(coat d) - I - February 4, 1963 Applo of De Stoneburner for Use Permit to Operate Livestock Auction Yard, m coat'd Report of Odor Problem Committee dated Feb. 4, 1963, stating that .after studying the odor problem of the City Sewage Disposal Plant, it had been determined that there were several products on the market which would eliminate odors, read and filed, The, report went on to list some of the firms from which detailed information on the -subject could be obtained. Another- report submitted by -the Odor Problem Committee and dated Feb. 4, 1963, recommended that .Mr. Stoneburner's application°for a use permit be withheld until further study of the General Plan could be made in the entire Lakeville area, A petition containing 16 signatures of property owners in the Lakeville area,was :read and filed. The petition set forth the .following requests: (1) A study of the -land use of the area between the Petaluma River. & McDowell Blvd. be made .by the Sonoma County Planning :Commission. (2) The Zoning Ordinance be .reworded, requiring stricter performance standards in the subject area,. (3) Use permits pertaining to the area be, -held in abeyance for 120 days so that a satisfactory ;study might be completed, Mr. V. K. Rosager, Chairman of the .Odor Problem Committee, stated that the xes'idents of the -Lakeville area had not realized that auction :yards, stock yards, etc° , would be allowed in a heavy industrial zone. Also, they did not feel that such industries should be located near the -proposed ,Boat-Harbor site, ..Mro . Rosager :noted. that none of the people who had signed the above mentioned petition were .residents of the City_ o .Mr. Bob Christian, Jo Do• Christian Engineers, 1000 Lakeville Highway addressed the Council stating that although he was not a resident of the City, many of his employees were, He expressed the opinion that people coming up the Petaluma River in their boats, should be greeted by light, clean, modern industry,' rather than "cow dung ". City Planning Commissioner Dick Lieb addressed the Council giving, his views on the subject problem as a citizen, rather than a member- of the Planning Commission. He believed that if Mro Stoneburner's application for use permit should be granted., it would be a matter of an agricultural use .infringing on .a heavy industrial zone inasmuch as he considered an auction yard as strictly more of an agricultural 'use. than a heavy iiidustr•ial use. .Mr... Li'eb suggested that a study .be made to, perhaps, consider some kind of zoning which would protect the agricultural people in the County from industry and residential area infringing on them, He believed this same problem would also be encountered in other areas in the future. Mayor Matzen stated that since the last meeting, he had talked with Mr. Elmer Scott and had learned that •Petaluma's odor problems were similar ;to those exp.er'enced by Los Angeles, According to an article Mr. Scott, had recently read in Western Dairy Magazine, Los Angeles had apparently solved the problem of odors, contamination and flies, particularly in connection with the operation of fertilizer plants. The Mayor felt that it might be well to send, a delegation. to Los Angeles to investigate this matter, He did not believe the Council sliould' make any recommendation to the County on the •Stoneburner use permit. until the Odor..Problem. Committee had made its study, A resolution before the Council supporting the .Planning Commission's recommendations relative to the S.toneburner u •permit. application_, was -read at this ,time. -After further discussion on the matter a motion was made by Councilman -Van Bebber, seconded by Councilman Ellis, that the subject resolution be tabled. Stoneburner for Use Permit to Operate Livestock Auction Yar - cont'd A motion was then made by Councilman Gustafson, seconded by Council- man So'lomoiz, that the- Odor Committee's report be accepted and that the County be requested to postpone action on all use permit applications in the subject area .for a period of 120 days, to allow time for the Committee! to thoroughly investigate the matter. It was, directed that a letter be sent to the County, telling of the action taken by the Council, A copy of the City Planning Commission's recommendation on the Stoneburner use permit application was to be - forwarded to the County Planning Commission, along with the petition which had been submitted earlier in the meeting, TheBoy Scouts in the audience were welcomed by Mayor Matzen and extended best wishes during Boy Scout Week.- . The Mayor then reminded the Council that next'Friday would be Boy Scout Government Day. 8°;30 p..mo . ® Councilman Solomon was excused from the meeting and a 10 minutel recess was called by.Mayor Matzen. The meeting was called back to,order at ; &-.40 p m A proclamA -tion on Boy Scout Week was read by the Mayor at this time and handed to Mr. - John Sullivan, Boy Scout District Representative. Recr eation, Parks Commission Report on Mosquito Abatement Program Parks Superintendent Dick Shollenberger pointed out to the Council the mosquito infested areas lying outside the City, noting that the marsh' just across the River, was the worst spot. Mr. Shollenberger then went over some datal on mosquito abatement programs dating back to 195'9, which he believed indicated that it was necessary to spray the infested areas outside 'the City in order , to .proper'ly�'coiitrol this problem. Mr.:Shollenberger. :went ,on to, explain, that his department was now using a chemical.for spraying which had been approved by the State Dept., of Health as to the safety of its use in areas where plants, animals and other agricultural products exist, Two forms were submitted to the Council for its...considerationo It was explained ,that these forms would be sent to the ,proper,ty owners in the infested areas , ;outsi'd`e .the..City if the Council approved. 'The letter proposed to.be sent would .tell of the work the City would do and .the other form would be used to secure permission from the property owner to enter his property and do this work, City Mana ger Robert Meyer recommended that the Council . approve this Method. of mosquito abatement for infested areas outside the -City, as long as the property owner's permission. was received a the spray to be used been approved. -by the State "Dept, of Health. The Supt. of Parks & Recreation was then directed to submit to 'the Council a list of the - 'property owners involved. Recreation Commissioner Dalton Dray suggested that the Council consider formation . of a mosquito 'district to include just the City of Petaluma.' ' He was of the' understanding that the City, 'by forming such a district, could then go out.side the City limits ao control mosquitoes. The City Attorney, however,' did not. believe this would be possible. After'fu-rther discussion on' the subject, the City Attorney'was directed to determine" just how far the City could go in the control of mosquitoes. if a. district were formed' within the City limits. , A" motion was made by Councilman "Ian Bebber, seconded by Councilman Criiiella, that the Commission's recommendations regarding 'mosquito abatement in the outlying areas be approved. Gustafson answered that he believed the County had filled i11 some of the bad spots on Petaluma Blvd.. South which had resulted from the installation of the Petaluma aqueduct,: The City Manager and City Engineer were then directed to determine ;if any further work Mould be done by the County. ADOPTION OF ORDINANCES. #671 NCS Contract for Chemical. Weed Abatement Councilman Colin asked if the company which would now handle weed abatement in the City would take care of the weeds growing in the back yard of a residence. Approving Mutual Aid Agreement (Civil Defense Before voting on this resolution, Cou cilman Van Bebber stated that he would like to ascertain if this program would evolve into one that would require most of one employee's time to handle. Authorizing City Attorney to Take Legal Action =re Com] of Public Improvements in Linda del Mar Subdo Res, #3141 N Co Se introduced by Councilman Solomon, seconded by Councilman Ellis, entitled, "RESOLUTION AUTHORIZING THE CITY ATTORNEY TO TAKE ;LEGAL ACTION IN THE MATTER OF THE COMPLETION OF PUBLIC IMPROVEMENTS IN THE LINDA DEL MAR SUBDIVISION, read ,and',adopted by 6 affirmative votes, 1 absentee, Discussion re Sunnyslope­'' Ste Annexation ° Sewer. Assess Dist The 'City Engineer's proposed boundaries for an annexation in the subject area were pointed out to the Council. City Engineer Don Scott noted that these boundaries were basically the same as those already proposed for the sewer assessment district and' contained 186 acres. Mn Meyer pointed out that one of the decisions which would .have to be - made by the Council would be whether they wished to have the area annexed before any sewer assessment district was formed. There were no objections to this line of procedure, the Council being in unanimous agreement that the annexation should come first, For the information of those people in the audience, Councilman Van Bebber explained why the Council felt it would be best for all involved to proceed with the anizexa.tion, prior to the formation of the assessment district, City Attorney Ed Robert briefly went over-the necessary steps. to betaken for annexation, stating that the first step would have to be a move by someone in the area to circulate a petition for annexation, As many of the people in the subject, area were wondering whether they would be able to keep their horses, cows, etc. after annexation to the City, Mr. Robert pointed out that their animals could be kept unless they became a nuisance to their neighbors. Property owners in the area who addressed the Council on the subject were; Mr. Cliff Asbell, 216 Sunnyslope Avenue Mrs. E. Gerrits, 625 Sunnyslope Avenue -Mrs. 'Lauri Loftus, '501 Sunnyslope Avenue After further discussion, the City Attorney and. other members of the. staff were .:directed to work with the people in the area in order to take the. necessary steps in circulating petitions for annexation, Xt the' request - of the City Planning Director, a.nd.'in order to expedite the annexation proceedings, the Council unanimously, agreed to allow any petitions received for annexation of the subject area to go straight to the Planning Commission. Mro ; Meyer at this time asked that as many Councilmen as possible attend the luncheon and Council meeting for the Boy Scouts next Friday, Odor Problem Councilman Ellis stated that Supervisor Shoemaker had suggested he go to ' Los Angeles and make a preliminary study of the fertilizer plants in that area and.find out how they had solved their problems. If this survey was favorable, S'upe'rvisor ';Shoemaker had stated that he would then like to go to Los Angeles With the County Engineer,, another Councilman and the City Manager to"fur'ther,. check into he matter° There being no objections to this, the Mayor then designated Councilman. Council. .,, m 5 m - February 4, 1963 North Petaluma Annexation #4 Councilman Van Bebber stated that he was quite concerned about the. length of tirne it was taking to process the subject annexation and asked to know the. present status of -same, The City Manager assured him that if everything proceeded as expected legislation regarding the call for the public :hearing would be .before the Council at the meeting of February 18th. To a question by Councilman Colin in connection with flood controt, drainage ditch in the :Lakeville area, the City Manager answorod that he was keeping the County aware .of this matter. Also, he bad talked with Mr`. Scott today and he had Mated that 'he would have - a report for the Council as soon as `' possible.
