To .a question by Councilman Colin, the City Attorney answered that the
City was not obligated to act as the bol'lection agent in cases such as"this
could do so, if it wished too
Councilman' Colin stated. that he did riot like the idea of the City acting:
as the collection agent -in'matters of'this type He felt tha # a definite policy
should be adopted by'the Council in order that' all such cases arising in the future
could be handled iii a uniform manner°_,
'Assistant City" Engineer john Stratford stated that he was 'not too familiar
with some of 'the circumstances involved in this matter_. For instances he believed
that one 'of 'the three lots that could be serviced by the subject line WaA°s ai'r eady
connected into another line-
The matter was referred `to the staff for further information and recom
mendation to the Couneila

The City Clerk was directed to draft a reply to Miss Studdert °s letter,
enclosing copies of.Mr Byers, letter to the Council and the Mayors open letter
in answer to Mr o Byers:' letter, - and I tha "t the Council believed `these '
letters might answer some of 'her. questions. If Miss. Studdert. ha,d any f urtl;er
questions on the subject,' Mayor'Matzen stated that she could contact'him
personally and he would be happy to help hero

Councilman Colin q uestioned claims #1024 and #1025; regarding additional
work which was done on. Oak Terrace in connection with Assessment Dist #5
N S, He wondered if,. in paying these: bills,r the Council was acceptiing all of
the work done Mr ; Stratford assured tiim that this was not the cas e and,
explained thafthere was still work that, would have .to, be done on Oak Tr .:before
it would be accepted, Councilman :Colin then stated that as long _as 'the work
"already done had'been authorized b the Dept. of Public Works he had no
objection to the payment'of the subject claims Councilman Crinella suggested
that provisions be made so that when such additional work was necessary, a

amount would be agreed upon for pay 'big of such work However,. the
Ass tant City Engineer felt that in a case where the contractor would have to
set ,a fixed price on the work, this price would be set quite High; '
Answering a questiori Councilman King conceYning claim #1,023 the'
City.Attorney stated tha he had been informed by the Title Company that this
amount would, be credited on the title insurance policy "on the 1VlcN ear- prop erty,
inasmuch as the condemnation proceedings had ten dropped.
