ROLL CALL: Present: Councilmen Crine.11a, Ellis Vari &bber and Mayor Parent. Absent: Councilmen Gustafson King and Matzen.. I READING OF THE CALL: Notice of the call .for special meeting- and the Clerk's certificate of mailing were submitted and filed: consent to the holding of said special meeting was indicated by the signatures of the Councilmen attending the meeting. Memo. of Agreement re Budgeting Gas Tax'Fuhas - for M4jo:r_ Sts. Memorandum of agreement budgeting ga's tdic funds for major city streets, submitted and filed; whereupon, Res.: #232.0 N, C,' S. imroduced by Councilman Van,Bebber, seconded by Councilman Crinella, entitled, "RESOLUTION OF THE CITY COUNC,,IL. THE CITY OF PETALUMA ADOPTING BUDGET AND A'PO_ THE FIRST SUPPLEMENTAL MEMORANDUM OF AGREEMENT FOR EXPENDITURE OF GAS TAX. ALLOCATION FOR MAJOR CITY STREETS. I adopted by 4 affirmative .votes, 3'absentees. Approximately 7:10 p. m. Councilman King - entered the Council Chamber at this time. Linda del Mar Subdivision - Submission of Findf-Ma 'Final map of Linda,del- Mar Subdivision,. $ubm itte"J and filed. Report of City Engineer Al Roberts, - dated - Sept. 28, 959, -recommend- ing the construction of improvements in the subdivision, 'submitted and filed; - The 1 recommendations outlined in report had been incorporated in the resolution- approving the final map. The City Engineer .informed the . Council that the final, map of Linda del Mar Subdivision was substantially the same as the tentative aip which had been approved by the Council a"t a previous meeting: He out one change which had been made in the moving of. a street, and exp*lain.ed the reason for this change, Referring to - Section (1) in the resolution approving the - final map of the subdivision, the City'Attorneyexplained�� 'that because of many tentative maps which had been submitted, there is a discrepancy in the description of � W c , - I . - I . . - I the preliminary title reports as relates to the actual 9UbG`1`vLS'io as f iled. After checking with subdivider"s attorney, it had been'agreed that the City would be furnished with a.corrected title policy. The subject res ,- ' olution was then full. After discussio . on various portions of'the subject ­rO solution, the following changes were made: Section `(2) (c) - A. sentence was -added to this section which read, "D6pth"0f 'rock' base may be adjusted'in the discretion of - the City Engineer on streets of less than 60 feet in width,.." "Pipe: -to, be reinforced where placed'unde.r. streets, Section :(2) (o) - This section .was 'added to the resolutiowand was written to read: -"All above - work and materials to be done and/or furnished in accordance with standards adopted and approved by the City.Engilleer.i.' Section (3) 'The ,total sum of the performance bond'wds changed from $480, GOO. 00 to 34 00; 000.000 Mr. Jess was in agreement . with'all of the above changes. Each - change was initialed on the resbIdtion.by the introducing and seconding Councilmen- whereupon, Res. #2321 N.C. S. introdu'cedby Councilman King seconded by -Councilman Ellis entitled, "A RESOLUTION-APPROVING FINAL MAP OF LINDA DEL MAR SUBDIVISION NO. 1, PETALumA, CALIFORNIA was adopted by the following vote.: Ayes Councilmen Crinel Ellis, King and Mayor Parent. Noe& Councilman .Van .Bebber. Absent:: Councilmen.Gust,aipoh ' and Matzen. At the request of the subd'lv r P ide '&a the City Attorney_.stated that a release and Abandonment of roadway had - submitted- to - him for the - - City" -- H the necessity for this stating tliat".a had - been prepared - the matter for the Council's action tonight. The res .was 'then read.. Counc Van-.Be objected - the Counc il"�s :acting - this , resolution tonight, inasmuch "as it , had not , appeared On the agenda for the special meeting. Res. : #2322.N. C., S. introduced by Councilman Ellis, seconded by Councilman, King, entitled, "RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT TO ABANDON A ROADWAY IN THE LINDA DEL MAR SUBDIVISION NO. 1. adopted by. the following vote; Ayes: Councilmen Crinella, Ellis,, King *'and Mayor Parent. Noes:, Councilman Van Bebber. Absent- Councilmen Gustafs and Matzen. I� I (2) 6� � f .2 September 28, 1959 1 1 1 Discussion re River '& Harbor Improvements Mayor 'Parent suggested that this matter be held over until the next regular meeting, due to the fact that it was now past the hour which had been scheduled' .for an informal meeting with the Petaluma School Board. There being no objections to this, the matter was held over as suggested. ADJOURNMENT: Ther°e_ being no further business to come before the Council, the meeting 'was 'a.d journed. Mayor.
