Council Meeting Regular meeting of the Council of the City of Petaluma
called to order by Mayor Van Bebber at the hour of 7:30
o'clock p m.
Attendance Present: Councilmen Battaglia, Brainerd, Cavanagh, Jr.,
Colin, Ellis, Gams, and Mayor Van Bebber.
Absent: None.
Invocation
The invocation was given by Reverend H. Don Guynes, The
Methodist Church.
Minutes
Minutes from the meeting of February 15, 1965, were
approved as recorded.
Kenilworth Recreation
Report, dated February 26,- 1965, signed by Jack Garrison,
Building Addition-
Chairman, Recreation, Music & Parks Commission re

costs obtained of addition were estimated at $5, 000 and low

bid received was approximately $6, 100, more than antici-
pated, and recommending that the complete job be done under
the contract, read and filed.' Proposal, dated March 1, 1965,
addressed to City Manager 'Robert Meyer from the subject
building architect, Lieb, Ross & Quaresma, of five changes
in the work which would revise the contract, submitted and
filed. After consideration of -the bids received and the
changes proposed, a motion was made by Councilman Colin
to accept the low bid of $6, 179 less the alternate of $680
($5, 499), plus the architect's fee of $282 (67, of estimated
contract $4700), for a total sum of $5, 781, and any difference
in the budgeted amount be appropriated from Item 23 of
the Major Expenditure Program - General Fund, and
seconded by Councilman Ellis. Roll call on this motion
carried by 7 affirmative votes, whereupon Resolution
#4221 N. C. S. awarding contract to Swallow Construction
Company for the addition to Kenilworth Recreation Building,
was introduced by.Councilman Brainerd, seconded by Council -
man Battaglia, and adopted by 7 affirmative votes.

Petaluma Fire. Resolution from Petaluma Fire Fighters' Assn. re "On
Fighters' Assn. Call Work Schedule" which greatly curtails the personal
freedom of the members, petitioning the Fire Chief, the

Old Adobe Antique
Letter, dated February 26, 1.965, from the Old Adobe
Car Club
Antique Car Club, of appreciation for use of Kenilworth
Recreation Building and enclosing a check for $50 to be
used by-the Department of Parks and Recreation for the
planned improvement to the building, read and-filed. It

was the wish of. the Council that the Mayor .send a letter
to the subject Car Club expressing the deep appreciation
of the entire Council for the contribution. A motion was
made by Councilman Ellis that the $50 be used to apply
toward future construction of the lockers in the. Recreation
Building addition, seconded 'by Councilman Gans„ and
carried by 7 affirmative votes.

In answer to Councilman Colin, it was explained that Items

•4 and 5 refer to competitive companies and not individual
Persons - hauling their own rubbish, which will be clearly set
forth when the amendment to, the Code is presented, where-
upon a motion made by CoLt oilman Gans to accept the recom-
mendations- of the. Garbage .Committee Report and proceed
with the. necessary legisl`atio, Was seconded by Councilman
Colin, and.ca:rried by 7 affirmative votes.
Economic Opportunity
City Manager Robert.Meyer reported on the Fzonomic
Act Meeting
Opportunity Act meeting which the Mayor an&:he attended
at the County Administration Center on February 25th.
They heard State representatives speak on the County's
part in the Anti - Poverty Act. He added that. it is evi-
dently a County_fUnction with which ind'ividual cities will
coordinate.
Sectional Sewer Rodder
Specifications for subject eq'iiipment submitted acid_ filed.

Mr. Roy Kelly, Public Works Superintendent, stated that
a sewer. de machine was originally requested in the

budget, but he .concurred with Mr. Young's opinion that a -
sectional sewer rodder would better fit the reeds of the
Depa- rtment, adding that th.e budgeted amount for the desand-
ing machine possibly will not be sufficient to cover the cost

advertise for bids, was introduced by Councilman Battaglia,
seconded `by Councilman Cavanagh, and adopted by 7 affir-
mative votes.
Garden Estates Subd. #1 Director of Public Works David Young reported that he had

encased in a pipe as required by the Council, whereupon
Resolution #4224 N. C. S. , approving final map of Garden
Estates Subdivision Unit #1, was introduced by Councilman
- Gans, seconded by Councilman Brainerd, and adopted by
7 affirmative votes.
Water Dept. Director of Public Works David Young reported motor
Station #9 Well trouble with. the submersible pump at Station #9 well
located west of No. McDowell Blvd., and from all indica-
tions, repairs or replacement will be necessary in the
near future. Due -to the fact no immediate action was
necessary, the matter was referred to the Water Commis -

Lakeville Area Director of Planning Robert Byrd reported that inspections
Inspections in the Lakevillea-rea are 50% complete and that a final
report will be submittedi to the Council on March 15th. o f
Upon Councilman Ellis' request, Mr. Byrd said that inspec-
tions will include Caulfield Lane area sewer problem.

..Hotel -Motel Tax The City Attorney explained that if the Council wished to

tax for promotional uses, - an amendment could be made
after adoption of the ordinance. At the suggestion of Council -
man Cavanagh, the City Manager was requested to send a
letter to all hotel- motel owners regarding the proposed ordi-
nance so that they will be informed prior to adoption of the
ordinance on March 15th, whereupon Ordinance #781 N. C. S.
amending Chapter 23 of the Petaluma City Code by adding
Article III, Sections 23. '13 through 23. 26 in order to impose
a.tax upon the privilege of transient occupancy and providing
for the collection thereof, was introduced by Councilman
Gans, seconded by Councilman Cavanagh, and ordered posted
by '6 affirmative and 1 negative votes. The negative vote was
cast by Councilman Battaglia and no reason for his objection
wa•s given.
Special Municipal Bond Councilmen Battaglia and Cavanagh together with the City
Election Canvass Clerk were appoilited to can -Vass the returns of the subject
Res. #4225 NCS` I election held on February 23, 1965.

A 20- minute recess was • declared. The time was approxi-
mately 9:15 p.- in. The meeting was called to order.
After canvassing the returns of the 17 consolidated pre-
cincts and the absentee votes, the following resolution
was adopted:

AND RESULT`OF SPECIAL MUNICIPAL BOND ELE_C-
TION HELD ON FEBRUARY 23RD, 1965.
INTRODUCED BY COUNCILMAN David W. °Brainerd at a Regu °lar. Meeti'i7g of the,
City Council of the City of Petaluma on the 1st day of March, 1965,
WHEREAS, a Special Municipal Bond Election was held on February 23rd,
1965, in the City of Petaluma to pass upon'a measure hereinafter set forth,; Which said
measure was duly and regularly submitted to the electors of the City of Petaluma at
said election; and
WHEREAS', the Council of-the City of Petaluma,, by Ordinance No. 769
N. C. S. duly passed and adopted on the 7th day of December, 1964, designated the pre -
cinc;ts and polling places and appointed the members of the precinct boards for the
Special Municipal Bond Election to be held in said City of Petaluma on February 23rd,.
1965, as required by law; and
WHEREAS, the Special Municipal, - Bond Election was held on `Tuesday,
February 23rd, 1965 in accordance with law.,. a -nd the votes thereat received and can-
vassed, acid the returns thereof ascertained, determined 'and declared in ,all respects
as required by law;
NOW, THEREFORE, BE IT f�ESOLVED BY THE COUNCIL OF THE CITY
OF 'PETALUMA, AS FOLLOWS:
.1. That the City Clerk of the City of Petaluma be, and she is hereby
instructed enter this Resolution on the minutes of this Council as a statement of
the result of said election.
2. That the total number of votes, cast in said C;ity,, at said Special Muni-
cipal Bond Election was' 2, 220. That two (2) ballots were spoiled and not counted.
3. That said measure submitted 'at said election was as follows:
MEASURE: `Shall the City of Petaluma expend the bal-

provements), by electors of the City of Petaluma by elec-
tion of.June r2th, 1945,, for the purpose of
the acquisition, construction and completion of the following ,muni-
cipal improvements, to wit: a municipal swimming pool, including
necessary appurtenant buildings conf9ining rooms, halls and of-
fices, together with all landscaping, improvements of grounds and
facilities, fixtures, furniture,. , equipment and other things and
property (including the acquisition of property) necessary and pro-
per to provide a municipal swimming pool; the acquisition, con-
struction and completion of park arid..recreational facilities, furni-
ture and equipment of a permanent nature for the improvement.of-
, the grounds - and facilities' of the various parks of the City of
Petaluma, as determined to be best.by the City Council of the City
of Petaluma, for the acquisition, .construction and completion of
property` or structures necessary or convenient for the park and
recreational facilities for the City of Petaluma?

4. That 1, 499 votes were cast in favor of said measure by the elec-
tors of said City voting on said measure at said election, and that 719 votes were
cast against said measure by the electors of said City voting at said election on
said measure, and that said measure passed; all as shown in the certification of
the result of the vote cast at said election by the City Clerk of the City of Petaluma,
which certification is on file in the office of the City Clerk of the said City; and
that said canvass of said returns by said City Clerk hereby ratified and con -
firmed.

I hereby certify that the foregoing resolution was duly and
regularly introduced and adopted by the Council of the City
of Petaluma, on the 1'st day of March, 1965, by the follow-

Swimming Pool Upon decision of the Council, City Manager Robert Meyer
was requested to invite the members of the Recreation
Commission to the Council's study session next Monday
might to discuss details regarding the swimming pool. It
was also suggested that at a later date a committee of
citizens in the community who are versed in the field of
swimming pools be formed to make recommendations and
render a's'sistance 'to the Council and Recreation Commission.
Downtown Following a brief discussion, it was the general opinion of
Redevelopment -the Council not to send a representative to the dedication
ceremonies in Orange City for the completion of their re-
vamping program. The Mayor said he would send a letter
of regret to Mr. Thomas J. Ashley of the Planning Advisory
Committee of the State of California who extended the in-
vitation to the City of Petaluma, . and that we would like to
meet, and confer with him at a l,"ater date in Sacramento re-
garding City of Petaluma redevelopment program.

Petaluma River
In response to Councilman Colin's inquiry regarding the
problem of recent: evidence of raw sewage in the Petaluma
River, Director of Public Works stated that the "B" Street
storm drain was getting a flow of sewage from a. Gros
connection of the sanitary sewer system, which subsequent-
ly 'has been sealed off, and that a continual check is being
made for hidden and unknown cross connectioiis between
the sanitary sewer .system and the storm drainage system.
The City Manager added that the City is continually workin .
with the State Water Pollution Control Board on Petaluma
River pollution problems.
Head of Navigation
In answer toy Councilman 'Colin, Mayor Van Bebber said that

a Congressional meeting is scheduled this spring re navig-
able waters and that Congressman Clausen will keep u in-
formed when this meeting will beheld, which the Mayor added
will be after the Corps of Engineers makes its report at the
end of March.. Councilman Colin wanted, to know if the City
is prepared to proceed with Washington Street Bridge recon-
struction °after the information is available. City Attorney
Robert stated, however, that if Congress declares the head
of navigation stops at Washington Street bridge, this does not
change its navigability in fact, and referred to air extensive
report he prepared several years ago on this subject from a
legal standpoint, copies of which w! 11 be furnished to the
;,.
Council by the City Manager.
Legislative Committee
_,Councilmen Battaglia and Cans were appointed to serve on
the Legislative Committee.
Washington 'Street-
Dr. Robert K. Atkinson of 50 - Raymond Heights, appeared
Bodega Avenue
before the Council to protest against the proposed subject
Realignment
project. He felt that the expenditure of $197, 000 for this
project could be better used .for more important projects,
such as improving the waterfrbpt area or eliminating traffic
tieups caused by trains .on "D" Street clad Washington Street.
Mayor Van B`ebber stated that the proposed' realignment
project has been given several years of study and considera-
tion and it is not a matter entered "upon Tightly or quickly.
Adjournment
There being no further business to come before the meeting,
the meeting was adjourned.
