Street Ext. cunt ° d City' Engineer Al Roberts explained that this had come about. as the, result of a property owner requesting a building permit to construct a home at the foot, of Walnut St. Inasmuch as the area shows on the old City ,m_aps :as an extension of Walnut St. , he felt the matter should be called to the Council's attention before issuance. of the permit. He went on to say that the problem had originated a number of years back when a subdivision map had been submitted to the Public Works office and apparently was executed Without consideration being given to the fact that the lot was , of substandard depth. The City Engineer at that time apparently overlooked the fact that the lot was of substandard depth when approving - the subdivision. Members of the Counci -Lagreed 'that there was. no reason to extend Walnut Street to Cherry Street and that the requested building permit 'should therefore be granted. It was the opinion of the City Attorney that it would be best for the property owner to clarify this by means of a variance to be technically correct. However in view of the, subdivision map, he did not believe - it was absolutely essential. Inasmuch as the City had been in error in approving the subdivision, Councilman. King did not - believe it would be proper to require the property owner to :get a, variance to build on, the lot at this time. A motion was then made by Councilman Van Bebber., seconded by. Council- man Gustafson, that the subdivision -map previously filed' in the City Engineer's office is satisfactory to the Council and by accepting it the Council "is accepting the variance imposed on the subject map, with no charge to the property owner.
