Attendance Present: Councilmen Battaglia, Brainerd, Cavanagh, Jr. , Colin, Ellis, Gans, and Mayor Van Bebber. Absent: None. Invocation The invocation was given by Reverend Harlan E. Selvey, Evangelical Free Church. Minutes Councilman Colin requested that the minutes of December 21, 1964, show that he suggested the matter of a truck route be placed on a future agenda. Following this cor- rection, the minutes of December 2i, 1964, were approved. Fire Hose f] Fire Department report on fire hose bid opening Dec - Res. No. 4188 NCS ember 16, 1964, submitted and filed. Res. No. 4188 NCS awarding. the contract for the purchase of fire hose for the Fire Department to American LaFrance was introduced by Councilman Battaglia, seconded by Councilman Colin, and adopted by 7 affirmative votes. California County Road Letter dated December 11, 1964, from J. C. Womack, and City Street Progress State Highway Engineer, enclosing a copy of California and Needs Report County Road and City Street Progress and Needs Report and expressing 7appreciation to City representatives for cooperation in compiling the report, read and filed. Plumbing Technical Advisory Letter dated December 23, 1964, from Samuel H. De- Board of Sonoma County Lisle, Secretary of the Plumbing Technical Advisory Board of Sonoma County with an explanation and set of by -laws of the Board and seeking recognition from the Council, read and filed. Director of Planning Robert �f Byrd informed the Council that Building Inspector Oberto was appointed to serve on this Board and that he attended the first meeting this afternoon. It was the wish of the Council that a letter of thanks be directed to Mr. DeLisle for calling this matter to the Council's attention and that a staff representative has been designated for the com mittee. State- Universities Letter. dared December 21, 1964, from City of A lbany Disturbances re adoption of resolution .commending appropriate legis- latioi7 to pf�event disruption of educational processes at r State Universities and requesting Council consideration, read and filed. A motion to table this matter was made by Councilman Gans, seconded by Councilman Ellis, and passed by 6 affirmative votes, 1 negative. The negative vote was cast by Councilman Colin as he felt the resol- ution adopted by Albany should be read and the matter given consideration. -1- Jaivary 4, 1965 Inclusion of Highway 101 Letter dated December .17, 1964, from Congressman in Interstate Highway - Don H. Clausen requesting Council's general thinking System of possible inclusion of Highway 101 in the Interstate j Highway System, read and filed. A motion made by Councilman Ellis, seconded by Coui-icilma_n, Gains, that the City- Attorney prepare, a resolution, supporting" High- way 1 1 as an Interstate Route, was passed by 7 affirm- ative votes. Downtown Redevelopment s Mr. Stuart. Walsh of Development Planning Associates, Survey presented a written outline of a proposed downtown development program, and with Mr.. Harold Atkinson, Planning Consultant, explained in detail the four parts comprising 'the study: namely, Part 1 - Market Study, Part II - Analysis= Concept -Action Program, :Part III - Program Method and Participation, and Part IV - Pro - ll -, cedure Schedule. A study of this type, including four f . months of field work, submission of. a report,, and six + months of follow-up service. Mr.. Walsh estimated would cost '$26, 000 -$30, 000, depending upon the amount of material now ,available as well as accessibility of information. A discussion period followed in which the :members of the Council and Chamber of Commerce Manager Ned Davis asked the two consultants questions regarding their proposed study and the problems in- volved. At the conclusion, Mayor Van Bebber expressed the Council's thanks to Mr. Walsh and his associates for their presentation and ,suggested that they submit a. formal proposal to the Downtown Redevelopment. Council Committee, composed •of Councilman Brainerd, Chair- man and Councilmen Ellis and Gaits, for their review and consideration, and then for a recommendation to the Council. County Road.'System Mayor Van Bebber announced that at the next Mayor's and Councilmen's meeting, County Engineer Donald Head will discus's and consider questions regarding the County Road System. The Mayor requested that any Council or staff .members who have questions to submit =. them to Mr. Head. immediately. 5 Excavation and- Grading Letter dated,December 14, 1964, from Redwood Branch, ,-.Ordinance American. Society of Civil :Engineers, volunteering ser- vices in the preparation of a more satisfactory excav- ation and grading ordinance than contained in Chapter. .70 of the 1964 edition of the Uniform Building Code, and enclosing a draft, of a recommended ordinance read and filed. Director'.of. Planning Robert Byrd reported that he . has studied the draft and has forwarded it to the. City Engineer for his review, and that the Sonoma, County Building Department will also be contacted for their comments. After complete review, it will be submitted to the Council for consideration. -2- 3r;5 3 January 4, 1965 Water Pollution Letter dated December 21, 1964, from Regional Water Control- Board , Pollution Control Board regarding tentative, legislation on requirements for waste discharge into te Petaluma ,I River, and also a tentative self - monitoring program `� Y designed to. •document compliance with the requirements, read and filed. City Manager Robert Meyer reported -that the Director of Public Works is working on this mat - ter with Mt. Yoder and a recommendation will be sub - mitred at the next Council meeting. Northeast Annexation Sonoma County Local Agency Formation Commission No. 4 notice of hearing to be held at Room 101, 2555 Men- docii Avenue, Santa Rosa, on January 7, 1965, at 3 :00 p.m. on proposed Northeast Annexation No. 4, read and filed. Director of Planning Robert Byrd ! located the area on a sketch map (northeasterly side of South McDowell Boulevard, approximately one -half mile south of the existing City Limits), calling atten- tion to an enclave of land-between the existing City Limits and the proposed annexation that would remain in the County and the many problems that 'are involved in such a situation. He added that when talking with the developers of the proposed annexation, he suggested they annex the entire area, but the addition of the en- claved portion would. make it an inhabited annexation and they felt too much time would be involved in an election. Following discussion .on the City Manager's question whether the staff was to appear at the hearing opposing the annexation on behalf of the City of Petaluma, a motion made by Councilman Gans, seconded by Council - man Battaglia, to oppose this annexation at the Form- ation Commission hearing, was defeated by two affirm - ative and five negative votes. "No" votes were cast by: Councilmen Brainerd, Cavanagh, Jr., Ellis, Gans, and Mayor Van Bebber. Those voting negatively felt that the Local Agency -Commission should determine the action to be taken. Mr. Byrd was instructed to present the facts at the hearing without recommendation. Denman Annexation Sonoma County Local Agency Formation Commission No. 3 notice , of hearing to be held at Room 101, 2555 Mendocino Avenue, Santa Rosa, on January 7, 1965, at 3:00 p. m. on proposed Denman Annexation No. 3, read and filed. Mr. Byrd located the area. on a sketch reap (northeasterly side of North McDowell- Boulevard directly opposite the North y71 'San Francisco Bay Industrial ParkO. It was the Council's wish that this - annexation receive a favorable recommen- dation. Claims and B'tts Res, 'No. •41 -89 NCS approving claims and bills was intro - Res. No, 418:9 NCS duced by Councilman Gans, seconded by Councilman Brainerd, and adopted by-7' affirmative votes. -3- 3 S 4 January 4, 1965 Enhance southern entrance City Manager Robert Meyer invited Supervisor Leigh to City of Petaluma Shoemaker present in the audience to further explain his December 16th letter on the subject matter filed at the last Council m. eeting. After the Clerk reread the letter, -Mr. Shoemaker identified the location of the area in question as.the. take -off from the Freeway to the )� Petaluma entrance up to the tw=in bridges, portions owned by the State, County and the City, and that if the City I were interested in a cooperative program with the State, , he urged that a meeting, should be arranged. In discussing the matter, City Attorney Robert recalled.an agreemei with the State for the beautification of the freeway within the City. It .was. felt by, the Council that there is a great need, for the continuation of freeway beautification, but that some of the area within the City should have priority. In order to clarify details, Councilman .Battaglia was appointed to research the original contract with the State, pursue, the matter further, and make a recommendation to the Council. Kenilworth. Recreation City Manager Robert Meyer read a communication from Building Storage Room Richard Lieb with regard the proposed addition of storage rooms at Kenilworth Recreation Building, in which he .s:tated that his architectural fee would be 6% of the construction, contract for doing the necessary, design work. _ A motion directing the City Attorney to prepare a resolution, hiring an architect for the storage room addition was introduced by Councilman Brainerd, second- ed by Councilman Ellis, and passed by 7 affirmative vote In Lieu Tax City Manager Robert Meyer reported that due to the recent census,, the City of Petaluma received an addi- tional $800 from the State Motor Vehicle In Lieu Tax. Rezoning Rejection Planning Commission Res. No.. Z22-64 recommending the rejection of amending Zoning Ord. No. 662 NCS by reclassifying 685 Bodega Avenue from an. R -1 -60.00 to C -H Zone (4. 33 acres located between Bodega Avenue and northerly property line of West Petaluma Jr.. High. School)resubmitted for Appeal- Wil -liam Paula Council, consideration. Letter dated December 28, 1964, from William and Barbara Paula, 685 Bodega Avenue, appealing, Planning 'Commission decision, . read and filed. The Clerk reported that she had received a request from j Mrs. Paula to hold- t h e m atter over for the Janua ry 18th meeting. City Attorney Robert explained that the Zoning Ordinance does not provide specific procedure for zoning appeals and hearings, and further added that if the Council desired, they could listen to the appeal, obtain the Plan= ning Commission reason for the rejection, and then make a decision a�s to whefher or not legislation is to be pre - pared. 'The matter was directed to be placed on the agenda for the-next regular meeting. Traffic Committee Traffic Comm- i.ttee Report dated December 30, 1964, submitted and filed. In answer to, Councilman Cavanagh's question, City Manager Robert Meyer stated .he would KIN January 4, 1965 C] Traffic Committee check into previous Traffic Committee reports to see (continued) that all recommendations had been carried out. After a .brief discussion; the.C.ouncil approved the items con- tained .in the Report. Arcade Councilman Brainerd read a communication from the Bunk handling the Schluckebier Estate indicating their willingness to. deed a 1.0 ft strip for the arcade from the Keller Street parking, lot to Kentucky Street for the sum of $5, 000 to be paid by the City and that the costs of i' developing the.arcade be paid by the City. With regard to the continuation of the arcade on to Petaluma Boulevard North, Councilman Colin felt that the present Council Committee should follow-through with the program and I ' keep the Council informed of all developments in order s to ultimately get an overall plan formulated for the entire project. -- The Council Committee was then directed to continue with their work and periodically present the facts to the Council. Outside Sewer'- Jim Nichols Outside sewer application of Jim Nichols, 104 West Res. No. 4190 NCS Street, for .one single family residence connection on .Madison. Street, just south. of Ellis Street, submitted and. filed., Director of Public Works David Young re- port, recommending approval of said permit, read and filed. Res. No. 4190 NCS was introduced by Council- main Colin, seconded by Councilman Battaglia, granting permissioii to Mr. Nichols to connect to the City sewer system, and adopted by 7 affirmative votes. Survivor's B .refits Ordinance No. 774 NCS amending the contract between Ord. No, 774 NCS the City - of Petaluma and the Board of Administration of the .Catifori-iia .State Retirement System, was intro- /C4 duced. by Councilman Gans, seconded by Councilman Ellis, and ordered postedi by 7 affirmative votes. Uniform Bui- ldilig Code` Ordinance No. 775 NCS, adopting 1964 Edition of the 1964 Edition Uniform, Building Code with certain amendments, was Ord. No. 775 NCS introduced by Councilman Ellis, seconded by Council- man Brainerd, and ordered published by 7 affirmative votes. Civil Eiigineerin' Associate Ordinance No. 776 NCS amending Ord. No. 655 NCS Ord. No. 776 NC& by adding the.,position of Civil Engineering Associate and; establishing.a Salary Range of 57, was introduced by Brainerd, seconded by Councilman Ellis, - and ordered posted 'by. 7 .affirmative votes. Purchase of Post Street Ordinance No. 77.3 NCS purchasing land on Post Street Property to add to the Civic Center, was introduced by Councilman Ord. No. 773 NCS Gans, seconded by Councilman Battaglia, and adopted by 6 affirmative and 1 negative votes. No.- 4191 NCS +; )- L)- Resolution No. 4191, NCS accepting assignment of ease- ment from Wesley Bailey, was introduced by Counc Gaits, seconded by Councilman Battaglia, and adopted by 7 affirmative voters. . City Attorney Robert stated that the City is acquiring more and more property, and in order for it to be recorded, a resolution must be passed by the Council. He suggested that in an attempt to r..educe paper work, the. City Manager.or the City Clerk be authorized to accept and record all deeds, whereupon the City Attori was - directed to present the necessary legislation to cover this matter. -- - Naming McDowell Well lies. No. 4192 NCS establishing that the McDowell Well � g Field - "Lucchesi Park" Field shall be.known as "Lucchesi Park", was introduced Res. No, 4192 NCS by Councilman Battaglia, seconded by Councilman Colin, and adopted. by 7 affirmative votes.. Keller .St -reet Parking Lot In answer to Councilman. Cavanagh's question as to whet - her or. not the. , Staff had contacted the owner of the •p-rop erty adjacent to the northerly side of the Keller :Street Parking .Lot, and to Councilman Battaglia's question as to Staff.contact of the'.oad Vienna Bakery property owner for possible access from Western Avenue to the: Keller Street Parking.-Lot, they were informed that the Staff did normake any contacts with either property owner. Garbage Committee. City Manager Robert Meyer reported that the Garbage Comm-i :tte,e_has requested a meeting With the Petaluma Sani=tary D- isposa;l Company and are now waiting for a reply from them. Little League _.Director of Planning Robert. Byrd stated that.`he.met.with Mr. :Hamme.lt of the' L -ittle League and Park Director Richard Shotlenbe;rger. :aid, they have decided to locate the, ball. diamonds on.the northwesterly corner of, Lucchesi Park and that Department of Public Works will stake out the general boundaries. He further added that the Staff 1 . will now proceed, with development of the general sketch plan for a community park, indicating that the location of the baseball fields do not interfere w.ith.said develop - m ent. Back -'up Treatment Director of Planning Robert Byrd 'indicated that he is pro- gressing with a ,study on - up treatment but.'is'being delayed pending the completion of a comprehensive study on the subject matter by .the City of Modesto Planning Department.
