Council Meeting- Regular meeting of the Council of the City of Petaluma
_ - called to order by Mayor Van Bebber at the hour of 7:30
o'clock P. M.
Attendance Present: Councilmen Battaglia, Brainerd, Cavanagh, Jr.
Colin, Ellis, Gans, and Mayor Van Bebber.
Absent: None..
Invocation The. invocation. Was given by Reverend Godfrey Hartzel,
St. John's Episcopal Church.
Minutes Minutes from the meeting of January .4, 1965, were
approved as recorded..
Weed Abatement This being the time set for public hearing of protests
Res. -No. 4193.NCS and comments relative to• the weed abatement program, -
_ the City .Clerk announced that no written protests had
been, received: In answer to Councilman Colin's ques-
tion, City Manager Robert Meyer replied that the weed
abatement contractor is fully aware of the Council's
displeasure with the performance of his work in the
past and knows that he is to do a more efficient job this
year. There being no protests and no other comments,
the public hearing was declared closed, whereupon Res.
No. 4193 NCS ordering abatement of nuisances was
introduced by Councilman :Battaglia, seconded by Council -
man G ns, and adopted by 7 affirmative votes. ,

Officer Ray W.• Myers, regarding bid opening and results

on the_ subject dump truck, read and filed. It was the

decision oftth& - to accept the staff recommendation,
whereupon Res. No. 4194 NCS awarding the contract to
Sanderson Motor Company for the purchase of a 6 cylinder,
1 1/-'2: ton tilt bed dump truck, was introduced by Council-
man Brainerd, seconded by Councilman Ellis, and adopt-
ed by 7 affirmative votes.

Letter dated January 4, 1965, from Stanley E. McCaffrey,
President of the San Francisco Bay Area Council, re San
Luis Drain, read and .filed.
Liquor License
Copy of ;application for transfer of liquor license filed by

Cader. Subdivision No. 4
City Manager Robert Meyer read a letter, dated Janua
7, 1965, from Dave G. Cader re Cader Subdivision No.

4 concerning the required replacement of existing 6 inch.
sewer line between Laurel Street and .Petaluma Boulevard
North with an 8 inch line. Mr. Meyer referred, to the City
Engineer's .report of.. January 4, 1965, to the Planning
Commission re subject tentative map setting forth the
requi- rement_ that this sewer line replacement be made
before construction of houses on the subdivision dots.
In his letter, Mr. Cader requested the City: construct
the 8 inch off- tract line with sewer connection fees col-
lected from new dwellings which contribute sewerage to
the line, and that the estimated cost: of $10, 000' be accounte
for in the following manner - "That the $2.600. OO,,paid on
sewer connection fees in the past 7 months ,on Cader Sub-
division .1, 2, and 3, be applied to the estimated cost of
$10, 000; and, that the balance be guaranteed, in co,nnec-
tion fees in the next two years or that I will- come up
with the balance to the City at the end of 2 years;, " fur -
they adding that he intends to build houses and sell lots
in Cader No. 3. and No •. 4 which should easily provide
the City with the balance of the. money. In answer to
Councilman Gans., Mr. Meyer said that the ;balance
would be guaranteed by the posting of a cash bond. Fol-
lowing a brief discussion,. the Council agreed to accept
Mr. Cader's proposal and :directed. the City Attorney to
prepare an agreement and submit it to the Councilfor.

Master Sewer Study
,Letter, dated December 31, 1964,, from Stone and Young -
Stone & Youngberg
berg, was - read by City Manager Robert Meyer regarding
financial considerations concerned with the proposed
ti
sewer construction project. In discussing Stone -

Youngberg'�s proposal, Mr. Carleton Yoder stated that
he is about fifty percent complete with his master sewer

Master -Sewer Study study, and. it would be beneficial and advisable for the
Stone & Youngberg City at this time to consider the services of financial
(Continued) - consultants in order to find the most economically feas-
ible sewer plan' the City could adopt and the means of
financing. A motion directing the City Attorney to pre-
pare an agreement accepting the proposal offered by
Stone & - Youngberg and present iV- for consideration at
the next Council meeting, was made by Councilman Gans,
seconded by Councilman Battaglia, and passed by 7 affirm-
ative votes.
Rezone Denman Annexation Planning Commission Res. Z1 - recommending rezoning
No. 2 of area within Denman Annexation No. 2 from an R -i-
Ord. No. 777 NCS 10, 000 Zone to an M -L' (Limited Industrial) Zone, sub-
mitted and filed. Ord. No. 777 NCS amending Zoning
Ordinance No. 662 NCS approving subject rezoning, was
introduced by Councilman Colin, seconded by Councilman
Gans and ordered :published by 7 affirmative votes.
Rezone South Petaluma Planning Commission. Res. Z2-65 recommending rezoning
Annexation No. 1 of area within South Petaluma Annexation No. 1 from an
Ord. No. 778 NCS R -1 -10, 000 Zone to an R -1 -6000 Zone, submitted and
filed. Ord. No. 778 NCS amending Zoning Ordinance
No. 662 NCS approving subject rezoning, was introduced
. by Councilman Gans, seconded by Councilman Colin, and

Rezone Second Street to. Planning Commission Res. Z3 -65 recommending rezoning

Ord. No. 779 NCS and filed. Ord.. No. 779 NCS amending Zoning Ordinance

by Councilman Gans, seconded by Councilman Colin, and
ordered published by 7 -affirmative votes.
Rezone North Petaluma Planning, Commission Res. Z4- 65 recommending rezoning
Annexation No. 5 are a.within North Petaluma Annexation No. 5 from an
Ord. No. 780 NCS R -1 -10, 000 Zone to a C -N Zone, submitted and filed.
Director of Planning Robert Byrd read his report to the
Planning Comrn.ission recommending approval of the re-
zoning request, whereupon Ord. No. 780 NCS amending
Zoning Ordina No. 662 NCS approving subject rezoning,
was introduced by Councilman Gans, seconded by Council -
man Colin,, and ordered published by 7 affirmative votes.
Tentative Map, Planning Commission Res. 1 - approving tentative map
Ca`der Subdivision. No. 4 of Cader Subdivision No. 4, submitted and filed. Direc-
�s for of Planning Robert Byrd read his report to the Plan -
ning Commission recommending approval of the tentative
map based on the conditions therein and those set forth
by the City Engineer.
Fee Schedule -' Report,, 'dated January 18, 1965, of Director of Planning
Plumbing and Heating . and Building. Coordinator Robert Byrd stating that in
Permits order to expedite reprinting of the existing plumbing and
)� heating permits, it will be necessary for the Council to
adopt the new fee schedule prior to the adoption of the

Fee Schedule - new codes; submitted and filed. He poii ted out that the
Plumbing and Heating fees are generally less than those recommended by the
Permits new codes and are the same as are cur.rentl -being used.
(continued) The Council approved the fee schedule as presented
which will be included as* an amendment to the ordinance
when the 1964 Uniform Plumbing , and the 1964 Uniform
Heating and Comfort Cooling Codes are adopted,
Septic: Tank Applications' Director of Planning Robert Byrd stated that the Planning
- Commission has :initiated, a recommendation to ask the
County to establish a policy of review and referral, if
not, to withhold major. septic tank installation approvals
within the area included in the Master Sewerage Plan
until - said Plan is completed., If the Council agrees,. a
letter of recommendation will be seize to the County along
with a copy of the reap showing the boundaries of the study
area, ' asking that they accept this type of policy. A mo-
tion was made by Councilman Gans,, seconded by .Council-
man Ellis, - that the Council concurs with the recommen-
d'ation of the Planning Commission regarding the septic
tank applications within the Master Sewerage .Plan Area,
and carried by 7 affirmative votes.

City Attorney Robert explained that it is .necessary for
the Council to rescind Res. No. 4166 NCS 'because a,
portion of the, district: is located in the County and juris-
diction must be, obtained from them before R : esolution.

introduced by Councilman Battaglia seconded by Council=
man Colin, and adopted by 7 affirmative votes_
.Res. No. 4197 NCS to adopt Resolution of Intention and,
requesting jurisdication of the County of Sonoma for m�k=
ing improvements within the unincorporated area of the
County of Sonoma within the boundaries of ,.Assessment
-District No.. 9 NS, City of Petaluma, was introduced by-
Councilman 'Battaglia, soconded by Councilman Ellis, and
adopted by 7 affirmative -votes.
Director of Public Works David.'Young report of.certi-
fication, of completion of public improvements in Kazen
Subdivision No. 1, read and. filed. M' r. Young stated that
the inip:rovements are complete except for remedial.
work to ;be done; on the grouting of, the Magnolia Avenue `
storm drain and the satisfactory completion_ of the street
pavement. Spot failures have appeared in, the street
pavement and numerous patches and repair -'s have been
made by the contractor s'inc'e originally completing the
work. Normally a street of this type should last ten
years, but if accepted, it would need maintenance work
within a year. He recommended - that the. City not accept
the street portion of the improvements. Mr. Charles
Smith, representing Mr.. Ka.zen, explained the problem
with the base rock..fur. --n.i by his supplier and requese
the Council's.consideration.to a solution of the problem
so that Mr. Kazen could receive final clearance from
PHA. The City Attorney'stated- that the City cannot

accept. subdivision public improvements in part but only
in 'their entirety and suggested the matter,_be referred to
the City Engineer, whereupon Mr. Young was asked
to discuss a solution with the subdivider. Following a
brief discussion, a motion to table action on the reso-
lution accepting the improvements until a satisfactory
report is received from the City Engineer as to a solution
on the matter, was made by Councilman Gans, seconded
by Councilman Colin,. and carried by 7 affirmative votes.
Director of Public Works David Young presented a re-
vised map of the ,Select System of City Streets and High-
ways prepared in .connection with the "Select System
Report" required by the Streets and Highways Code to
be submitted to the California Highway Commission for
consideration in order to receive funds made available
by the Collier -Unruh Local Transportation Development
Act. Res. No. 4198 NCS adopting a select system of
City streets was introduced by Councilman Brainerd,
seconded by Councilman Battaglia, and adopted by 7
affirmative votes.
Director of Public Works David Young reported that he
and Mr. Yoder had ;met last week with Mr. Roger James
of the, Waster Pollution Control Board to discuss the Board's
requirements for the City's waste discharge into the Peta-
luma, River and the self - monitoring program of taking
tests in order to comply with these requirements, also
referring to the Board's letter of December 21, 1964.
Mr. Young said that the Board has requested the City
to reply to-their letter by January 29. Mr. Carl Yoder
briefly reviewed the requirements as outlined in the
Board's resolution and the self- monitoring program.
He said that 'in their discussion with Mr. Jame s, it was
tentatively resolved that the City would got take tests at
the three sampling stations located downstream and
outside of the City Limits' as long as the B. O. D. and
T. S.M. requirements': oflSec,. VII - B -2 of the resolution
are satisfied. Upon conclusion of Mr. Yoder's summary,
the staff was directed to answer the Board's letter and
indicate to them the Council's approval of the resolution
on waste discharge requirements and monitoring pro-
gram with the above noted modification on eliminating
the sampling stations outside the City Limits.
A 5 - minute recess was declared. The time was approx-
imately 9:35 p. m The meeting was called to order.
Mr. Carleton Yoder presented a review of the progress
L of the Master Sewer Plan, giving in detail the various
�J plans proposed for the area and. the approximate con -
struction and annual costs involved. He stated that his
report will. be completed by the end of April.

Avondale Subdivision No. 1 Director of PubItic Works David Young stated that Mr.
Crinella has requested that the City inform FHA that
even - ough construction of the improvements in sub-
` ject sudivision is not complete, they have sufficient
money in bond. to cover the completion of the improve-
ments as a cash amount has been deposited with the
bank that exceeds the value of the. improvements to be
completed. Mr. Young read a letter from the Batik of
America verifying this deposit. The City Attorney
explained that this .request is made in order for the
people who have purchased homes in the subdivision
can complete their own fin -ancing -with .FHA, and in
addition to the cash deposit, the performance bond
is in effect and a maintenance bond when the 'subdivision
is completed. Mr. O'Neill, contractor for Young
America Homes" in this subdivision, appeared support -
ing their request and stated that this assurance from
the Council that the improvements will be completed
will in no way indicate that the Council has accepted
completion of Avondale Subdivision No. l.. A motion
was made by Councilman Gans and seconded by Council -
man Colin that the- City Attorney forward =a certification
to the FHA in'view•of the guarantees that have been
made, and passed by 7 affirmative votes,.
Survivor's Benefits Ord. No. 774 NCS amending the contract between the
Ord. No. 774 NCS City of Petaluma and the Board of Administration of
the California State Ret- irement System, was introduced
by Councilman Gans, seconded by Councilman Ellis,
and adopted by 7 affirmative votes.
, Uniform Building Code Ord. No.. 775 NCS adopting 1964 Edition of the Uniform
V 1,964- Edition Building Code with certain amendments, was introduced
Ord. No. 775 NCS by Councilman. Ellis, seconded by Councilman Brainerd,
and adopted by 7 affirmative votes.
Civil Engineering Ord No. 776 NCS amending Ord No. 655 NCS by adding
Associate the position of Civil Engineering'Associate and estab-
Ord. No. 776 NCS' lishing a Salary Range of 57, was introduced by Council-
man Brainerd, seconded by Councilman Ellis, and
adopted by 7 affirmative votes.
Kenilworth Recreation Res. No. 4199' NCS appointing Lieb, Ross & Qua.r,esma
Building Storage Room to perform architectural services for the addition to
Res. No. 4199 NCS the Kenilworth Park Recreatioiz Building, was intro -

Inclusion of Highway Res. No. 4'200 NCS supporting inclusion of Highway 101,
101 in Interstate the Redwood Highway of California into the Federal

Res. No. 4200 NCS man Ellis, seconded by Councilman Brainerd, and
adopted by 7 affirmative votes.

Acceptance of Deeds Res. No. 4201 NCS authorizing the City Manager to
Res. No. 4201 accept all deeds and grants conveying any, ; interest in.
or easement upon real estate to the City of Petaluma
and to consent to their recordation, was introduced
by Councilman Ellis, seconded by Councilman Brainerd,
and adopted by 6 affirmative and 1 negative votes. The
negative vote was cast by Councilman Colin because he
preferred Council consideration of each deed or grant.
i Taxes Res. No. 4202 NCS requesting cancellation of taxes on
Res. No. 4202 NCS property acquired; by the City of Petaluma from Andrew
L.. Lacasse, was introduced by Councilman Colin, sec-
onded by- Councilman Brainerd, and adopted by 7 affirm-
ative votes.
Auditorium Bond .Funds -, Mr,. -Robert Meadows,- member of the Petaluma High
School faculty and the Petaluma Community Theater,
asked for proper procedure to oppose the use of the
Auditorium Bond Funds for the construction of the pro-
posed swimming pool as the community is in need of a
small theater. He was informed by the Council that
the deadline expired on January 15th for filing arguments
against the swimming pool measure and that opposition .
to the measure could be handled by advertising, pam-
phlets, etc. The City Attorney stated that if the swim-
ming pool measure fails on February 23, the legality of
the change of. use could be contested, but that it is within
the authority of the Council to determine the use of the
-- funds for an auditorium or any other use.
Adjournment There being no further business to come before the
Council, the meeting was adjourned.
