SUBJECT: Request from Vice Mayor and Councilmembers to Place an Item on the Current
Agenda for Discussion and Possible Direction Regarding Placing a Charter
Amendment on the June 2018 Ballot
RECOMMENDATION
It is recommended the City Council consider the addition of this item to the agenda, and if
added, provide direction to staff, as appropriate.
BACKGROUND
Pursuant to Rule II (A)(3) of the Council's Rules, Policies and Procedures, after the draft agenda
has been approved by the City Council, and before the posting of said agenda for the City
Council meeting in which the items will be addressed, additional items shall be placed on said
agenda when the City Manager receives a request by two Councilmembers, either verbally or in
writing, that an item be added to the agenda. An item added in this manner will be addressed by
the Council if a majority of the Councilmembers present at the meeting votes to address the item.
DISCUSSION
Vice Mayor Healy, and Councilmembers Miller and King, have used Rule II (A) (3) to request
an item be added to the agenda for the February 26, 2018 meeting to discuss and provide
possible direction to staff. The request involves placing a Charter amendment on the June 2018
ballot, to select a Mayor from among councilmembers for a one -year term, replacing the current
directly - elected Mayor system; and replacing the terms "Councilman" and "Councilmen" with
" Councilmember" and "Councilmembers ", respectively.
Council's March 5, 2018 meeting provides the retraining opportunity for the Council to act to
place a measure on the June 2018 ballot.
The Council is aware the City Charter is dated. "Update the Charter" was added as a priority in
its goals for the 2017 and 2018 period. The changes proposed by the Vice Mayor and
Councilmembers are straightforward, and can readily be incorporated into any legislation you
may wish to adopt on March 5, 2018. Several opportunities for modernizing the Charter exist,
and the function of this City government could be improved with a thorough review and update
of the charter provisions. Time to do so, however, is not available before your next meeting.
If the Council elects to add this item to the agenda for discussion and entertains the request for a
Charter amendment, I would respectfully request that the Council also consider two other
changes. First, I would ask the Council to consider changing Section 59, "Annual Estimate of
City's Requirements and Revenue ", to change the date on which the tentative budget must be
submitted to the City Council from the first Monday in May to the first Monday in June. Second,
I would ask the Council to consider changing Section 68 "Public Works and Purchases to be
Done and Made by Contract" to allow for design -build contracts for City projects. The benefits
of these changes can be discussed at the February 26, 2018 meeting, should you choose to add
this item to the agenda
