St. Statement of Policy re Variance Applications Resolution :of .statement of policy regarding variance applications, submitted and filed. City -Planning Director Dick Coleman noted that this resolution had been passed by the Planning Commission at its meeting of'May 17, 1960. In general -, this policy would provide for a $50.00 -fee for each individual lot in the case of multiple variances. In other words, when applications are submitted for variances on several lots within a subdivision,' etc. , under the subject policy a $50, 00 fee would be charged for each lot. 'Councilman King did not believe the Planning Commission should set policies concerning -fees to be charged by the City, He felt that this should be done by the Council. . However, Councilman Ellis, Council representative on the City Planning Commission, believed this was a matter of interpretation of the City's zoning ordinance rather than a matter:cf actually setting fees. Gity Attorney Ed Robert stated that in accordance with the wording of the zoning ordinance; he believed a fee of $50. 00 should be charged for each individual .lot requiring'a variance. Legally, he believed a variance is applicable to only one aoto T here. was discussion as to when an application for - variances on 6 lots in Linda.Del Maz''Subdivision had been submitted Mr . Ben °Woodworth. Mr. Woodworth informed the Council that his application had - .submitted approximately 2 weeks ago'. It was thereby determined that Mr. Woodworth's, application for variances had been submitted after the .Planning Commission had passed its - policy resolution on fees, After. further discussion between the Council; - members of the Planning Commission Mr. Woodworth, Councilman King - . stated - that he felt the zoning ordinance should be amended in order to clarify the - wliole matter if the Council concurred with the Planning Commission's resolution. However-, it was the opinion of the City. Attorney that such action was not necessary. He felt that a resolution would suffice. , Mayor Parent then. directed the City Attorney to prepare a resolution ...stating in general that the Council accepts the recommendation of the Planning Commission in this s The Mayor felt that in this - way, members of the Council could then -officiallyadopt - or reject the Pianning.'Commission's recommendation concerning variance fees. Variance. - G. - M. Stonitsch R.eso °lution` - recommending the granting. of a variance to G. M. Stonitsch, 45 Shasta Ave. ; to divide property on Hill Blvd. into 2 substandard lots, submitted. and Mr. Stonitsch - .addressed the Council requesting that the reconsider the :gra-nting of a variance to allow him less then 5' side yards his property. This port ion, of the variance had been deleted the City Commission. Af_ter considerable discussion on the subject,­ Mr. Stonitsch decided to withdraw his request because of the time element involved; whereupon, Res. #2477 N. To' question by Mayor concerning the .use. of hatchery buildings, or portions thereof, -, which. are not in use at this time; Mr. Popp: stated that the interim ordinance recommended by the Planning Commission would ;not cover these situations, He noted that this was merely an ordinance - to enable the H & ,N Hatchery to obtain bank financing which they are interested' in securing, He went on to say that the recom- rnended hatchery zone seemed to be agreeable to Mr. - Wm. Devitt, representative - of the H & N: Hatcher' Yo - Councilmari King felt that the proposed `hatchery zone Would not solve the problem - of'the . ' hatchery­- .in financing, He did not believe the, proposed ordinance would :satisfy ­a bank, After further discussion'on the subject and at the suggestion of Mayor Parent, the ordinance concerning the - proposed- hatchery - -zone -was withdrawn by the introducing -, and -- seconding, Councilmen. The matter was to be discussed further with the- Planning_ Commission; so that a .general ordinance could lie: worked out.to cover the situation. Councilman Matzen asked that the Planning - Commission make a sincere effort to return this matter to the Council as soon as possible.. Councilman King noted that during negotiations he had stated that if a price somewhere in the neighborhood of'$11,'500 was asked, he would recommend that the Council, accept this offer. However, as a Councilman, he did not feel that he could set a. selling price for the subject piece of land Mr.. Karsevar addressed the Council stating- that . if this matter should be taken to court through. condemnation: proceedings, he sincerely felt that. the lowest price his client would receive would be..$13, 000. After discussion relative to the hiring of an. appraiser,, etc..,, and at the suggestion of -Councilman _Matzen, Mayor Parent asked that the Council Committee meet once mo re with Mr. Karsevar and - his client for further . negotiations, Council Committee Reports Traffic Comm: ttee Traffic Comrrmittee dated-May 31,, .1960, .submitted filed°. Councilman 'King called attention to the stop signs- in City which .are situated in the middle .of certain streets, - He - felt that these s4ms`vvere very - confusing - to nonresidents and suggested that consideration be given ,to moving them to side of the street. City ,Engineer A 1 - Roberts informed the Council that he had recently discussed this matter, and`-the matter of having - school safety patrols, with Dro .Manning. The schools still seem - to be opposed - to - safety - patrols. Councilmn'Matzen suggested solving the problem by uniformity of school stop= signs throughout the County, The matter was referred to the Traffic Committee, Mayor Parent excused himself from the Council. Board's request that a study -of the boundaries of the elementary school districts be made by the. County. Committee on School District Organization.
