
concerning the parking of trucks - and advert.isingo In view of the wording in
these sections, he did. not that Mr. Combs ° - request - should - - be granted,
Acting Mayor King stated that this type of 'advertising was allowed in
the City of. San Francisco, and. presented a copy of a letter - on this - subject
which had been signed by San Francisco Police Chief Thomas J. is

letter from 'Police Chief Cahill, which was dated March 31, 19591; and addressed
to Mr. L. V. Chase, Manager of Appliance Promotion, was then read and filed.
In the letter, permission was granted to Appliance Promotion to parka forty -
two foot display trailer and. tractor in front of the sotres of its appliance
dealers in the City of Sa.n Francisco.
Councilman. Gustafson stated that he was in agreement with Police
Chief Del Maestro on this matter--if permission was granted to one business,
many similar. requests would be received..
Mr. Michael. Gentil.ly addressed the Council. stating that he believed
this type of advertising should be allowed in the City.
Mr. Donald Thoms informed the Council. that the Merchants' Committee
of the Petaluma Chamber of Commerce had discussed this matter and felt that
Mr., Combs' request should be granted. They believed it would be for the
�est` nterest of the City of Pet:a.luma,

whether or not Mt. Combs' request should be granted. The votes cast were
as follows:

Noe's-- Councilman Gustafson.
Absent: Councilman Matzen and Mayor Parent.

Councilman Van Bebber stated that he felt the Council should decide
upon certain policies in connection with _ future annexations to the City,,-, so that
developers might know just what to expect,, He. believed that the problems
foreseen by the Cinnabar School. District could be worked out by discuss' ion -
on the subject with the City. Council and Petaluma School Board.

Councilman King :stated that as he understood, the Council . . did not have
a written policy on wh'ether or. not annexations would be included in the
Petaluma: Elementary School District,,
Col. John _Gibbs addressed the Council expressing his ideas regarding
annexations,
Mr, - Harry G. ossage, proponent of the annexation - of land between
highway 101 and Petaluma, Blvd. No,; explained at length hadTiranspired
on this project to date. He stated that at this time he interested in finding
out what the - Council's policies will..be regarding ,this annexation. and also other
future annexations,
Dr. William Manning. Supt, of Petaluma School:s9 addressed the -
Council stating that he felt it would' be, well for representa.,tives - 9f a.
school districts - involved in the annexation being pr6posed Mr. to
meet. with the - City. - Council to discuss t he problems involved".in connection
with school boundaries.
Mr., Mut&h'stdted that his school board would be very wi - lling to meet
with. the Council and others on this Matter,

school. boards involved City Council.
In regard to property taxes in the . nman. area, the City Engineer
stated that the,net increase in the property tax rate,in the event, of annexation,
would be approximately, .5'0,- $i,'7,5, this,being due t fact that - this
area c urrently h� a fire d istrict tax ; wh I ic . h would -not . - apply w ithin the City
lim its, and the - .fact - that - school. district Caxes are a variable fact or.

Annexation Policy - cont'd
Several property owners in the area proposed to be annexed to the
City by Mr. - Gossage addressed the Council asking v I arious questions in regard
to annexation,
Mr. Robert rioted that any property being annexed. to the City would
come into the City unzoned, Zoning would be done after annexation,
To a question by Mr. Gossage, Acting Mayor. King Answered that he
was certain the Council, would haNie the City Planner work with him and the
property owners to determine just how the area would be zoned, as soon as
Mr. Goss.age indicated a fairly definite desire to annex to the City.
.Mr. Phillip Joerger addressed the Council in regard to his proposed
rezoning of 100 acres In the Denman Area,
Councilman Ellis and the City Planner invited Mr.. Joerger to attend
the next Planning Commission meeting, at which time this matter would be
considered, Mr. Joerger was informed that the City would merely express
approval or disapproval of the rezoning; the actual decision on the matter
would be up to the County,
Motor Vehicle Bldg,.
r. Michael Gentilly in ' formed the Council. that he had contacted- some
private investors relative to constructing a building in Petaluma for the Dept,
of Motor. Vehicles, He stated that one of the investors had expressed a desire
to construct such a building And le-as--o it to the State.
Supervisor. Shoemaker congratUi ' lated the Council on the way they had
worked together in connection with the w aster situation,
