Regular meeting of the Council of the City of .Petaluma called to order by Mayor Matzen.,, ROLL CALL: Present: Councilmen Colin, Gustafson, Solomon, Van Bebber and Mayor Matzen, Absent: Councilmen Crinella and Ellis. INVOCA TION 1n the absence of Reverend Scrimgour, an invocation prepared for a previous meeting was read by Mayor Matzen, APPROVAL OF' MINUTES: Minutes from the meetings of Oct. 15 and' 16, 1962, were approved as recorded. -' CONSIDERATION OF BIDS: '1 New 1963 Auto - Police Dept. - (Report on Bid Opening of Nov. 1) The :Clerk reported that bids ,had been received from Price Roche Motors 'and Sanderson Motor Co. , the low bid being that of Sanderson Motor Company. (Councilman Ellis entered the Council Chamber. The time was approxi- mately 7o40:p. m. ) A resolution awarding the contract to Sanderson Motor Co. was then adopted. Res. #3080 N. Maestro, submitted and. filed, Re Sarkesian Request for Annexation Councilman Colin reported that together with members of the staff, he had met With�Mr. Sarkesian to discuss the problem s.- concerning his subdivision;; As. he understood, Mr, Sarkesian had now' agreed to start hi development at the - McDowell end of his property as suggested -by members of the City: staff, City Planning Director Bob By-rd advised the - Council as to why it would -be' all but impossible from an engineering standpoint to start development. of the property as originally proposed_ by Mr,. Sarkesian, It was explained that McDowell Blvd. would have to be graded down .to the level of the prope_rty,. Councilman Colin stated that he had talked With Mar. Crinella, who owned the property on the other side of McDowell Blvd.,, and had z been assured that he would be willing to pay for his share of this pproject. The committee report on this' matter,, which recommended that Mr. Sarkesian start his development at the McDowell end of his property, was accepted by the Council. Co So introduced by Councilma Solomon, seconded by Councilman Colin, approving claims and bills (Nos 1479 to 1544 inclusive and Nos. 1070 to 11,73 inclus' ve),, wa -s read and adopted by 6 affirmative votes, *1 absentee. 1 Report oil Annual Audit L Report of City Manager dated Novo 2,. 1962, re audit recommendatiohs the fiscal year ending June 30, 1962, read and filed, Mr; Meyer went over his report out the audit recomrnendal.tions which were already being .put into effect, etc. He noted that he agreed' with , the -auditors' recommendation that certain funds be abolished and rn.aklitained as- reserve accounts:_under the General Fund, However', he did not agree that this- should , be done. in the case of the In Lieu Tax Fund as had been recommended.. A motion was then made .by Councilman'Gustafson seconded .by Council- man Van Bebber, that the report of the City Manager be accepted. The.'motion carried by 6 affirmative votes, 1 absentee. 'The City Attorney was directed to prepare the :necessary legislation to abolish the funds as recommeded by the auditors, with the exception of the In Lieu Tax Fund. Communication from City Treasurer Albert Overton dated Nov. 'Z 1962 , recommending that the otuncil adopt a resolution requi.riiig two signatur..es on theactive- a- nd_inactive accounts which were now on deposit with the 'Crocker .Bank and. Which required only Mr`..Overton°'s signature,,. read and filed. Mr. Overton further recommended that.John Scharer be named as Assistant City Treasurer :to act in the capacity of Treasurer during his absence. Cities dated Oct., 31, 1962, commending City Attorey Ed Robert on his excellent paper delivered at the recent Annual Conference in Los Angeles, read and filed, Letter from Allen Grimes, City Attorney for Modesto, commending City Attorney `Ed. Robert on his presentation on the subject of "California's New 'Right to Organize' Statute" at the recent conference of the League of Calif.,, Cities, read and filed., Councilman Gustafson felt that all the City staff members who, had attended the conference `had worked hard and had obtained much valuable information, A letter dated Oct. 26, 1962 signed by Lucile Moffa and addressed to the Petaluma Fire Dept., was read by Mr. Meyer. Mrs. Moffa expressed her gratitude to the .Fire Dept. for its prompt and kind service rendered her husband on,Oct. 20, -19620 City Planning Com. m.i.ssion Use Permit - Mrs, Co Olse Res. U38-62 - granting Use Permit to Mrs, C,• Olsen to conduct home for foster ch at 505 Adrienne Dr -ive, submitted and .filed.. Director of Public Works Drainage Problem - D. J. Deevy, Copelan S treet Report of Dir. of Public Works dated Oct. .26, 1962, recommending that some plant mix be put in the .gutter and driveway area in front of :Mrs Deevy's business. on Copeland Street in order to solve his drainage problem, read and filed. The above report was approved by the Council 9 and the -Diro of Public Works was dir.ected proceed - as recommended by him. Linda Del Mar Subda #1 .Report of Dir. of Public Works dated Nov.'- 2, 1962, re meeting with representatives of bonding company re embankment protection failures subdi- vision, read aid filed, The report noted that they had apparently determined the cause of the -failures and would ;start planning for corrective measures,. Mre Scott believed he would probably -receive some kind of report or proposal on this matter within a couple of weeks. 'of Public Works dated Novo 5, 1962, re application of George Perry for 2 outside sewer connections, read and filed. The report pointed out that Mro Perry had recently sold his -trailer court and. that the 2 connections desired woul`d'be adjacent to the trailer court, One connection was for an office trailer afzd_',o for a house trailer. "Perhaps the City Attorney and City Planner should investigate this matter; especially in 'regard to another agreement, future annexation, zoning, etc° City Attorney Ed - Robert stated that these applications actually we=re neither for a trailer court nor a house as defined in the sewer ordinance, He explained that one of the trailers to be connected would be used by the manager of the trailer court and the other trailer would be used by the caretaker. , It was the decision of the Council to refer this matter to the staff for further investigation and discussion with Mr. Perry. Vallejo Street, Extension Dir.. of: Works' report dated Oct. 2 1962, re possible solutions to . the access and drainage problems of the Nati=onal Guard Armory, submitted,'and. filed, Mr. Scott stated that the cost of paving Val-ljeo Street, Jefferson $,to to end of Armory, would be about $5, 8,00. 00, Extending Vallejo Ste to East Court, would run about $4, 000.. 00 plus possible land acquisition costs. Manager. Councilm-'an' Van 'Bebber also objected to the provisions of Section.. 27. 1.7. 1, page 6 which read: "The above formula shall apply in those instances when the - _ Manager determines that both sides of a street will receive.benefit, for the main extension proposed to be constructed, In the event that the Manager determines that one side.:of t h e , street only will be bea e- fited by .the main extension, the applicant desiring a connection. with' the water system shall pay a :frontage connection charge in an amount calculated as "A" in accordance with the foll:owin�_r formula:" - 4 - (coat /,may: November 5, 1962 Ord. Gity Code re Water Main Extensions, etc. cont'd There wa's considerable disc,u.s.sion on the subject; during which it was explained by the -City Attorney and - Dir. of the Water Dept; that if this section were left out of the ordinance, it would be - possible' for' the City to end up paying for half: of the main construction costs, A motion wa.s made 'by Councilman Colin, seconded by Councilman Ellis, that the above mentioned section, remain in the ordinance, The motion carried by the following vote: Ayes: Councilmen Colin, Ellis Gustafson, Solomon and Mayor Matzen. Noes.: Councilman Van ,Bebber.. Absent: Councilman 'Crinellao. .Relative to the use of the word, "Manager" throughout the ordinance, the City Attorney explained that this: had.been done in order to conform with other water ordinances which were already a part of the City Code, and in which the same term had been used, After some discussion on the subjec t, a motion was made by Councilman Gustafson, seconded by Councilman Ellis, that -the word "Manager" be left in the ordinance. The motion carried by the following vote Ayes: Councilmen Colin, Ellis, Gustafson, Solomon and Mayor Matzen. Noes: Councilman. Van Bebber. Absent: Councilman Crinella. Mayor Matzen asked that, a study session of the Council and members of the Library Board beheld as soon as possible in order to ;review the library-' bond project. He also asked that the City Attorney be present at th;is..meeting. This message was to be conveyed to the Library. Board. Mr.. Meyer at this time requested that as many Councilmen as possible - attend the meeting to be held on November 1.4, in connection with the proposed sewer assessment district in the Sunnyslope area November '26th; was 'the date set fora .joint meeting of.'ahe Petaluma - School Board and the ��o .. uncil. Mr.. Carl Peterson, owner of property at 8 -15 E. , Washington St. addressed . the Council. regardingsidewalk repairs in front of '.his .property., This matter was referred to the -City E' ngineer... .. . F, .Mobert, '5 "1 E, .Wash ngto.n St , addressed the Council. stating that most of the sidewalk in need of repair',at his address; had been darriaged by the'equiprnent of the IVI, Amaral Construct "ion Co. Therefore, Mra'�Mobert did not feel that he -should. have. to bear the expense of repairing same,, The City Attorney :advised Mr Mobert of the .law which states, in' effect, that the property owner is responsible for the care and upkeep of the , sidewalk. Mr, Robert'-went onto say that Mr. Mobert could . seek payment from art the' who p y had damaged the sidewalk, but this matter would not be the -responsibility of the City.
