Council Meeting Regular meeting of the Council 'of the City of Petaluma
called to _order" by Mayor Van Bebber at the hour of
7:30 o'clock - p. m.
Attendance Present: Councilmen Cavanagh, Jr. Colin, Ellis, Gans,
and Mayor Van'Bebber.
Absent: Councilmen Battaglia and Brainerd.
Invocation
The invocation was given by Reverend Godfrey HaYtzel,
St. John's Episcopal Church.

Denman Annexation #3
This being the time set for public hearing of protests and

comments regarding the subject annexation, the area was _

located on a map by Director of Planning Robert Byrd. The
City Clerk announced that no written protests had been re-
ceived. There being no protests or comments from the
members of the Council or the audience, the public hearing
was declared closed, whereupon Ordinance #782 N. C. S.
approving Denman Annexation #3,, was introduced by Council -
man Cavanagh, seconded by Councilman Gans, and adopted
by 5 affirmative,: ,votes, 2 absentee.
Northeast Annexation #4
This being the time set for- public hearing or protests and �/
comments regarding- the subject annexation, the area was /
located o' a map by- Director of .Planning Robert Byrd. The
City Clerk announced that no written protests

members of the .Council or thie audience, the public hearing
was declared-closed.- Discussion by the Council followed
on the problems involved in the creation of a corridor be-
tween the existing.C.ity limits and the proposed annexation.
Mr. Byrd- staled-that 14 registered voters reside in t1 1e con -
claved area, and if included in the annexation, would require
an election as it would be considered an inhabited territory,
further adding that the proposed annexation would make it
difficult from the Ci."ty's, standpoint to determine boundaries,
to offer. City services, and to serve utilities in the area,
The,Mayor said that a recen survey of the residents in the
corridor section indicates that there was a strong opposition
to annexation. Due to the problems involved, Councilman
Gans made a motion to table action on the subject annex:, -adoaz
and refer the matter to the administrative staff for further
study and recommendation for r` >�oi-isideration by the Council.
Motion was. seconded by Councilman Colin and carried by
5 affirmative votes,. 2 absentee.
Petaluma Properties
Mr. Herold Mahoney appeared before the Council in regard to
an existing agreement between i:he City of Petaluma and Peta-
luma Properties and introduced Mr. Vincent Schoeningh, D L/

because said line also benefited the adjoi:tning property,
an agreement was authorized to be executed for, reimburse-
ment of one -half cost. of the line to be collected from con-
nections made by Parcel "B" as shown on the map attached'
to the agreement.' Mt. Schoen ngh added that they recently
received a letter from the City •transmitting a check in the
amount of $463. 50 as reimbursement for the; connection

that at the time the - agreement was executed the City had
no sewer connection fee ordinance in effect and questiJoned
the enforceability of the agreement, adding tha tin his

with Mr. Mahoney's' suggestion for further study and nego-
tiation and Councilman Gan's request for time to study dates,.
maps, etc. on the .subject, a' Council Committee was- appoii t-
ed, consisting of'Councilmen Cavanagh- - Colin, and Gans, to-
consider the matter for recommendation at the next Council
meeting.
F eport dated March 15, 1965, signed by Purchasing Officer
Raymond W. Myers., re subject bid submitted and
filed. No recommendation was made as the two bids re-
ceived were so close. Mr.. Robert Jerauld of Plectron Elec-
tronics, the low bidder; and Messrs. Harris -and Sloan of
Western Fire Equipment Company, appeared before the
Council to describe and demonstrate their equipment. Follow-
ing consideration of both °products, it was the decision of
thb� to accept the• low bid, whereupon l?,esolution
#4226 N. C. S. awarding contract for the purchase of radio

A 5- minute recess was declared. The approximate: time

Lesly H-. Meyer requesting joint study by the City Planners
and the County planners for possible future school - sites in

..by Coucilman Ellis and seconded by Councilman Gans, the
Director 'of Plan ling .was directed to meet with the School
administration in selecting school sites.
Sonoma. County Taxpayers' Letter, ,dated March 4, 19.65, from. Sonoma County Taxpayers'
; Assn, re "hotel= Motel" Assn. recommending revenues received from proposed
Tax ''Hotel -Motel tax. be used advertising- promotional pur-
poses, and further- recommending that monies now being
expended for advertising and promotion be used to reduce
property tax - requirements next year and in future years,
read and filed It. was indicated by the Council that this, ;
recommendation be kept in mind when discu ssing the pro
posed ordinance later in the meeting.

into an agreement to effectuate the same, was introduced by
Councilman Ellis, seconded by Councilman Gars, and

and Training Peace Officer Standa'r`ds and Training re reimbursement to di
participating cities and •counties in the 1964 allocation, read
and filed. It was noted that Petaluma received a reimburse-
ment of ' $ 271.00.

Purchase of Fire Apparatus City Attorney Edouard F.obe <.rt read a resolution he had pre- /;
and pared for Council consideration covering a joint agreement (

for the subject equipment to be approved by the pity of Petaluma
and Vallejo, and when approval is reached, the City of
Berkeley will call fo:r.and receive the bids. Each City will
be allowed to accept or refuse and act on their bids. The
proposal calls 'for separate bid forms for each of the res-
peefive :city }'s requirements' The contract would be between
the cities and the successful bidder. Following discussion
on this type of purchasing, Fesolution #4229 C. F. author-
izing agreement between City of Berkeley, the City of Vallejo,
and the C:.ity of Petaluma for the- purpose of exercising a
common function, to wit:. the purchase of fire apparatus and

to. comply-with subdivision requirements, said plans are to_
show that one -half of Paula Lane is to be paved and improved
with curbs, gutters; and sidewalks, including' across the
frontage of Lots A a.nd. B, -and that an off -tract storm drain
pipe be installed from Cader #3 to Laurel and W, Streets,
further adding that the subdivider objects to the street im-
provements fronting Lots -A and B and paying for the - entire

installation cost of the storm drain pipe. Mr. Cader stated
that the' homes on Lots A and B were built prior to - _ai nexatio
and that the present-owners are not in favor of these improv -
ments, referring to letters sent to the Council by Mx,. ,& Mrs.
W. F. Muller, 600 Paula .Lane, Mr. & Mgrs. V. H, Davison,
600 Paulalane, and Mr. Arthur F. Canavan, 670 Paula. Lane,
which were submitted and filed. However, Mr. Cader said
that the entire'West St. - Paula Lane intersection will be im-
proved, req ue.sting only deletion of the portion from the curb
return .iii front of Lot B on Paula Lane to the northerly bound-
ary of Lot A on Paula Lane. Following a, discussion on.this
matter, ' a poll' of the favoring the requirement of
including the street improvements in front of Lots .A, and B on

Mr. Cader also requested reimbursement for the port -ion of
storm 'drain pipe installation that would benefit other proper-
ties. In.order;to receive reimbursement, the City Attorney
stated that legislation covering storm drains similar to sewe
reimbursement would. have to be enacted, and that it would
be advisable for Mr. Cader to delay commencement of Cade
#3 construction until this legislation is effective, whereupon
the City Attorney was d'ire:cted to prepare the., necessary
legislation for the adjourned .meeting on March 22nd... A
Motion was•m_ade by Councilman Colin to table approval of
Cader #3, and seconded by 'Councilman Ellis.
Motion .carried by 5 affirmative votes, 2 absentee.

Mr. Tom Wilson, Water Department Superintendent, re-
ported that a 30 HP p failed at Station #9. Ue: ?matter
was referred to the Water C=ommission who concurred with
staff recommendation to purchase a new deep well turban
above ground and because of the emergency involved,
it was recommended that price quotes be obtained instead of
going. to bid. The—City Attorney stated that the pump needs
to be acquired very quickly which does not provide time for
the usual ordinance and bid procedure, and in emergency
cases, this can be done without going to bid. He added that
this procedure does not require any action, but brought to
the Council for information. Mr.* Wilson said that it was
their recommendation to accept the low bid of Weeks Drilling
and Pump Company of in the amount -of $2790,
which Mr. Young stated would be paid out of Water Sur=plus
Revenue Funds. Staff_.. recommendation was approved by the
Council.
Report, dated March 12, 1.965, of Director of Public. Works �'
David Young certifying to the completion of the public im
provements in subject subdivision and recommending accept-
ance, read and filed. Fesolution #4231 N. C. S. accepting
completion of work required in Avondale Subdivision #1 was
introduced by Councilman Gans, seconded by Councilman
Ellis, and adopted by 5 affirmative votes, 2 absentee.
Resolution #4232 N. C: S. adopting and submitting a budget
for expenditure of funds allocated from the State Highway
Fund to Cities, was introduced by Councilman Cavanagh,
seconded by Councilman Colin, and adopted by 5 affirmative
votes, 2 absentee.
Director of Planning Robert Byrd reported that 90 percent
of the: businesses in the subject area were contacted by the
Building Inspector and Health Sanitarian. Primary among
the violations found in the area was the overflowing of " -7 "
septic tanks along Wilson Street and Lakeville Highway.
Lack- of toilet facilities -was also found. Abandoned build-
ings were found creating a safety hazard; and two abandoned
refrigerators were ordered bolted and destroyed. One
rendering plant operating under a use permit was required
to clean up their. operations, immediately, and the other
rendering - plant will be required to comply with the health
code for any health hazard. He added that letters are being'
written requiring corrections: and making recommendations
in the area, aild' if corrections are not made within a
reasonable time, follow -up procedure with advice from the
City - Attorney. will be- used., Mr. Byrd further added that
the Inspectors strongly advise the installation of a sanitary
sewer main to eliminate ponding of septic tank overflow and
help correct the toilet facility problem. At -the suggestion of
Councilman Cavanagh, Mr. Byrd was requested to keep the
Council informed ,.on .the matter,.
Ainend Garbage Ordinance Ordinance #784 N. C. S: amending the Code to provide for the
Ord, M,4 NCS prohibition ,of unauthorized persons from collecting garbage
or rubbish within the City, and. to prohibit the burying of
rubbish within the City, was introduced by Councilman Ellis,
seconded by Councilman Gans, and ordered published by
5 affirmative votes, 2 absentee.

and Telegraph. Company; addressed the Council to oppose
-SCA -17, Telephone in Lieu Tax. Councilman Gaits,, member
of the Leg- islat_ive Committee, referred to the League of
California Cities' communication, dated' March '9, 1,.965,, in'
which Richard Carpenter recommended said' tax. 'Duo to the
fact Cobncilman Battaglia (Legislative Committee member)
was absent, action on the matter was postponed.

At the suggestion of Councilman Colin, the City-Manager
was requested to look into the matter of synchronizing
the traffic lights on Petaluma Boulevard.
There being no further business to come before the
meeting, the meeting was adjourned to Monday, March
22, 1965.
