INVOCATION°. , Invocation was given by Reverend Fred F. Rusk, First Presbyterian Church. . APPROVAL OF MINUTES Minutes from the meeting of May 6, 1963, were approved as recorded. . PETITIONS & COM MUNICATIONS- . Letter dated May 8 1963 from William Sovel, on behalf of the' Poultry Industry expressing appreciation for Council's co-operation in helping to obtain passage of Senate Bill #157, read and filed. Resolution adopted by Grand, Lodge Dania dated May 6, 1963, expressing thanks to Mayor Matzen for services rendered in connection with their annual convention held in Petaluma, read and filed. Letter from Petaluma Chamber of Commerce dated May 9, 1963, encouraging Council to seek convention bids and offering Chamber's assistance on same, read and filed, Councilman 'Colin felt that much more could have been done by both the City and,the Chamber *of Commerce in welcoming members of the Danish Lodges during, their recent convention in Petaluma, He suggested that this might: be accomplished by the use of posters, banners, etc, Councilman Van Bebber pointed out that the amount allocated to the Chamber of Commerce for conventions was quite small. He therefore believed thiv� s a.s fin deitely a matter to be given further consideration by both the City and Chamber. So Coast Guard dated May 14, 1963, re recommendations for new; aids to navigation to better mark the Petaluma River Channel, read and fi'l'ed, Copy of resolution adopted by Santa Rosa. Chamber of Commerce and dire.cted,;to .B.oa'r.d of Supervisors;, dated May 10, 1963, recommending that feasibility studies be continued re widening and deepening of Petaluma River Cha'niel,.. read and filed.,. Letter from American.Legion, Petaluma Post No. 28, dated May 20, 1963, nvitingme'mber's' of 'Council and their wives to attend dutch treat dinner and entertainment meeting at the 'American Legion Hall. on May 22, 196:3 at 6. °30 p. M., read and'filed. 1 May 20, 1963 . Northeast Petaluma Annexation #2 Letter dated May 15, 1963, received from Uermott, Maxwell & Hood, Attorneys representing Carlisle S. Gutermute, asking that the Gutermute property be omitted from proposed annexation, submitted and filed. City Attorney Ed Robert stated that if the Council. wished to grant the Gutermute request, it would be necessary to pass a resolution terminating the subject annexation proceedings and directing the applicant to re- submit his application for annexation. Mr. Robert then explained how the Mitchell property could still be annexed without the Gutermute property by annexing up Ely Road, Mr. .John Mitchell. addressed the Council stating that he believed it would be advantageous to the City to annex the Gutermute property, After checking with the City Planning Director, Councilman Solomon stated he had learned that the taxes on the Gutermute property posed to be, annexed would increase approximately $63, 00 if it were in the City liin�its. Considering this, he felt .that the Gutermute property should be included in the subject annexation as originally proposed. Councilman Vail Bebber agreed that the Gu.termute property should be included in the annexation- Acting Mayor Cr nell.a stated that he did not like the idea of f'orc'ing anyone to. annex against his Wishes, However -in this particular case, the City . would be, faced with the maintenance of a considerable amount of road, Also, if the sewer were run down along .the G.utermute property, this would greatly. increase the value of said property, making it saleable immediately. A motion was then made by Councilman Colin, seconded by Councilman Vain Bobber, that the Northeast Annexation proceedings be continued as originally proposed, and that.Mr. Gutermute' °'s request to have his property omitted from, the annexation be denied. The motion carried by 6 affirmative votes, 1 -absente&., REPORTS OF CITY OFFICIALSa City Manager Claims approved for payment by -the City Manager were submitted and filed; whereupon, Res #3197 'No Co Se introduced -.by Councilman Colin, seconded by Councilman Van Bebber, approving claims and bills (Nos, 2288 to 2377 inclusive and No 1592 to 1620 inclusive)`, was read and adopted by 6 affirmative votes; 1 absentee, City Planning Commission General Plan Modifications Res. #176 approving modifications to the General Plan and recommending that the Council adopt the same, submitted and filed. City :Planning Director Bob Byrd went over the 10 proposed modifications for the :infor.mation of the Council, Mr. ,Byrd stated that he would have, in the near future, a report on methods that could' be used in order to buffer the airport location thus keeping the airport from eventually being encroached on by' residential. 'There was discussion concerning what could be done to protect the area . adjacent to the proposed `Boat Harbor, Inasmuch-.as this area was in the County, it was the conclusion of the Council that the only way in which the City could be assured of the type of use would be by annexations The following resolution was them adopted. " adopted by 6 'affirmative votes, 1 absentee. 2 .,. 1 . �b 1 May 20, 1.963 Mt. Villa Su #1 Res, 41 approving final map of Mt. Villa Subd. # 1, submitted and filed; report of Dir. of Public Works thereon dated May 9, 1963, submitted and filed. Councilman Colin felt that the developers of this property - were to be commended on this project, considering the topographical problems involved, etc. There was discussion relative to the costs involved'in the construction of the street leading into the development, Meadow Glen Drive. The City Attorney explained that in this particular case, the subdivision was away from an existing, improved 'street. and in order to obtain proper access, this street had to be improved, Mr. Robert went on to say that the land being used for street purposes had no ownership but had already been dedicated to the City. Therefore, the'developers could not retain any portion of it as a means of recovering some of the construction costs in the future. The City Manager and City Attorney were directed to study the matter of street construction costs involved in developments of this type, and Res. #3199 N. C. S. introduced by Councilman Van Bebber, seconded by Councilman Crinell_a, entitled, ''RESOLUTION APPROVING FINAL MAP OF MOUNTAIN VILLA SUBDIVISION NO. 1. " was read and adopted by 6 affirmative votes, 1 absentee. Report re Central Business District Parking Study Report of Planning Director dated May 17, 1963, re Central Business District. Parking Study, submitted and filed, City 'Planning Director Bob Byrd went over his report in detail for the Council's information, relating the manner in which the study had been carried out, .figures and facts brought out by the study and his recommendations relative to .additional offstreet parking facilities, etc, Mr, Byrd noted that the report also contained various methods of financing offstreet parking facilities. In 'view of the,results of this study, the Planning Director stated' that he did not recommend the acquisition of the property adjacent to the alley on Petaluma Blvd. North, recommended by the Chamber of Commerce, for additional offstreet parking., .He further' pointed out that the property was located on a. blind curve which would create quite a' traffic hazard, City Manager Robert Meyer stated that a copy of the subject report would be sent the' Retail' Merchants' Committee of'the Chamber of Commerce for their study.' ; THe City 1VIanager was directed to arrange for a study session for discussion of the parking study report 'within the next 2 or - 3 weeks. Direc of Public Work Branching Way Court Subd, Request'of William G. ' Lynch dated May 10, 1963, for extension of time , in which to* complete public improvements in subject subdivision, submitted and filed. ,Recommendation of Dir, of Public Works dated May 13, 1963, that subdivider be granted'150-day extension of time, submitted and filed; whereupon, Res. #3200 N. C. S. introduced by Councilman Ellis, seconded by Councilman Brainerd, entitled, "RESOLUTIO.N GRANTING TO WILLIAM G. LYNCH AN EXTEN­ S'�ION OF TIME "WITHIN WHICH TO COMPLETE THE WORK AND IMPROVEMENTS, REQUIRED BY THE SUBDIVISION AGREEMENT FOR BRANCHING WAY COURT SUBDIVISION, DATED OCTOBER 8, .1 ,962, was adopted. by 6 affirmative votes, 1 absentee, _3m May 20, 1963 Street Repairs - 1963 Certificate of Dir. of Public Works dated May 9, 1963, stating that -above named project had been completed satisfactorily in accordance with contract .and plans & specifications of City of Petaluma, submitted and filed; whereupon, Res, #3201 N. S. introduced by Councilman Crinella, seconded by Councilman Ellis, entitled, "RESOLUTION ACCEPTING COMPLETION OF CONTRACT KNOWN A'S STREET REPAIRS, 1963° was adopted by 6 affirmative votes, 1 absentee, At the suggestion of Councilman Ellis, the City Manager was directed to draft - a letter to the contractors, Reichhold & Jurkovich, expressing_ the City's appreciation of the manner and speed in which this project had been accomplished, Res. . #3202 N. S. introduced by Councilman Brainerd, seconded by Councilman Van Bebber, entitled, Sewage Gas Purifier Request of Eimco Process Engineers dated May 17, 1963, for extension of time in which to make delivery of sewage gas purifier, submitted and filed; whereupon "RESOLUTI.ON EXTENDING TIME OF COMPLETION FOR THE DELIVERY OF A SEWAGE GAS PURIFIER.
