Councilmen Crinella, Ellis, Gustafson, King, Van Bebber and Mayor Parent, Absent: Councilman Matzen. INVOCATION: Invocation was given by Reverend Fred E. Rusk, Presbyterian Church, APPROVAL OF MINUTES! Minutes from the meetings of August 15 and 25, 1960 were approved as a ecokded. PUBLIC H EAR INGS: Victor DeCarli Application to Rezone This being the time' set for public hearing on the appeal of Victor DeCatli from Planning, Commission Res. #Z3: 60, the Clerk announced that two communications had been received on the subject. The two letters were then .read. , Communication from Mr. & Mrs, Fletcher Scott dated August 20, 1960, stating their approval.of the rezoning of the DeCarli property on East Washington Street to C -1, read and filed. Letter from Mrs.... F. Ramacciotti, 626 East ''D" Street, protesting the subject ,rezdnling, read and filed. Aepdrt of City Attorney dated August 30, 1960, advising the Council as to p.r. concerning legislation on the subject rezone, submitted and filed. Report of City Planning Commission dated Sept.. 2�* 1960', setting' forth reason - s for the Commission "s action on the DeCarli rezone request, submitted and :filed' Mr, Bob Taylor, Standard Oil Co., Was"introduced by Victor DeCarli and explained his company -s reasons for desiring to lease the DeCarli property at 7,32 }East Washington Street for a station. Inasmuch as Payran Street would become an expressway, and because of the present traffic pattern on East Washingtoi Street, Standard 0i1 felt that this corner - would, make a very good site for a service station. He noted that in selecting a site, his company's decision was based on traffic patterns. The following people addressed the Council speaking in favor of the subject rezoning: Victor DeCarli, 1492 Old Adobe Road James R. Campbell, 711 East Washington St. Walter Hoffman, 155 Vallejo St. James C.. Councilmen King. and C.rinella stated that they were in favor of rezoning the - subject property as requested. He went or) 'tc say that the Council was going to set up a series of meetings with _)resentatives of the Division of Small Craft Harbors to discuss details of the report and iron out some differences. Auditors' Report on Petaluma Water Department for the period Sept, 1, 1959 to June 30, 1960, submitted and filed. Kenilworth Recreation Bldg, - Report re Acoustics Report of City Manager & Director of Public Works dated Sept, 2, 1960, rc acoustics at Kenilworth Recreation Building, submitted and filed, The report z-ecommended the installation of blackout drapes which it was felt would result consider -able improvement of the acoustic problem and also serve to darken the building for the showing of motion pictures. After discussion on the subject, it was the feeling of the Council that an acoustical engineer should be contacted in order to determine the exact solution to the problem. 1 he matter was referred to the City Manager, who was to check into the cost of such services, Councilman King suggested that the City Manager also check with the University -of California, as he believed they afforded services of this type, City Planning Commission Use Permit _ Bertha B. To a question by Councilman King, the City Attorney'answer.ed that after a motion has been made; seconded & carries to table a matter for a certain period. of time, the matter cannot be reopened during that period of time, except upon motion .of a member who voted in favor of the resolution tabling the mmattero 9 p,mo - - A recess was declared at this time: 9-.-20 p. m.- The meeting,was called back to order, Councilman King asked the City.Attorneyes opinion as to whether the action of the Council in tabling the DeCarli appeal for 120 days would auto- matically grant the appeal. . The. City Attorney stated he was - not in a ,position to give a formal opinion but that he did not believe such. would auto matically grant the app.ea1. In order that the Council. grant the applicant :"s request. it would have to adopt an ordinance, and to adopt an ordinance there must be. affirmative action by the Council, - - - Councilman Crinella requested. the , .opinion of the Council as- to whether. they would be willing to take action at the end ° of 120 - days 'on the 'DeCarli appeal if the consultants' planning report on the area had not .been received by the City at that time.' In order to determine the Council's opinion in this matter, a poll was taken in which , a "yes" vote - was mean that the 'DeCarli - appeal would.be reopened after 120 days if the planning in - that area not . been completed at that time, There were 6 affirmative votes, 1 absentee..
