Regular meeting of the Council of the City of.Petaluma called to order by
Mayor Van, Bebber.
ROLL CALL:
Present: Councilmen -Battaglia, Brainerd, Cavanagh, Jr. , Colin, Ellis, Gans,
and Mayor Van Bebber.
Absent: None.
INVOCATION:
'l'nvocation was given by Reverend Earl D. Shaffer, First Church of God.
APPR'OVA L OF MINUTES:
'M'in"utes from the meeting of November 4, 1963, were approved as recorded.
PETITIONS' AND COMMUNICATIONS.:
Recommendation from the -Recreation, Parks and Music Commission dated
November 12 1963, re the Council to consider closing the Recreation Building when it
is not 'in use, submitted and filed. 47.
Councilman .Gans made a motion, seconded by Councilman Colin, that the
recommendation of the Recreation Commission be sustained. Motion. carried 'by 7
affirmative votes.
Notice from the -U.,S. Army Corps of Engineers that funds have -been budgeted
for the maintenance dredging of Petaluma River for the fiscal year 1964, and request-
ing that expeditious action be , taken to obtain the , necessary disposal easements, dated `
November 7, 1963, submitted and filed.'
The Mayor explained he had written a letter to the Board of Supervisors that
the City is .'securing spoils area for this project but because of the development of the
southern part of the County, there .is an increasing demand for' extensive river 'd'evel-
opment and that the City would appreciate assistance from'the County from thin time on.
Application of Harold Ascherman' for Outside - Sewer 'Permit
AppEication of Harold Ascherm'an for outside -sewer connection permit to con-
nect a duplex'for property located at 3 and 4 Ash Lane, submitted and filed. Report
of City Engineer. - thereon dated November .18, 1963, recommending the Council deny
the application, submitted and,filed. .
There being no. resolution prepare' d; Councilman Colin made a motion,
seconded,by Councilman Cavanagh, Jr.,' that the application be denied. Motion
carried by -7 affirmative votes.
Petition filed with the City Clerk November 8, 1963, signed by 12 property
owners in the vicinity of Laurel Street and Schuman Lane, requesting that ;sidewalks,
curbs, gutters and driveway ramps be histailed in that area', read and filed..
Gouncilrnan .Gans. .,made a motion, seconded by Councilman Ellis, that the

Holidays
Letter from the Petaluma City Employees' Association, dated November 14,
1963, re shifting - holidays and opinion of the group that the Government Code should
be retained as a guide for holidays, read and filed.
The Mayor and ,Councilman Gans felt the Employees' Association had completely
misunderstood the .intentions of the -Council in that it was not the desire of the , Council
to take away holidays but merely to divert them to some other time such as the day
after Thanksgiving when the Employees could have a long week end.
.With this understanding the matter was referred to the City Attorney for an
amendment to the present ordinance governing holidays.

City Manager
Claims approved for payment by the City Manager were submitted and ;filed;

and bills Nos. 3268 to 3352 inclusive and Nos, 2134 to 2199 inclusive, was read and
adopted by 7 affirmative votes.
Lease:of rifle range
_6D - Councilman Garis made a motion, seconded by Councilman Ellis, that the
lease of the rifle range be extended for another five years at 'a cost of $1. per
year. Motion carried by •7 affirmative votes.
State Compensation Insurance Fund
The: City Manager explained each .year there is a safety contest and Petaluma
placed tenth out of 70 for accident rates. It was the .first time -the City had planed so
high on the list,
Sales tax revenue
The City Manager noted sales tax revenue for the .last quarter increased 11, 5
per cent over the same period in 1962, due mainly -to the increase .in motor vehicle
sales,
Hotel Room Tax
The City Manager informed .the Council a model ordinance re hotel room tax
had been sent to him by the League and .that copies of the ordinance are available ..for
those members of the Council who are .interested in this type of legislation.
Napa - Petaluma. Expressway
The Mayor noted that the proposed .Napa - Petaluma Expressway had not yet
been approved by the Legislature,
The City Manager was directed to schedule a study session. to discuss this
matter in the very near future.

The Annual Report of the Department of Public Works dated November 5,
1963, submitted and filed,

G,a,;s,,.tax monies available in 1963 -64
The City Manager stated the City expects to receive an additional $8, 000
from the increased gasoline tax and increased City population. On the recommendation 3.
of the City Manager, it was the decision of the Council to budget these monies for
street maintenance.

Apartment unit located at 323 Petaluma BouleNa rd North
Mr. and Mrs. Henderson addressed the Council re occupancy of the apart-
ment at 323 Petaluma Boulevard North which they had been directed to vacate by the
owners of the building and which they had agreed to do in a letter to Mr. Gary Walsh.
City Planner Bob Byrd reviewed the.actions taken by the Staff in the matter,
stating that it was the new use of the building by Gary Walsh which brought the building
under current housing laws and which disclosed the building deficiencies and violations
of many State laws.
After some discussion, Councilman Colin moved, seconded by Councilman
Cavanagh, Jr., that the Hendersons be given six months time in which to vacate the;
apartment.
The City Attorney explained that this motion, as worded, would mean that
the Council is directing the Staff to order Mr. Walsh to cease the .occupancy of the
premises. The motion was then withdrawn.
After further discussion, Councilman Ellis moved, seconded by Councilman
Brainerd, that the hearing be closed and that the decision of the Staff in the matter
be , upheld, Roll Call to uphold the decision of the Staff carried by -the :following vote.-
Ayes: Councilmen Battaglia, Brainerd, Ellis, Gans and Mayor Van Bebber.
Noes: Councilmen Cavanagh, Jr., and Colin.
ADJOURNMENT:
There .being no further business to come before the Counc il, the meeting was
adjourned.
