Regular meeting of the Council of the City of Petaluma called to order by Mayor Matzen, ROLL' CAL Present. Councilmen Colin Crinella, Ellis, Gustafson, Solomon, Van Bebber and Mayor Matzen, - Absent. None, INVOCATION Invocation was given by Reverend Godfrey Hartzel, Stu .John's Episcopal Church. APPRO,VAL,OF MINUTE Minutes from the meeting of November 5, 1962, were approved as recorded. CONSIDERATION OF .BIDS. ,. 19,62 Water Main Construction & Replacement Report of bid opening of Nov. .13, 19629 recommendation of Water Commission dated Nov 19, 1962, that contract be awarded to low bidder, Kirkwood -Bly, Inc. , read and filed;; whereupon, Res. #3094 No Co So introduced "by Councilman Colin, seconded by Councilman Solomon, entitled, , ?!RESOLUTION AWARDING CONTRACT IN.ACCORDANCE WITH THE `PLANS AND SPECIFICATIONS ENTITLED, ' 1962--63 _ MAIN CONSTRUCTION AND REPLACEMENT PRO - QRAM, PROJECT NO, 622'. " was read and adopted by 7 affirmative votes. PETITIONS & COMMUNICATIONS. Th following copies of .applications filed with ABC re transfer of liquor licenses and approved by Chief of Police Del Maestro, were submitted and filed. Pinky's Pizza Parlor, 321 Petaluma Blvd. South; Buford's Distribution,- 100 Poultry Street; and To and Co Grocery, 307 "F" Street, Letter from City of Long Beach dated Nov, 9, 1962, enclosing copy of resolution adopted by them, opposing legislation permitting use of partisan political labels by municipal candidates, read and filed, Ther City Clerk was directed to send copies of the enclosed resolution to members of the Council. REPORTS OF CITY OFFICIALS City Claims approved for payment by the City Manager were .submitted and filed; whereupon -; Res. #3095 N. C. S introduced,.by Councilman Solomon., seconded by Councilman Colin, approving claims and' bills No's, 1551 to 1619 inclusive and Nos. 1175 to 1207 inclusive, was read and adopted by 7 affirmative votes, - 1- - November 19, 1962 George Perry - Application for Outside Sew Report of City-Manager dated Novo 1.6, 1962, , re application of George -Perry for outside sewer- connections, submitted and filed, A portion of the report read as follows° "o 0 0 0 0 0 o the City Attorney -has conferred with Mr. Perry and advised him that his proposed use of two trailers was not a trailer court categc ry,., and that his proposed use required two separate charges under Section 190 17 of the Code, One trailer; to be lived ; iii by a caretaker, should be treated as a dwe The' other trailer, to be used as an office,, is a separate commercial estabrishment, Total fees then would be , $620 50 every six months,," The City Attorney explained that, in his opinim , one pf the proposed connections should b treated as a. trailer and the other .as a soparate; dem:6rcla;l establishment In accordance with the City.Code Mr. Perry addressed the Counell stating that he believed the fee bei_l g quoted was too high He -went on to .say that, rather than pay such, a fee, he would make arrangements :for one of the trailers to be placed in the existing trailer court, If one of'the trailers were placed in the trailer court, Mr. . Roberr stated that a $5. 00 fee -for that connection would then merely be added to the, trailer court °s ,present fees , .. -. ,,,,, There was discussion relative to the Council`.s reconsidering this rna ;hero However, some members of the Council :felt that if they did not abide by the City Attorney °s opinion, a poor precedent would be -set, A motion was. then made by Councilman Ellis, seconded by Counc:ilmaiz Colin, that the Council accept the recommendation of the City Attorney regarding Mr. Terry's outside sewer connections. The motion carried by 7 affirmative votes Street Excavations r, . City M. ana Robert Meyer asked that the Council. consider establishing a new policy dealing with street excavations. He explained that presentlyy; the. "person who actually makeo the street excavation is responsible -for refilling same -,and, must stand behind his work for a period of 2 .years by mea=ns of a cash, deposit or a faithful performance bond° Mr. Meyer went on to explain why this system. had. not worked out. too satisfactorily and suggested several other methods for the Council 's consideration° One of The :suggested methods was for the City -to do, the. resurfacing work on' street excavations aild charge the contractor, based on the amount this :would cost the City, The City Manager was directed to work out a fee schedule on the Above - suggested method for the Council's consideration, Mro .Meyer noted that there were some other changes he would like to. suggest in the excavation ordinance also, Sidewalk Repairs ,& Excavations Mro .Meyer was of the opinion that the City should not 'involve itself with the 2 -year responsibility on sidewalk. excavations., inasmuch as :sidewalks, were actually the responsibility of the property owners. . Councilman 'Gustafson asked that the repair notices being sent - to property owners be changed.to allow more than 2 weeks in which to make these , ,repairs. If the City actually did not enforce .this time limit, he .felt that it should.. be changed so'that_the`property owners would i ota= become alarmed. ,Mro Meyer stated that he could check the °ordinance in regard to the time involved. However, he felt that if the property owners could not have the °work done within the 2 -week period of time, they should contact the City. A -s I long . the City was aware of -this and realized that the property owner did intend to: have ,the work done, the City would not step. in and have the - repairs made, ; Mr. .Meyer reminded the Council of the joint meeting to be held .with the Library Board next Monday and the joint meeting with the School Board. on Tuesday, November 27, -2- ._v November 19, 1962 Mayon Matzen at this time commended those. City employees who had recently recef.ved their diplomas from the in-service training courses. Council Committees Boat Harbor .'Councilman Vail Bebber reported on the recent Boat Harbor meeting which .was held =at``the Old Adobe Room, stating that so far, everything appeared to be progressing according to schedule, However, he had been disturbed by a letter received from the State Harbor Commission in which there -had been considerable difference from what the City had desired, Mr. .Meyer stated that he had contacted the State regarding the Boat Harbor meeting in San Diego today, and had expressed the Committee disappointment in connection with the misunderstanding. He had suggested that they come to Petalura for discussion on this matter, and they had agreed to do so. Mr. Meyer had also informed them that the City would probably tape the meeting, Letter from UD .S, Corps of Engineers dated Oct, 25, 1962, requesting statement from City, preferably in the form of a resolution, relative to the City's legal authority, financial capability and willingness to cooperate and participate in 7 items: listed on enclosed information sheet, read and filed. It was the decision of the Council to have the City Attorney prepare a resolution as requested, incorporating the 7 items listed by the Corps of Engineers, as this was necessary in order to secure the Federal grant, Letter from Morgan Noble dated Nov.. 1, 19 6.2, re engineering for the Petaluma Boat Harbor and fees concerning same, submitted and filed. After discussion on the subject, it was decided'that-the contract between the City and Mr,. Nobel should be _reviewed by the City Attorney and the Council, Member-,s of the Council were to be sent copies of that portion of the contract pertaining to, work which would be consideredcas a part of the contract and work for which additional fees would be charged in connection with the present: situation, to City Plannirig' Comm ission S Use Permits ' Res. U39-62 - re. -issue of U41-61 to Co Jo Ruegge, 527 E. Wash. St. , to construct building for wholesale or retail sales of auto parts, submitted and filed, Res.. U40 -62 - granting permit to Clinton Garrett to sell Christmas trees, 433 E.: Wash, St., submitted and filed. Re8� U-41 -62 - granting.permit to Robert Sylva to operate beauty shop at 223 Keitucky'St> , submitted and filed. Variance - C. J. Jo Ruegge Res,, V10 - - re -issue of Variance to Co Jo Ruegge to allow 0" rear yard instead of 5° at 527 E. Wash, St. , submitted and filed; whereupon, Res, #3096 No C. Se introduced by Councilman Colin, 'seconded by Councilman Ellis, entitled, "RESOLUTION GRANTINO-APPLICATION OF C. Jo RUEGGE FOR A VARIANCE FROM THE REQUIREMENTS OF ZONING ORDI- - NANCE NO. 340 Na Co So " was adopted by 7 affirmative votes. 3 . 7 Water - Commission Termination of Well Leases & .Bids o n Well Pumps Recommendation of Water Commission dated Novo 16, 1962, that, City. accept bids submitted .on leased well equipment from owners of wells.and that the staff be authorized to negotiate with a private contractor for the removal of the pumping facilities that are not being purchased by the owners, submitted and ' filed. Water Dept. Director Dave Young told the Council that after completiQh of the subject report, Mr, - Perry had also submitted a bid for $695.. 00 for the ; pump at the well on his property, Answering a question by Councilman Van Bebber., Mr. Young stated that bids received were not only fair,.. but the- best they could get. A motion was made by Councilman Gustafson, seconded by Councilman Colin, that the Council accept these bids, The motion carried by 7 affirmative votes. Partitions &.Lighting in Basement of C ity Hall Recommendation of Water Commission dated, Novo 19, 1.962, that an appropriation of up to. $1200 be made for partitioning the large basement 'ro.om of.. the City Hall into 3 rooms for: (1) Water Dept. office; (2) secretary- recept`'oi room; and, (3) machine. room for general City use, submitted and filed Following a brief review of the subject proposal by the Water Dept, Director, a motion was made by Councilman Van Bebber and seconded by Councilman Colin,, that the recommendation of the Water .Commission be accepted. Due to the wording of the subject ordinance, if either, ofthese: people extended, the water main, the. other would be able �to book into it for noth.ing , resulted . from the ,fact that a water main.was in existence but: was too small to serve the needs of these people.' Van Bebber suggested that this problem could be solved by charging a connection fee to any property which had -never been served water before, regardless of whether or not a water main existed in front of said property, Mayor Matzen- agreed with the suggestion of Councilman Van Bebber. He pointed out that under the ownership of the Calif. Water Service Co. , the owner of a vacant lot would never have paid his share of a water main fronting that lot, as this cost could only have been reflected in a charge for water service. Councilman Colin stated. that he would definitely be against any connection charge for a.-property having an existing water main in front of it, After further discussion relative to having a study session on the subject, etc, a motion was made by - Councilman Van Bebber; seconded by Councilman Crinella that Ordinance #668 NCS be tabled, The motion carried by the following vote. Ayes: Councilmen Crinella, Solomon, Van Bebber and Mayor Matzen. Noes: Councilmen Colin, Ellis and G'ustafson.
