Present: Councilmen Colin, Crinella,. Ellis, Gustafson, Solomon, Van Bebber and Mayor Matzen, Absent: None, INVOCATION ;.Invocation was given by Reverend Fred Eo - Rusk, .First Presbyterian Church, APPROVAL OF MINUTES. 1 Minutes from the meeting of Sept. 4, 1962 were approved as recorded. G 1 Zoning M ap - This: being the time set for hearing of protests and comments relative to the proposed n6w zoning ordinance, the affidavit of..publication of the notice of public hear-ii-ig watts submitted and filed by the City Clerk.- Resolution of City Planning Commission approving zoning map, submitted r and filed, .Letter from C. Fred Momsen & Marjorie L. Momseh dated Sept. 6, 1962, protesting proposed zoning for Western Ave, and particularly regarding their lot at corner- of :Fair St. & Western Ave. , read and filed, Letter from Philip L,, Joerger dated Sept, 13, 1962, protesting City .Planning. Commission °s recommendation for the zoning of his property at Denman Flat, .read.,and filed, Notice re telephone request of Harold Cutler ;received on Septa 17, 1962, asking that 35 acres of the land belonging to the Was Square Shopping Center be zoned commercial and that adjacent land'be zoned R -3, submitted and filed. Mrs. fl. Jo ;Scott, 326 English St. , addressed the Council protesting the p'ropo.sed zoning of her property, lying between Fair & Baker Sts., from R -3 to R -2a It was noted that this matter had not been brought before the Planning Commission. Planning Director Bob Byrd stated that there wa:s a predominance of R-1 use ,in this" immediate area. However, he believed it would be in order to develop an.R -3 zone there encompassing` a large area, due to proximity of the land to the Creamery and considering the proposed -R -3 development adjacent to Mrs. Scott's property. The; Council agreed that the proposed zoning ordinance should be changed in accordance with the suggestion of the Planning Director; Mrs.. :Blanche Bundesen, owner of property on Sixth Street, between "A" and; 'v'B "' :Streets, addressed-the Council requesting that her property remain R -3 rather. °than `being changed to R -2 - .as proposed in the new zoning ordinance. Mr. .,Byrd did not believe this request should be granted. He pointed out that, the-predominant land use in the immediate area was R -1 and R -2 and. informed Mrs. Bu ndesen that her property was in a transitional zone whereby it could be, used for R -3 purposes by obtaining a use permit for same, He assured her that to the best of his knowledge, there was no reason why she could not develop` the apartment house she planned for her property with the zoning proposed h. in the: new zoning ordinance. Being in the real estate business, he was very aware.of the need for good zoning, etc, Mr. Harry Trayer requested -that his lot on Edith Street not be .changed from R-3 to R-1. He felt that this case was similar'to that of Mrs.. Bundese.n's property. 'Councilmen Crinefla, and Solomon felt that M. Trayer's lot,!should remain" R-1 After considerable discussion on the subject, and before call on the .resolution approving, the zoning map,, a poll was taken to determind wheth'ex thi property should. remain R - 3. There were 2 affirmative vot-es,.in, f avor " o.f the lot remaining -R-3. as shown on the old zoning ordinance and 5 negative, votesa - There- fore, - *no change-was to be-made on the proposed zoning map in connection With this parcel of -land'. Mr. Byrd went on. tell of the -traffic problems which already existed in- the area during peak traffic hours etc. Councilman Crinella, expressed the opinion" that the subject 'property should be zoned, commercial, There was 'discussion during which it was noted -,that it . would -be ,possible for commercial ' , development to take place on -Mrs'. NoVak' property;, due to the flexibility of the proposed, Zoning ordinance. Mr. : Stephensen"s, request for commercial zonin was not granted. (Q-o nt "d) 2 r Sept. 17, 1962 Zonn& Map Hearing - cont °d To a .question by Mr o Harry Trager relative to the use of the rear 40' of his lot,.on Edith Street —,iMro .Knox answered that he could not use these additional 40 feet `of the lot's depth in figuring: the total area to. determine the number of units; to be put on the property. Answering a question by Mr. .Howard Heggum, the City Planning Director explained the purpose of an R -1 10,,000 zone; stating that in.certain cases, land could be zoned R-1 10, 000 and remain as such. Philip Joerger protest to the �propos'ed zoizing - map, After considering the matter thoroughly, it was the decision of the Council that Mr. Joerger°s property and Mr. .Morehead's property sho.uld'ea -ch have a 200 strip of commercial as set forth in the new zoning-map. Mr. .Morehead stated that he felt this arrangement was a fair one, It, was pointed out that when any of the properties at the Denman interchange were ready to develop, plaizs.could be submitted and the property could be zoned accordi at that time, Mr. Byrd. explained the flexibility of the proposed „..,zondng as applied to the commercial zoning of areas such as this, There was discussion regarding the-PM zoning on,Fourth Street, After ' consideration and at the suggestion of the Planning Director, it was the r : decisio l of the Council. to change that portion of the PM zone extending toward the j so;uth from "B" Street to central commercial. That portion that extends back toward the R -,2 zone in a westerly direction was to remain' as PM. The Planning Director was directed to amend the proposed zoning map to concur with the foregoing changes as made by the Council. Said resolutions were to be presented at the next meeting, Re Acceptance of Bantam Way by City Report of Dir. of .Public Works dated Sept 17, 1962, informing Council that the Petaluma School, Board has requested that Bantam Way be accepted by the City, submitted and filed. The City Attorney was directed to prepare the necessary legislation for acceptance of the subject street for. the Council's consideration at the next meeting.
