Adjourned meeting of the Council of the City of Petaluma called to order
by Mayor Parent.

Present: Councilmen Crinella, Ellis, Gustafson, King, Van Bebber
and Mayor .Parent,
Absent: Councilman Matzen.
PETITIONS & COMMUNICATIONS:
Letter from Petaluma Chamber of Commerce dated June 10, 1960,
setting forth its budget request for' 1960 -61 under° the City advertising program,
submitted amid filed.

Claims approved for payment by the City Manager were submitted and filed..
Referring' to some claims which .had been submitted by the Chamber of
Commerce for payment, Councilman King stated that he hoped these bills would
be presented as soon as they are received in the future.
Mayor Parent believed an understanding had been reached with the
Chamber of. Commerce on this, matter, and that from - now on,, bills would be
presented, for payment as soon as received by the Chamber.
The resolution approving payment of claims was then adopted.

Spocifica.tions on tl e subject autos were submitted and filed,
To a question by Councilman King relative to the .30 -day delivery date
set forth in the.specif.ications, the City Manager answered that if this did
present a problem, the 30 -day delivery date could be waived by Council policy.
Councilman Ellis noted that he had checked with some of the dealers
in town and had been told that the specifications regarding delivery would
present no problem. to them.

Re s, Approving Policy re Variance Fees
Councilman King stated that he was still of the opinion that this matter
should be handled by an - .amendment to the zoning ordinance if the Council
- -ices to set the variance fees at $50, 00 per lot as recommended, He also
i)ressed the opinion that the more expensive it becomes to develop land in
the City of-Petaluma, the less attractive this City will become to subdividers.
Councilman Cr. inella objected to the wording of the second paragraph
of the subject resolution which. read,' < o subdividers, contractors, builders
and othr.r persons are required to bear the burden in compliance with zoning
laws... , � < "a The City Attorney noted that this was the usual terminology
used in this type of legislation and merely was a statement to the effect that
it is the burden of. person building and using his tot to construct, build and
use his property in accordance with the existing law.
The subject resolution was then defeated as follows:

Mayor- Parent remarked that he was very sorry the Council had not
backed up the Planning Commission in this matter. He believed this resolution
would have caused future developers to be more careful in their planning, etc. ,
and that the final results would have been to save everyone money,

Policy re Variance Fees coat'd
The City Attorney explained that he still maintained the same opinion
on this 'mattero He believed, in accordance with the present zoning ordinance,
there should be a variance charge of $500 00 for each lot, What would be done
in the future would be a matter of Council. Policy.
The City Engineer stated that he would like to have a definite policy
set by the Council on this, so that in the future his office would be assured of
charging the correct amount when applications for variances are submitted.
Mr.. Woodworth addressed the Council stating._th.at he did not agree
with the City Attorney "s interpretation of the zoning ordinance. He went on
to say that he could not recall a time when the City had charged more than
$50.00 for a variance, even though there had been more than one lot involved.
The City Manager suggested that an amendment to the zoning ordinance
be prepared in order to clarify the terminology of the present ordinance. He
felt that this would resolve the immediate situation, treating any variance
application as a single variance until the proposed ordinance is either adopted
-and becomes effective - or is rejected by the. Council. - -
The Council having no objection to the City Manager's suggestion, the
City Attorney was directed to prepare the necessary legislation to amend the
City's zoning ordinance.
Payran Street Extension
Councilman King reported that the price now being asked for that portion
of the Ma'ncebo property optioned to Mr. Stonitsch is $12, 500° 00.
At the suggestion of Councilman Van Bebber, this matter was to appear
on the agenda for consideration at next. Monday night's meeting.
ADJOURNMENT:
There being no further business to come before the Council, the
meeting was adjourned.
