ROLL CALL: Present: Councilmen Crinelnla, Ellis,; Gustafson, King Matzen, Van : B'ebber and Mayor Parent. Absent: None. INVOCATION: Invocation was given by Reverend Kenneth G., Peterson, United Church of Christ. APPROVAL OF MINUTES: N_i:nutes from the meetings ,of August 3 and 5, 1959, were approved E: as recorded. 'v PETIT -*& COMMUNICATIONS; Copy of application for transfer of liquor license, Petaluma Liquor Store, submitted and filed.. The application had been approved by Chief of Police -Del Maestro. -Outside Sewer Connection Appl.. - Charles . F Lear Application' of Charl'e's F.. Lear, 1 Lindberg Lane, for permit to connect one single family residence to City Sewer' System, submitted and filed. To a question by, Councilman Van Bebber, the City Manager explained that the subject , property - is right outside the City limits At the time this particular sewer line was installed by the Blackwells, - it was on the basis - that anyone within - a - certain area near the line would be allowed to - hook .on provided they pay the connection fee, etc. This policy been carried out in regard to the sewer line now for the past 7 - or 8 years. Mr:. Frank explained that this application was ,brought to the attention of the Council because of a health problem; whereupon, Res, . #2298 N. C. S. introduced by Councilman Crinella, seconded by Councilman. Ellis, entitled, "RESOLUTION GRANTING THE APPLICATION OF CHARLES F. Available 1t. was pointed out that the appli'cAnt' has already requested recommenda- tions for the installation of. the leaching from the Sonoma. - County 'Health Dept. The City Engineer stated that in so far �as'the health problem is concerned, installation of the septic tank, in accordance with the recommendations of the Sonoma County Health Dept. , would provide a .satisfactory means of sewage disposal for this one residence to serve until such time as the adjacent properties are subdivided, making it possible for Mr. Krulevitch to connect to the sewer line. (cont' d) (1) August 17, 1959 Request of Elmer Krulevitch, re Septic Tank cont'd y y ed the `Council:- that the City's subdivision Cit Attorney. Ed Robert` inform ordinance provides that no septic tanks .shall be,installed within the. City limits.. He believed it a general policy of the City that no building permit shall, be issued unless there is a connection to the City sewer line, - However, he could find nothing in the ordinance which specifically prohibits installation of a ,septic tank.. Inasmuch as there are some 5 acres involved in this case Mr. Robert felt that it would be proper to grant a temporary installation of a septic tank as the extension of the sewer line would be prohibitive for the use of one home, The City. Attorney believed a septic ;tank should. be ,allowed until such time ` as -a sewer line is reasonably 'available to Mr., Krdleviwh, Councilman Matzen then made a motion that the Council grant a build- ing permit and allow the septic tank to be installed,. subject to the: availability of a sewer line. The motion was seconded by Councilman Gustafson. Mt'mbers of.the Council being in unanimous. . agreement - on "this matter, a formal - agreement between Mr. Kru_levitch and the City of Petaluma was to be prepared by the City A, ttorney. Eo, Layton, Consulting Engineer dated Aug 12;, 1959, re meeting to take place 'on Aug,._ 19, re final negotiations of Petaluma with - the County for the Petaluma Aqueduct; read and filed, The letter read in part;- ''This`meeti'ng'will be 'the:,first - meeting for me leading toward: final- negotiations of Petaluma the , County for the :Aqueduct - The objective of this first meeting - w ll. be to examine and discuss the factors involved= 'with , possible service of - water - to the North Mar in Water District and the effects of this possible - service - on .Petaluma, - "The engineering services - for this meeting and others .like it will be performed under- Schedule - III of our agreement - with - the City.- - If - you appr -.ove of this - meeting and wish me to attend please - forward a letter of a.utliorizaton for the. record. Councilman King that there was - a .question " in - his `mind as' to whether this meeti -ng should come. under schedule IlL He felt that the meet- ing had nothing to do with contracts; that it was actually in - connection with whether the North Marin .Water District will go in with Petaluma on the aqueduct, The City Attorney explained that in the City`s negotiations with the Board of. Supervisors, he believed there is a question 'as `to - what the terms of the City. -.'s contract will beg - in view of `the 'possibility of 'other users. If " North Mar.in..Water Dist. should come in with - Petaluma 'on the aqueduct, - he believed that this would :effect the ultimate contra'cta.."Thus according- the 'agreernent with Layton, he ,felt that this meeting would schedule III. He ;pointed out -that schedule II is based-upon- the Petaluma hydraulic system, whereas - a - meeting with North Marin -- if 'Mro - Layton. is authorized by the Council to attend; - would have a bearing upon the City-'.s contract with the Board of Supiervisors,, - (Under schedule III, - Mro - Layton - is to be paid a `per diem basis, = the work in schedule II is outlined and all included. in a flat fee,, Other members of the Council expressed opinions similar to that of Counc K'in'g = =that the meeting to be attended by Mr. .'Layton should come under schedule 11, C I I (cont' d) (2) 'add 0 August 17, 1959 Letter from R. Layton cont ° d Although Councilman Nla,tzen felt that the subject meeting `should come under schedule II, he stated that he did want to be assured that the City would have an engineer at the meeting. A poll was taken wherein a "yes" vote was to mean that the Council was in agreement with Mr. Layton`s request; a "no" vote, that Mr. Layton's attending this meeting should come under Schedule 11, The vote in the poll was 'as follows: Ayes: Councilmen Ellis and Matzen-. Noes: Councilmen Crinella, Gustafson, King, Van Bebber and Mayor Parent. The City Manager was directed to contact Mr. Layton to inform him of the Council's decision on this. matter REPO OF CITY OFFICIALS: City.Manager Claims approved for payment by the City Manager were submitted and f fled; whereupon, Res. - #2299 N. C; S. introduced by Councilman Matzen, seconded by Councilman - Ellis, approving claims and ,bills (Nos. 430 to 58'5 inclusive), was read and adopted by 7 affirma- tive votes. Director of Public Works Civic .Center Improvement 1959 Plans '& specifications entitled ''Civic Center Improvement - 1959" were - submitted and filed, In answer to various. questions by members of the Council, the City Engineer explained that work proposed - in this project, not. including removal of old sidewalks; etc. was - estimated to post $7400. - Removal of 'the cement is not necessary for the completion of , this particular project.. �� ;recall plan as presented by the City Planner is not this ij_ phase of the plan should not interfer with any future. construction - work .on the lot. For the most part; the subject project wilt'' rovide additional parking facilities for City Hall - Mr Roberts went - on - .to -- say that this - would, however, preclude the extension of'Post Street e -- He believed this was the only restriction .the .project would put on the future development of the lot. Councilman .Crinella wondered about the - possibility of the Engineering Department" s adding other streets in need of repairs to this list, thereby cutting down the unit cost of - the work. Street Deficiency Report The subject report was deleted from the agenda at the request of the Dir. of Public Works. Director of Finance & Records Report dated Aug. 7, 1959, re cost of amending retirement contract for additional benefits to miscellaneous members for prior service, submitted and filed, The Dir. of Finance & Records explained that this amendment would be of great benefit to all- of the miscellaneous members and would cost the City approximately $1550. per year; whereupon, Res.. #2304 No.C, S. introduced by Councilman Gustafson, seconded by Councilman. CONSIDERATION OF UNFINISHED BUSINESS: Linda Del Mar Subdivision Discussion Mayor - Parent related what had taken place on this matter to date, noting that;:a meeting had been held with Mr. - - Woodworth - & his subdivider since the last Council meeting on the subject The problems of the size of the street and -bridge, -school 'site location, drainage, etc, still remained to - be solved. .The Mayor stated that the Petaluma Board of "Education would discuss the school site problem and make its recommendation to the Council. (cont'd) (7) 206 August 17 1959 Linda. Del Mar Subdo coned Councilman King suggested that the Con cil discuss the matter of having a park area included in the school site location. The City Planner stated that he had initiated this idea,. based on the"fact that subdivision will have a considerable am.ou:nt of 'homes w hen completed and - will be located quite some distance from the nearest-park, Mt.. Coleman remarked that these park areas adjacent to school sites do tend. to save money in the long run,, inasmuch as you do not duplicate equipment; for example; - the field .of' the school is used, rather than providing -for same in the park -area, Council= man Matzen felt that the matter of combination park and school. sites, in­ general., should be discussed by the Rec.reati.on Commission. , After ,further discussion , on the subject, a poll was 'taken in which a "yes " vote was ,to mean that a park would required adjacent to the school in the subdivision; a "no''' vote, that the Council is not going to insist that ground be taken from the Linda - Del Mar Subdo for such a park at this time. There were 7 negative votes cast in the poll, Mr. Dick'Gray, 100 Cinnabar. Ave., addressed the Council relative to -2 t ,)r which had been made that 7�1 /2.acres of his land be for 'a school site for the subject subdivision. He stated that this amount. of land were taken .from. his dairy ranch, at the particular location which`had. been suggested,, he would no longer be able to operate his dairy, - -- However; Mr, .Gray stated that he would be willing to offer - 51 acres from another part' o f his ranch to the - schools, Mr. Lloyd Pidgeon,, representative of stated that any additional land was : from the - subdivision area for schools, etc, , - it would be impossible - to go-ahead with subdivision. It was - brought out - that the Boa .rd'of` Education would have the final decision in the matter of a .school site location The matter the width of the Payran Street through the subdivision was discussed, after which the -- following - pall - was - taken: "yes "vote - Payran St. to be 80: wide through subdivision. Before roll call on the foregoing poll, - Councilma.nlVlatzen to 'know when the subdivider, Jess Cons truction.Coo , 'planned on building the bridge. over Payran. Street. -- Mr, Woodworth answered that -he ,believed ;1Vlra . Jess would be willing to any reasonable bond, ­ demand - or - agreement on. this -matter' that the City might ask°. He stated - that construction work .in the subdi- vision was planned begin .in -Sept. , and he was quite certain the bridge would - be built - sometime this Fall, Discussion was held relative to - the extension of Payran Street - . 'by the City, from the railroad track at* the edge of the subdivision; - on out - to Magnolia Avenue, Consideration was given to the cost of this project; whether ;it could be paid for out of Special Gas Tax Funds,. etc, The fact that the City. would have to purchase property in order to continue the street was brought out, and the City' Manager was'. to investigate the poss of - the City's paying for this property - out of Special Gas Tax Funds: Mr.- Woodworth- stated that the. subdivider wou -ld be willing to construct that portion of the from the railroad track to Magnolia .Ave° , with - the under.standi.ng' that the `City will reimburse him for this Work. - Councilmen Crinella and` King felt that the continuation of Payran n - Sto to Magnolia.Ave. , by the - City - 'would, justifiable inasmuch as it will. provide a traffic link in the .area in order to open up end of town. A ,poll was then taken - to - determine whether or not the major "ity of'the Council .favored the extension, Payran _St. , as proposed, from - the railroad track to Magnolia Ave, There were 6 'affirmative votes; ° Councilman Ian B'ebbe.r voted "no'. Mar Subdo _ cont °d -- Mayor Parent stated that during a meeting with the Sonoma County Flood Control Board, it had been brought out that the Flood Control District could, perhaps, pay for 25% of the drainage facilities in the area,only if this benefits the entire area. Mr.- Woodworth stated that the subdivider would be willing to put in the .drainage ditch there was a reasonable suposition that he would be reimbursed at a later date by the Flood Control District fora portion of the work. Supervisor Shoemaker addressed the Council suggesting that Mr. Woodworth submit a request to the Flood Control District for matching funds for the drainage project. However, he emphasized the fact that he was not assuring Mr. Woodworth of anything I at this time. Mr. Woodworth expressed his appreciation of the consideration the Council had given these problems tonight, Res. Approving the .Trafficways Plan for Sonoma County, Prepared DeLeuw, Uatner & goo e to the late hour, this matter was held over. 1 At the request of Councilman Gustafson, a study session was set for 6:30 po m, next Monday night, August 24e Small Boat Harbor. Supervisor Shoemaker and Mr., Glenn MacKenzie, Harbor Commissioner, addressed the Council, requesting an indication as to the Council's feeling in connection with the proposed small boat harbor for Petaluma which is now being handled - by the County. After some discussion on the subject, and through h poll - revealing 7 affirmative votes, the Council reaffirmed its resolution the operation of the boat harbor should be in the -hands of the County, - _ and if the County proceeds with - the project, the Council no desire to go into competition with them., ADJOURNMENT: There being no further business to come before the Council, the meeting was adjourned until 7:-30 po m.o , Monday, August 24, 1959° Mayor.
