To a question by Mayor Parent, the City.Attorney replied that it appears that the general practice for establishiig.plan lines, as he understood it; was by means of an ordinance .establishing, the­ authority to - set forth plan lines. The purpose for es "tablshing them is, fairly well explored and stated - in the ordinance. The ordinance would define plan lines and give the City the - authority to establish them from time to Mimeo The problem, facing; any City in establishing plali• lines' is whether or not you; are actually taking away a person's property; This depends upon the - basic reasons established in the ordinance and the purpose of the City in setting forth plan lines, He went on to explain that if the sole purpose of establishing plan lines was to widen a ,street,. there would be a question-.as ,to whether .or not is legal without immediatelygiving owners compensa- tion. If there are other reasons involved. such as to - assi! t in:.developing traffic, ways, clearanee' - fire- protection, . , . then` you have a b-etter situation° Mr, James. Butner, owner',of property -on .East-Washington ;Str;eet addressed the Council ;stating that he believed there would be no objection; to any widening in that area. The main :thingjhe property owners were interested in-was to have their property rezoned` to c.omme- rcial, - However, "Mrs Butner[•felt that widening the street to provide for as - .4 lanes of ;traffic would rather' extravagant. - He felt that it.might bebetter to eliminate onmstr"eet parking on East Washington St. to - provide .for more traffic lanes, - After further discussion on the ,subjec,t and at the request of Councilman Van.Bebber, the City-Attorney was directed to prepare a model ordinance on. . plan lines for the`Council's consideration at the- next meeting, 8055 pa ma A recess was declared at this times 9000 p, mo m The meeting was called back to order. 1 Report re Request of Shell Oil Co. for Encroachment Perm -it: City. Engineer's report dated Jan. ' 16, 19 1`9 re .Oil Cd-j' encroachment application, submitted and filed, A. The City,,.Engineer reported that the Shell Oil Co. will request that thie . Planning Commission amend their Use Permit to allow them 'to have a pump island on the right-6f-way, Other than this pump island, light standards, 'and a sign, no actual structures vill..be constructed oil -the public rightmofmwaye Mr. Roberts went on. to say" that Shell Oil had agreed to remove these facilities , as soon as the .City required use of the 'r ght�:of ®way. It was his recommendation that the nec'essar-y permits be granted, subject to the condition that they are revocable and that the applicant agrees to bear all costs of'rem val or relocation of facilities, . There were no objections to the recommendation of the City Engineer in this matter. - Water Commissio Recommendation of the City. Water Commission dated Jan. 13, 1961, re sale of Water Dept, property to 01d'Adobe School District and other items, read and.filed.' January 16, 1961 Re Municipal Swimming Pool Speaking .orr of those who had circulated petitions for the construction of a municipal swimming pool, Mr. .Dalton Dray addressed the Council requesting to know the Council's intentions in this matter. Councilman. Matzen felt that the Council should give serious' consideration. to the - request of people. However, he *could not recall' having heard any information relative to cost estimates or location of the pool° He s_u_ggested that the Recreation Commission look into the matter thoroughly 'and submit its findings to - the Council Within the next month or so. Mayor Parent remarked that he would like to see both the swimming' pool and library issues, plus what the City should do about the Washington Ste Bridge, put on the ballot.. He, requested the. R ecreation Commission work °together with members of: the staff iivorder to formulate definite plans for the swimming pool project> The City` °Mana - ger was directed to exp6dite the matter. Flood. Control. Wilson Ste Area Mr Victor DeCarli addr-'essed the Council stating.-that `he had'.�been, asked by the people on 'Wilson* 'St.. to find' out if something - .could be done now iii - regard to flood control in - that area. Councilman Van Bebber informed Mr. DeCarli that the Flood Control:,: District was- already working on this, Mayor Parent - suggested" that Mr,. DeCarli appear- before •th'e group representing_ this area on the Flood Control Board for further information.
