Co'uiicilman Colin was in favor of. eliminating, the 'left turns but was, reluctant
to prohibit parking along Washington Street.
Councilman Ellis. explained - nothing further w.11, be considered u ti -1 a- traffic

intersection.
Approval of` the Traffic Committee Report, 1 - was passed by 7 dffirmative

The Mayor said he had bee .info.rmed by the - County Counsel that since the .
petition requesting annexation had been filed.pr.ior to S'eptember•.20,. it would not be
necessary for this annexation`to go before , .the newly created Annexation Comm- assion.
It was the decision of the Council to approve the boundaries of the annexation
as outlined on the reap entitled, ''Lakeville Annexation 1963'" and to. forward the
petition acid map to the Boundary Commission as soon.as possible.

CONSIDERATION OF NEW OR UNFINISHED, BUSINESS:

Petaluma Gardens Subdiv
Mr. john Miitchell',. representing the , Elton .Corporation, addressed the =Council:
stating he .felt the most feasible method of financing and constructing 'the sewer Tine
to thepropo'sed`Petalurna. Gardens Subdivision. would 'be.by'assessment di'str- ict
would include the .proposed subdivision, , Gutermute - property, Converse :property, and
Swanson and `Cutler property. He wanted the -.City to work with him in .promoting the
assessment district. As an alternative route, Mr. mitchell'proposed - the , s fine.
-go on the north of Ely Road and westerly to the - existing sewer line on East Madison
Street. Mr. Mitchell also wondered if the City could : legally force _adjoining property -
owners to tie into a sewer line constructed by him. Mr. Mitchell indicated, he may
sit back and wait. until the. Gutermute and Converse proper .is developed.;before he
proceeds with , hi's subdivision.
In order to br. -ing the Council up, to date, the Mayor briefly discu'ssed,the; re'quire'-
'ments. of the City Engineer and the , advantages and disadvantages of.theproposed. sewer.
line routes.
Mr.. felt that by -the time Mr.. Mitchell is ready to file ;his final map,
the City would' have established a sewer connection charge whereby he could.."reco.ver
a .portion of his costs for extending the-sewer line.,
Planning Director Robert Byrd :commented that since .the City Engineer has
laid out what he .thinks is the.,best route -and Mr.. Mitchell disagrees with the route,
he should come in with an alternate .proposal. The Council could ,then make a decision
to overrule -the City or to .concur with the Engineer. If the-Council con;
curred with Mr.. Mitchell, the City Engineer could , be - directed to work. with Mr.
.Mitchell in following through with an alternate proposal. Mr.. Mitchell could then
decide if he wants to put =the dine through or to sit back and wait.
Mr. Ben -Race,, 'Consulting Engineer of Santa Rosa, addressed the .Council
stating basically there Was no disagreement with the City Engineer as to where the
:various alternates should .go. The disagreement has been in trying. to find a solution
whereby -it. would -be economically feasible for it client to. develop his property,.
He felt the -City Engineer had very adequately determined where the .trunk sewer line
should, go.
At the suggestion iof Councilman Gans, the Mayor appointed Councilman.
,. Gans
to meet with Mr. Mitchell and the -other property owners involved to try Ito =find a
solution to the -problem.

The :Mayor 'reminded the Council to ,be -sure to attend the -hearing -before the
Board of Supervisors at 2:00 p. m. on November 5 'if at all possible. He also extended

. .Apartment unit located at 323 'Petaluma. Boulevard North
Report' of Building Inspector dated September 30, 1963, re a.p'artment is in
violation of the State Housing Code, Uniform Building - and Plumbing Codes of the City
of Petaluma submitted and filed.
Planning Director Robert Byrd explained that the Lessee -has been notified to
vacate. and :abandon the car storage operation and .that the tCity will take no further
action, until the, car storage is reinstated.
Si °dewalk Sales
Councilman Brainerd wondered if the %City had an ordinance prohibiting the
displaying of merchandise on sidewalks.
.The. City Attorney explained an ordinance prohibits the placing of merchandise
on the idewalks except in the City wide promotional sales by the Chamber of Come-_
coerce which have been approved by the Council•.
The City Manager was directed to enforce the .ordinance regarding sidewalk
displays.
Holidays
The Mayor noted that Monday, November 1.1, is a holiday and that-since .a
large percentage of the community will.be working on that day, he thought it would
be .better to divert this particular holiday to some other time when it would be more
useful.
The C.tyAttorney explained the present ordinance provides for the holidays
to be the same as set forth in the ,Government Code.
The Mayor felt the Council should consider the days available and set the
holidays for the coming year. He , added that last year the employees were given the
days preceding Christmas and New Years.
Mr. Meyer suggested a list of the proposed holidays for the coming year be
-presented. `to °the ,Council and if the Council is agreeable, an ordinance can be adopted
to become effective .January 1, 1964.
It was the -wish of the , Council to have the City Attorney prepare -a new ordinance
establishing the holidays to be observed either for the coming. calendar or fiscal year.

There:. being no further business to come before the , Council, the meeting was
adjourned.
