ROLL CALL: Present: Councilmen- Crinella, . Ellis,, Gustafson, Matzen, Van _Bebber and.Mayor Parent. Absent: Councilman King. INVOCATION: In the absence of Reverend Lorne J. Mee, Methodist Church, invocation was' by Mayor Parent. 7:35 p. m•. -- :Councilman King entered the Council Chamber. APPROVAL OF MINUTES: Minutes from the meeting of July 13, 1960 were approved as recorded. At the request of Councilman Van Bebber, the City Clerk was directed to set forth in the minutes of July 18, 1960 the entire report of the Water Commis- sion dated July 1% 1960, which recommended cont inued.negotiations with R. E. Layton.:& Associates and that the hiring of a full -time staff engineer. for the Water Dept. be given no further consideration at this time. Minutes from the meeting of.July 18, 1960 were then approved as corrected. PUBLIC HEARINGS Weed Abatement Superintendent of Streets' report dated July 28, 1960, re cost of abatement of weeds, etc. , submitted and filed. The Clerk announced that no written protests had been received in connection 11 with these costs. There being no verbal - protests or comments, Res, #2531 N. C.S. introduced by Councilman Crinella, .seconded by Councilman _Gustafson, entitled, "RESOLUTION CONFIRMING SUPERINTENDENT OF STREETS' REPORT OF COST OF A ' BATEMENT OF WEEDS, RUBBISH AND OTHER NUISANCES ORQ.E.' ED ABA'TED`BY RESOLUTION NO. 2454 N. C. S. " was adopted by 7 affirmative votes. L,uma Industries Appeal from Decision of Planii Use Permit Commission re This being the time set for public hearing on the subject matter, the Clerks stated that no written protests. had been received. Affidavit.of posting of notice of public hearing,. dated July 22 1960, and signed by John R..: Stratford;_. Assistant City Engineer, submitted and filed. Report of City - Planning Commission -dated July 28, 1960, recommending that they Council deny the - subject use permit, and;. if the Council should grant the permit, recommending that certain conditions be 'made a part of said permit, submitted and filed. Councilman Ellis - stated that he would like see this matter held over until the Council had adopted the RCM Zone ordinance; City; Attorney Ed- noted that the conditions set forth in the recom- mendation of the Planning Commission had be. en agreed to by Mr.. Maxson. (1) (cont'd) 4 f August 1, 1960 r Luma IndustriesPublic Hearing cont'd 'Councilman Va'n .Bebber suggested that some sort of temporary °permit be granted Luma Industries until such time as the proposed RCM ordinance was p ^ t d y, ado ted,b the Cit He felt that the Council would be se tting a poor precedent in �a use permit in this case. There was a general discussion relative to the' manner. in which this matter should be handled,, Ir was pointed out by Mr.: Morgan, P.. G. &E. 'Co., that if some sort of permit was not granted Luma Industries, his company would then require that the applicant advance to them the cost of the job. Mr. Morgan estimated that this would run between $15'0:0. and $1600. - In other words, the P. G. & E. Co. would -have to be assured that this ,was not merely a tempo- rary installation before they could do the work without requiring an advanc& for the cost of the ' project: Mr.-- Maxson appeared before the Council requesting that a use permit be granted to his firm at this time. Members of the audience, who were interested in the, subject matter, were invited to express their. opinions. No protest : or comments were presented. Councilman Matzen requested that roll be called on a resolution granting. the use permit, - subject to the limitations as recommended by the Planning Commission. Councilmen Ellis & Gustafson were of the opinion that the subject use permit should be- granted. However, they felt that this should be-done after the Council had adopted the RCM ordinance Councilman V'an. Bebber stated that although. he was in of allowing Luma Indistries to locate this building, he objected to the manner in which the situation had been handled, (Approximately 8 p.m. == Councilmen Ellis & Gustafson were excused from the Council: Chamber at this time. ) The resolution was then'adopted as follows: Res, N.C. Discussion re RCM Zone Ordinance The Mayor rioted- that the subject ordinance had been discussed by the Council at'an informal meeting this After considerable discussion of the proposed ordinance, the City Attorney was directed to redraft it with . the following revisions: Section 4.11'.10 "A tl'buildings in an "RCM" district shall conform to a standards of . . occupancy as set forth in the Uniform Building Code. " Section 4.11.3 Councilman King felt that, this section was , too restrictive.. City Attorney Ed Robert felt that perhaps section - should be expanded to provide for more uses to give the- Planning Commission - a standard -by which they might .find that some use not listed is of a similar nature, if its also compatible with residential. Section -40 11.3 "Exi ting 'incidental - a "nd accessory structures and uses on the same site and necessary for the operation of a permitted use. Section .4. 110 10 (b) The words, "architectural and engineering ", referring to the type of plans, were deleted throughout this section. - Subsection. (2) was changed to read° "Pl'ans for building alterations. The second sentence in paragraph (b) was to be modified so as to provide such reasonable, necessary information as covers the .matters in the subsections. Section- 4. 11 9 The City _,Attorney was directed to modify this specify that when buildings are rehabilitated they conform to the residential pattern. " Section 4. 11 � 2 The - City Attorney was directed to insert various uses which would be permitted without a use permit. The exact type of uses to be inserted were left to his discretion, It was further directed that the modified ordinance be presented to the Council at, least one week before the next meeting, and that a copy be given to Attorney Schwobeda. THE CITY OF PETALUMA. " read and adopted by 7 affirmative votes. Ord. Amending 1955 Plumbing Code Before introduction of the subject ordinance, discussion was held relative to cleanouts, etc. , and the following changes were made: Sec. .11 -07 (a) The words, " a and at the junction with the soil pipe at the building... were deleted. Sec. 1107 (c) - The following sentence was deleted: "The extension of house sewer cicanouts to grade is - optional. " The underlined words were added to the following sentence: "Closure shall be made with a cast iron body screw -type brass plug within six (6" inches of grade the curb properly marked, " To a question by Mr at'l Gregg,, the City Engineer stated that the subject ordinance did provide for the use of copper tubing. (7) '2 August 1, 1960 Res, Declaring Position of'Planning Commissioner Held by Wayne F Parsons Vacated Counc:ilman.Ellis requested that the subject resolution be voted,on at this time, He explained the reason for this, stating that the subject Commis- sioner had failed to attend meetings for more than ten consecutive meetings, and that this action was necessary in order to provide for the appointment of another member to the Commission, It was noted that Mr.. PARSONS VACATED, was read and adopted by 7 affirmative votes, Councilman Crinella called the Council's attention to the .fact that several people, just outside the City limits on,.Petaluma Blvd. North, had indicated that they would like to be annexed to the City of Petaluma,..
