Staff report dated July 18, 1960, containing information and recommendation
on subdert_',bids, signed by City Engineer and City Manager, submitted and filed.
City Manager Lawrence Larson reported on`the 5 birds which had been received
- and.opened on.July 12, totals'of which are listed below.

Mr. Larson stated that the Staff recommended acceptance of the bid of Soatena
Y , Co., the lowest responsible bidder. It was explained that the units which are
in the C1ty'Hall at present were purchased from this company, thus giving the City
an advanthge from a standpoint of service.

Mayor Parent briefly explained what had.transpir°ed on this matter to date,
" .stating that these people had checked at the City Hall and been told by members of the
staff that they would be charged a license fee in accordance with the provisions of
the. City Code,
The City Attorney stated that there was nothing in the City Code, in his
opinion, which would exempt this organization from the license fee required.

However, members of the Council expressed the belief that it had riot been the
intention,,of.the Council to charge or gan long of this type a license fee, it
was also the consensus of opinion that the subject organization should be allowed
to go ahead and solicit in the City without paying.a fee,
A letter was directed to be sent to the National Federation of Independent
Business,, info ' rming them of the CounciV decision.
At suggestion of Councilman Matzen, the City Attorney was directed to
check with the League of California Cities for guidance in preparation of
legislation to solve this problem.

City Manager
Claims approved for payment by the City'Manager were submitted and filed,
Councilman King questioned olaim #30, payable to John Adams'
requesting to
know if this claim was for the topography map only, or if it also included the
survey at the Small Boat Harbor site. It was explained that the subject, ciaim -
merely covered the topography map. However, the total 'price of the map and the survey
would still be as originally quoted.
Referring to claim #61., payable the Marin County Building Inspector for
his work during the absence of the ' City Building Inspector, Councilman King requested
to know if the City Building Inspeotorgs salary continued during,his military leaves.
The City Manager and City Attorney informed Councilman King that this was true,.
noting that according to law, the salary of'a City employee must be, paid ,while said
employee is on official military leave,

Appeal of the decision of the Planning Commission dated July 14, 1960, filed
by John, d. King, Agent for Luma Industries, read and filed.
Noting his personal interest in this matter, Councilman King requested to be
excused from -the Council Chamber during discussion on the subject. However, Mayor
Parent informed him that there would be no action taken tonight, other than the
setting of a hearing.date. Councilman King therefore'remained at the meeting.
To a question by Councilman Crinella, Planning Commissioner John Gibbs stated
that the'Commission's main,reason for denying-this' Use Permit was based,on -the fact
that it felt the building in question was far less desirable for such a use than I many
of the other vacant hatchery buildings in the City.
Mayor Parent noted that members of the Council had been in conta'ot with Mr.
Maxson last Saturday, and had assured him that the'City was interested I In seeing these
vacant buildings put to u
Councilman King stated that he had made a complete tour of the avililable
buildings in town last Saturday with Mr. Maxson. It had been determinea*at that time

that the only 'building suitable for the operation of the plastics firm would be
the 4 3k: -Hill Hatchery, He,noted that the cost of remodeling the Vestal Hatchery

one building f or or which the subject Use Permit had been denied. If this could not
be done, it�would necessitate their leaving Petaluma.

City Planning C ommission ommission to take a tour of the Oak Hill Hatchery building before the

It was explained by Bob Stimson, Planning Commissioner, that the Commission

the cixaumatances involved in this case. The Commission was not familiar with the
sti.bdivision agreement, due to the faot that the Council had set forth the provisions
contained therein.
City Engineer Al Roberta pointed out an error in the resolution before the
Council, noting that the minimum rear yard for Lot #3 should read 12 rather than

Answering a question by Councilman King, the City Engineer explained why it was
necessary to have the curbs higher on one side of the street. He noted that if the
curbs were made level,, it would create a, very poor drainage situation.. '

To a question by Councilman Van Bebber°, the City Engineer stated that the
property owners on the '®uth side of Oak Street hate canastructed cur°b& and .guttea°s
of concrete, which he assumed were to City standards at the time they were eons:tr°u:otled
not too long ago. The driveways were -fie only thing that were not constructed to
City standards because of the existing, high crown street at the time this work was
done.

he had, been unable to reach a price of $12,250.00 as was suggested as a compromise
a former Council meeting. He also - noted that additional property, other than
set forth in the original agreement, was now being purc.hased.
In answer to a question by Counoilman King, the City Engineer stated that the
City would have to negotiate with the RJC for a new croasing of the railroad track
on Payran St. Ext. He went on to say that the RUC might not approve of two crossings
so (.,:I-!ose together. Of course, the City will attempt to maintain the Shasta Avenue
cross-,.Tig but there is a possibility that it will have to be given up.

The Manager informed the Counbil that the salary range for the subject
classification was exactly midway between Sergeant and Assistant Chief of Police.
To a question by Councilman Gustafson, the City Manager answered that the
Staff was recommending that the appointment to the subject position be filled from
the eligibility list, and that such eligibility list be established through a combin—
ation of a written examination and an oral interview.
Counplilmd Gustafson stated that he did not believe in examinations tions of this
type. He (felt that the Department Heads should be allowed to make these appointments.
Mayor 'Parent pointed out that this resolution would actually protect the
Policia Chief. In other words, after the examinations, the Chief of Police would be
able to point t out the fact that he had chosen a man for the position who had come out
with one of the three highest scores.

After extended discussion, certain merdbars of the Council suggested that
the resolution previously introduced and seoonded be withdrawn and the matter
referred back to the Water Commission. The introducing and seconding Councilmen
did not consent to the withdrawal of the resolution,,
Councilman Van Bebber and Councilman Gustafson expressed strong opinions in
favor of the Water Commission recommendation,
Mayor Parent indicated agreement with Water Commissioner Brown 9 s - opinion, that
the consulting, services c,f Mr.. , La_yton be engaged, for a period of one year, and at
the expiration'o'f that time, the matter of a full-time engineer be further explored.
Cbuliiallmen Crinella, King, Ellis, and Kit, made statements in favor of the
staff report and indicated they felt the Commission and Council should follow the
recommendations as set forth by the Staff.

that all phases of the economist's report had been, reviewed and the State staff had

be confirmed by letter.

Honorable Mayor Parent and
Members of the City Council
Petaluma, California
Gentlemen:
At an adjourned meeting of the Petaluma Water Commission held
July 18th at 1:00 p. m., through an approved motion the Petaluma
Water Commission recommends that the hiring of a. full time
staff engineer for the Water Department be given no further
consideration - at this time.
It was the further decision of the Petaluma Water Commission
through an approved motion that the City Council and staff
continue negotiations with R. E. Layton & Associates for
engineering services as a routine engineering consultant and
as a consultant for major projects, plans, and specifications.
