ROLL CALL: Present: Councilmen Crinella, Gustafson, K ing. Matzen., Van Bebber and Mayor Parent. Absent: Councilman Ellis. INVOCATION: Invocation was given by Reverend Victor Magnussen, Elim Lutheran Church. APPROVAL OF MINUTES: Minutes from the meetings of Feb. 1. and 8, 1960. were approved as recorded. - BID OPENING ,Equipment - Kenilworth Park Recreation Bldg. The Clerk announced that 3 ' bids h'ad been received on the subject equip- ment and proceeded to open said bids. city-Attorney Ed Robert ruled that in view of the amount of items involved, it would. be proper for the' Clerk to merely read the total. of each bid; individual items would be reviewed by a committee. Bids were received from: the following firms° Dohrman Hotel. Supply, Co., San. Francisco Weller. - Hopkins, Furniture Co� , Petaluma Schoen ingh,'s Petaluma Co.uncilmen.Gustafson & Ellis, the City and Chairman of the Recreation Commission were appointed as a committee to go over the bids and submit - their `recoinrnendatiori to the Council at the next meeting. The matter of gathering, these, people together for a committee meeting was lefv*in the hands of Councilman Gustafson. PETITIONS & COMMUNICATIONS': Proposed Denman Flat Annexation 1VIr: Harry Gossage informed the Council.of the properties to be involved -in .the P` . R ro osed' annexation, and-pointed out the general area to be annexed to the City. He exp a ined that two, of he property owners., Mr. Elmer Scott and Mr. Dick Gray, both of whom own land which is contiguous to the City, are not desirous of annexing. 1VIr Gossage requested that the. Council. make a study of the proposed annexation In order to- determine .the, proper boundaries, how th,e school_districts', should, be: set`. up, etc. He went on to explain that according to lava, this' area.could' be annexed''on. the basis of being uninhabited, and that it was 'planned to exceed 600 acres. In answer to a question by Councilman Matzen - Mr: g Gossa e' answeredithat it was his s u.nderstandi:ng matter of of. how much land would be annexed from the Scott.and Gray - properties could be decided by the City Council. It was noted by Mr_ that one of the things planned after annexation of. the area was the formation of a sewer district. -'Councilman Van Bebber made a motion, which was seconded by Council - n .an Matzen, that the Director; of Public Works be directed to designate the boundaries of the area and proceed with annexation on motion of the Council. (1) (Cont'd) 310 February -15, 1960 Proposed Denman Flat Annexation coned Mr. Elmer Scott and Mr. Dick'Gray addressed the' Council. stating that they were not interested in annexing to the City,,, inasmuch as they were not developers,, these gentlemen were concerned with the. increase in taxes and the amount of sewer assessment which would be placed.oh their properties if annexed to the. City. Mainly; Mr. Scott and Mr.. Gray were concerned with the formation of ' a sewer district which they felt= wou.1,d be quite- expensive for them.. The City Attorney explained that at the. tine a. sewer district Was formed for construction of sewers in.the area,, Mr. Scott and Mro. Gray would have an opportunity to show that this would be an excessive burden on their .part,. and they would be able to have themselves excluded,foll.ow : ng the procedural steps required by law. This matter was tabled until after the public hearing which was scheduled for 8a00 P. M. PUBLIC HEARING: 8:00'po m. Assessment - : District #4 N. So This, being the time set tor_ hearing protests and comments on the subject assessment district, the Clerk. stated that one written protest .had been received'. A letter dated 'Feb.. 15, 1960, signed by Douglas H. - Foot and Shirley,E. Foot, protesting. the amount of assessment for street pavement fronting their property, was read and filed. Mrs. J. 'Simoens, 745 Mt.. View Ave,., addressed the Council stating that there was a large. hole in the new street in front of her home.- A ssistant. City. Engineer Roy Kelly explained that there is. a survey monument - at this hole and a casement would be placed on the hole in the very near.future, In .regard to the Douglas ,Foot property assessment, City Engineer Al Roberts recommended that'Mr.. Foot be granted a credit of�154 08 on his assessment and .that the City make up this difference to avoid going through expensive legal and engineering processes in order to respread amount throughout the entire assessment district.. . He explained that a , portion - of the street fronting on Mr. - Foot's property was. included in the original. Booker Subdivision and had therefor been accepted by the - City After considerable discussion on the subject and reference .to agree- ment between. the-'City -and the developer of the.Booker Subdi.vis?.on, , it was suggested by Councilman..Crinella that Mr.. Foot be given' a credit of- $88. 67, and that the City -pick 'up this difference. A poll - was then taken -in which a "Yes" vote would mean than the City. would �contribute 67 on the F: oot' assess - �ment.. There were 6 affirmative votes, 1 absentee. Mr. Robert"Mossi, 950 Mt., View Ave., addressed °the Council complain ing of the .large hump in his driveway.. City Engineer Al Roberts .informed 'Mr.. Mossi. that this was.a problem which could :only have been eliminated by cutting into his driveway in order to lower it, - ° Phis, he explained, would -have run into considerable additional cost. Mr.. Mo,ssi remarked that with the car :. . he presently owns, it is possible to drive in and out of his driveway without_ scraping the car. Due to the fast that there are some property owners who wish to subdivide their large holdings, City Attorney Robert asked than th hearing be postponed in ..order that the two property owners can have their properties subdivided and'the assessment liens- charged against the divided parcels this would :eliminate the need of re-:assessng later on. It wa the dec'is'ion of the Council to bold the matter over until the next regular meeting. The hearing was to be continued at 8:00" .. in., March 7. 9;10 p. m. - 10 minute recess was declared, The meeting was called back to order.. February 15, 1960 PETITIONS ' & COMMUNICATIONS: Proposed Denman. Flat Annexation -' cont'd The City Engineer pointed out on •a m ap the proposed sewer line route for the subject area, after which there was disc' isc_ussion relative to the size of the line, the proposed route, etc. Mr. Gossage istated that'he now has .an engineer working' on the cost 'of constructing the sewer line and should have the results of'this study in the near future. He also noted .that meetings had been ,set up in order to discuss the matter of a , sewer assessrrient district with the property owners in the.area. There was discussion relative to the wordingbf`Councilman Van.Bebber's motion 'concerning the annexation. Mayor.Parent requested that the Clerk read the motion as she had noted it. - After this reading,' and further discussion as to the exact meaning of the wording ; Councilman Van B ebber withdrew the motion and made a .new motion that the Director of Public Works be directed' to determine what he feels to be reasonable boundaries for the proposed annexation and present his s- _easons.for selecting them as such,' and to present any other evidence which might-be necessary for :the Council's consideration on this annexation. A poll was then taken which revealed 6''affirmative votes, :1 absentee, in of proceeding as`outlined'n the motion. Mayor-Parent asked Councilman King :.contact the various, rural school districts "in the area proposed to be annexed after the Council has received the Engineer's report on boundaries, so that a series of meetings can be arranged''with all of the people who will be. affected the annexation. . Following- general discussion on the subject, a poll - was - taken determine if the majority of the Council- were in favor of'participating in, this Work with Mr. - Novak, and contributing no more than -the correcte e d estimate of $23 00 to the project. (5) 3,14 February 15, 1960 Mr. Mel .vin Hein addressed the Council: expressing the opinion that the City, under its present plans, wou.1d be locating the proposed boat harbor in the middle of: what always has been - considered one of Petal.uma's best industrial park sites. Councilman flan 1Bebber pointed out- that this opinion -was debatable, ,inasmuch as the Gity' °s Master Plan had rjot been received as yet, Wes Hill, - Water Dept.. Manager, reported that the pipe line across the Petaluma River had been repaired at a cost of- $19000.00, and that the reservoir had been - filled by the recent rains .Last Saturday afternoon, ADJOURNMENT: There. being no further business to come before the Council, the meeting . was adjourned..
