`Regular meeting of the Council of the City of Petaluma called to order
by Mayor ;Parent.
ROLL CALL:
Present:: Councilmen Crinel.la, Ellis, Gustafson, King, Matzen,
Van B ebber and Mayor Parent.
Absent: None.
INVOCATION:
Invocation was :g:iven by Reverend Fred Rusk, First'Presbyterian
Church.

This being the'time 'set for hearing of protests regarding the Martin
Annexation #1, the Clerk announced that no written protests had been received.
'There - being no verbal protests or comments on the subject, the following

City Attorney; Ed Robert pointed out` that "Mr : AvilYa s. application
indicated he desires to be reimbursed for any future connections to the proposed
sewer trunk.' He stated that he - had not provided in the resolution for an
agreement of this type, whereby the City would act as the collection agent.
Mr. Robert then asked'what the Council's wishes were in this matter.

Report of Dir. of Public Works date d Sept.. 2.1, 1959 recommending
certain stipulations to be set forth in agreement with St. Vincent Church,
submitted and filed.
Copy of letter from, Schubart & Friedman,. - Architects, dated Sept. 17,
1959, setting forth conditions which . they had been authorized to propose by
Reverend Clyde Tillman, submitted and filed,
Copy of report from, Fire Chief J. M. Eaglin dated :Sept. 21, 1959,
outlining certain - recommendations in connection with fire protection for the
proposed school,, submAtted-'and filed.,
The City Attorney informed the Council that he believed it was the
desire of the Planning Commission to request that the -Council enter into an
Agreement with St. Vincent. Church..to provide for certain recommendations
in connection with granting of the subject Use PQrm:it.
. To a question by Councilman Crinella, Architect Henry Schubart, Jr.
answered. that St. Vincent Church wou Id. agre . e to reserve a -strip of land 20'
deep parallel with" Magnolia Ave. and adjacent theire,to
and a strip of land
15�' wide parallel with .Cherry -St. and adjacent thereto . for future street
widening. He explained that this land Would not, at this time,.. be dedicated

to the City.
Father Tillman explained that the various buildings proposed for the
site will be constructed - in phases. For instance, the convent onvent building Will
probably not be - constructed until about 1970.
Fire Chief Ea noted that his recommendations for - fire hydrants
had been based on the completed,project - all of the - buildings -- being proposed.
He ther.efore believed that it would 'n no t be necessary to install - afire hydrant
at Magnolia - Ave - . & this time. This hydrant should be installed
when the convent building is constructed.
In so.far excluding the - school from any future - street improvement
work, City, Engineer - Al - Roberts stated that he could not this,, -
s i nce ince such improVemen ' ts would certainly be of benefit to the school as well
a other abutting
Father Tillmah that if he could have the"assu - of the City
that such work would be before - 4 or .5 - years:, he - would - be willing
to agree that the school - would not be exempted from future street paving
work undabutting - improvements.
.-There were no - objections to providing foru 57year limitation clause
in the agreement; - whereby the school would not be any street
paving Work and abutting, improvements fora period of 5 years.
At :request of Mr. Schubart, the City Engineer was - directed to -
prepare: ,q finished - 'Street profile which was to be attached to the agreement.
The City Attorney was directed to - prepare an agreement, in accordance
with The wishes of the Counc and a resolution thereon to be .presented at the
meeting of Oct. 5, 1959.

1958 Plumbing Code Discussion
After'som'e discussion as to fees submission of plans, etc. ,. and at
the. request of Councilman King, consideration of the 1958 Uniform Plumbing
.
.Code was held over for further study until the next regular meeting.
Business License Discussion
Councilman Van Bebber referred to a recent occurrence whereby the
City'Tax.Collector had requested - . a business license from Lings Home
Furnishings of Santa Rosa. Inasmuch. as Lings' attorney had deemed that
th—. it work in town was only `an incidental transaction, the City_ Attorney had
passed the' opinion that no business license should be required.
At the request of Councilman Tan Bebber,. the City. Attorney then
explained his reason.for concurring with the.opinion of Lings attorney on this.
Discussion was held relative to whether or not this particular case
shmild be taken to court; if it might be advisable to amend our present
business license ordinance in order to cover situations such as this more
thoroughly; etc,
City Attorney *Ed Robert stated that he felt the present license
ordinance was a very good one. He further stated that he did not believe
this case should be pressed any further, under the present circumstances.
It was the decision of the Council to abide by the City Attorney's
opinion in this particular. case. However; the City Tax :Collector was directed
to keep a close check - on .such casual business being :conducted within the City
in case such business should become more than merely_ occasional.
