ROLL CALL: Present :. Councilmen Crinella, Ellis, Gustafson, King, Van_Bebber and Mayor Parent. Absent: Councilman Matzen. INVOCATION: Invocation was given by Reverend „Roy, Ross, Two Rock Presbyterian Church. APPROVAL OF MINUTES: Minutes from the meetings of April 20, May, 2 and 9, 1960, were approved as recorded. Mayor Parent introduced the new City Manager, Lawrence Larson, and,.welcomed him to the City of Petaluma. PE TITIONS & COMMUNICATIONS: Notice of Mayors' & Councilmen's Institute to be held in Berkeley on May 264nd 27, 1960,, submitted and filed. Letter from Louise Montero dated May. 4, 1960, thanking the City, on behalf of the McDowell residents, for installing the stop signs on McDowell Blvd. ; read and filed. Application of-..Isabel S. Minor for City Deed on portion of lot #76, s.:csr_� *ted and.filed. It was explained by Councilman King that this procedure was necessary in order to, comply with. Ord... #34,, approved on July 22, 1867, and an Act of Congriess entitled, "An Act to Quiet Title to Land in the Towns of Santa Clara and P �, luma, in the State of California, approved March _l; 1867. " Councilman King noted that the deed was needed in order to obtain title insurance on the subject property; whereupon, Res. #2466 N. C. S., introduced by Councilman King, seconded by Councilman .Ellis, entitled, "RESOLUTION GRANTING CITY DEED TO ISA'BEL S. MINOR. " was read and adopted by , 6 affirmative votes, 1 absentee. Letter from R. E. Layton & Associates dated May 9, 1960, re - Petaluma Aqueduct, submitted and,filed. 'School District. Annexations Letter'frorn Petaluma B-d: of Education dated May -12,, 1960, requesting that City Council include in 'any territory annexation proceedings to City, that such territory also be annexed to Petaluma City (Elementary) School District, read and filed. Copy of resolution adopted by Rural.Trustees Association of the Petaluma .Rural Elementary - School Districts on May 4, 1960, requesting that all rural school remain, as they presently exist regardles's:of changing city boundaries;, and that future territory annexations to the City of :Petaluma be annexed` to the City School District :only by mutual agreement between the districts concerned, read and filed. The .appointment of'a, committee to negoitate on this matter, as well as the ::oat harbor project, was left in the hands of Mayor Parent. .Letter from Petaluma Water Commission dated 16, 1960, recom- mending, that a letter of contract be negotiated with Mr. R. E. Layton and requesting that $4000 00 be transferred from the Rental`Fund to the Consultation Fund to allow an expenditure of $500. 00 for two months, '(May and June, 1960), plus incidentals in the current year., read and filed, resolution of Water Commission thereon, submitted and filed, Copy of Mr„ . After some discussion relative to the necessity of hiring Mr. Layton, the Council unanimously agreed that a transfer of funds should be made as requested by the Water Commission, and that said transfer should included in the group of proposed transfers to be presented to the Council for action .at the -next regular meeting. (5) 36 • o� Maly 16, 1960 R. e Removal of Trees Grant Ave. - School Site Acting Mayor King informed the Council of a request he had recently_ received from Mrs. Marion, owner of property "adjacent to the Grant Ave. School site, regarding the removal of a number of trees on the school site near her property, He stated that a contractor now working.at the school site would be willing to remove the trees for a cost of- $350.00 'if the work: was done while his mein were still on this job. Acting Mayor King Went Oil to say that the subject trees would have to be removed eventually, as they are located on land which will become a city street right -of -way. Councilman Van Bebber stated; that he could make no decision in th:je matter until he had seen the area involved and become familiar with the problem. Councilman Ellis was also in' favor of seeing the area involved before taking any action on this. The Acting. Mayor noted that this would call fora decision on the part of the Council in the very near future, - -he believed about one week. - After that time, the contractor would be leaving the job and the offer of $350. 00 would no 'longer stand. After further discussion, members of the Council agreed. to investigate the situation by next Thursday afternoon. . The City Manager wa "s directed to contact each member of the Council for his decision in the matter on, Thursday afternoon, and then decide whether or not the subject work should be done, based on the answers received from members of the Council.. Acting Mayor King reported on a recent joint meeting of the Faair .Bd. , School Bd. and* the Council committee, at which. time discussion was held on the subject the d new access road for Kenilworth:jr; High School.. Several proposals were made, the final one being to bring the new street through, where -Ellis.Street now ends in a. "T" at East' Washington Street, However, - he understood that the: Fair Bd. had met since then and turned 'down this proposal - He had been informed that if - the three publicagencies involved. could not reach an agreement on this, the State would then have to solve the problem, In talking with a representative of the State, the Acting Mayor- stated that he had learned there will be a sidewalk .improvement over the-present interchange at East Washington Street very shortly. Payran Street Extensio A problem involving the acquisition of the Mancebo-property on what will be the extension of Payran Street was related by. Acting Mayor King; He, stated that after attending a meetii With the property owners on this, he believed the City.Attorney should be to prepare necessa °ry legislation to start condemnation proceedings; in case an agreement is not reached before the next meeting, He explained, that, the•property would be willing to sell entire parcel, except.for an option which apparently exists on the property. City, -Ed Robert pointed out that even though condemnation proceedings had been started, this would not preclude future negotiations - with the ro ert owner if an agreement could be reached prior to trial:•: p P y' g P .(Couneilman entered the Council Chamber. The time was approximately 9:30 p.m,) The Council being in agreement with the line of procedure suggested_ by the Acting Mayor., the City Attorney was directed to be prepared to present - legislation to commence condemnation proceedings at the next meeting. Acting -King called the Council's attention to the fact that the Little League sponsors have constructed facilities at. the park :to 'be used in connection. with­ the ball games held there. However, - because a. sewer which was -apparently promised by the City has not been installed, they cannot use these facilities. (6) . (cont'd) 3 6*7 May 16, 1960 coat `d Assistant City. Engineer John Stratford explained that as he understood the situation the Little League was to provide the materials for the sewer, and the Parks Dept, and public - Works Dept, were to provide the labor. Councilman Ellis stated that he had been informed that the City would go ahead with the work as soon as the man-power was available, There was discussion concerning the question of who had originally in.a'de this promise to the Little .League, etc, The matter was referred to the City Manager for a full report on the situation, said report to be made as soon as possible. Councilman Gustafson reported on a hearing he had attended in connection with. the proposed danger zone in San Pablo Bay, stating that nothing definite had been decided at the meeting, However, there would be another hearing on the matter of which the City would be notified. Nirso Emma Tietze, 25 Howard Street, addressed the Council requesting that: the fence along the side of the Police - Station be extended to inclose the adjacent lot which was recently purchased by the City. The matter. was referred to the City Manager-for a report thereon. Mr.- E. W. Calkins, 1000 Mt,, View Avenue, called the Council's attention to the stop sign on McNear Avenue, coming towards town, which is widely ignored, He suggested that a "yield right -of -way" sign installed to replace the present sign. Inasmuch as the corner is not too unsafe, he felt that the "Yield right -of -way" sign should suffice, The matter was referred to `the Traffic Committee.
