At te;tldance Present: 'Councilmen Biattaglia, Brainerd, Cavanagh, Jr. , Colin, Ellis, Gams, and Mayor Van Bebber. Absent: None Washington ,Street- Letter, dated March` 16, 1965, from .St. Vincent's Mothers Bodega Avenue School Club suggesting installation of school crossing stop lights Crossing Lights for proposed Washington Street - Bodega Avenue realignment. for the children attending St. Vincent's elementary school, 1 read and filed. It was noted that such an installation could be considered in the realignme "it construction costs, and also that the installation cost of the school crossing lights near Valley Vista and Mc Near. Schools was shared by the schools and the City. The City Manager was requested to answer the letter.` " 1. Claims and Bills Resolution #4238 N. C. c. approving claims and bills, was Res. #4238 NC'S introduced by Councilman Gans, seconded by Councilman Battaglia, and adopted by 7 affirmative votes. Traffic. Committee. Traffic Committee l- eport, .dated March 17, 1965, signed by Director of Public Works David Young containing three , 1,1. recommendations, read and filed. Following review of each item by Mr. Young, the Traffic Committee Deport was approved by the Council. F.ezon& Planning Commission Resolution #'Z6 -65 recommending re- , S outhwest Corner 2izd .& D Streets zoning northerly half of A. P. #8 -066 -4 and 8 -044 -5 from a Ord. #785 NGS C -C' zone to a C -S- zone modified a C -. zone, submitted and filed. Director of Planning Robert Byrd located the area on a map and explained the , modification to a C - H zone, where- upon Ordinance #785 N. C. -S. amending Zoning Ord. #662 NCS by rezoning subject property from a C -C zone to a C -H zone, was introduced by Councilman Gans, seconded by Councilman Brainerd, and ordered published by 7 affirmative votes. Storm Drain Installation The City Attorney explained that the subject ordinance was Reimbutsemeits drafted hastily and is temporary in filature, and suggested Ord. #786 ;NCS should have further study. Following review of the proposed ordinance by the '-, irecto.r of Public Works and the City Attorney, deletions were authorized in Section 19. 13. 1, 19. 13. 4 (b) and (c), and entire Section 19. 13. 5, whereupon Ordinance #786 N. C. S. amending the (=ode to provide for the reimburse- meat to individuals or subdividers of costs incurred by them _ for the installation of storm drains benefiting other properties, was introduced by Councilman Gans, seconded by Councilmani Cavanagh, and ordered posted by 7 affirmative votes. 'Flotel -Motel T_ ax Iii order not to have the 'Hotel -Motel tax in effect prior to other- communities in the area., it was decided by the Council to:designate July 1st. ; 1965, as the effective date of the ordi- nance providing for transient occupancy tax. The City Attor- ney was directed to prepare the necessary legislation. -1- Purchase of Fire Apparatus and Equipment Pes. 44239 NCS March 22, 1965 City Manager Robert Meyer stated that through the efforts of the City Manager of Vallejo, a joint agreement, was made" between Rerkeley, 'Val 1ejo and Petaluma, to purchase fire . equipment and that a standard set of specifications have been ( I prepared, whereupon Resolution #4239 N. C. S. approving l specifications entitled, "One 1250 GPM triple combination pumping engine, '" was introduced by Councilman Battaglia, seconded 'by' Councilman Gans, and adopted by 7 affirmative Lyle Sage R;esigrnation votes. - Resolution. #4240 N. C. S, accepting resignation of-Lyle G. ' Bd. of Butt - dinq Feview Sage as a member of the Board of Building Review, wa°s Fes. #4240 NCS introduced by Councilman Battaglia, seconded by Council - �5 { man Ellis, and adopted by 7 affirmative vote,s.. Sewer Treatment' Plant Mr. Carl Yoder explained the procedure of. 'filing. by March State Grant Application 3P st an application'for PL660 funds to, be used for the coil- Res. #4241 NCS struction or imporvement of the City`'s 'Sewer Treatment Plaint. and intefceptor lines, and if the City qualifies, up to- 307 of the costs could be granted by the government. In order to receive the money, a bond issue would have to be passed by March - 1, 1966. Mr. `Yoder also briefly spoke -on the progres's of his Master -Sewer Study, particularly regard- ' ing the long-range plan for discharge into the ocean or San Pablo Bay. Upon completion of his report, R'esolutioii.- #42.41 N. C. S. author_.izing the filing of an application for state grant for sewage treatment works, was introduced by Councilman Brainerd; seconded by Councilman Battaglia, and adopted by 7 affirmative, votes. - Airport Study Fesolution ' #4242 N. C. `'. requesting the. Federal Aviation F-es. 4242 N( Agency to conduct: an airport study for the City of Petaluma, Was introduced by Councilman Ellis,. seconded by ("ouncil - man Cavanagh, and adopted by 7 affirmative votes.. Library Bond Counsel Dr, cam BroWp, Chairman of the Library Board, addressed. -'es. #4243 NCc ' the Council stating that the'E'ederal Government recently approved Petalurna's application for a Library grant in the ai°nou t of $162, 500' ; which is 257 of the -total construction cost . of $650, 000. The .remaining 757, or $487, 500, must °L be financed by the City, .and .0r. B'rown said that the Board J would like `to add $12, 500 for reimbursement to the r i for previous and coming- election costs, bonding costs, and :any other costs not covered in the grant, and recommended that the amount of the bond issue be $500, 000. Following' a .brief discussion in which the City Attorney stated that Council determination of a definite amount is required for the bond counsel to proceed .a motion was made by Council=man Gans, and seconded by Co'u'ncilman C specifying $500, 000 as the amount of the bond and directing the ( ity Attorney to so inform the bond counset.' Motion carried by 7 affirmative votes. Pesatution #4243 N. C. S. authorizing the employment of Orrick, Dahlquist, Herrington & cutcliffe as special ;bond counsel for the purpose of conducting a Lib -rar.y bond elec- tion, was introduced by Councilman Brainerd, seconded- by Councilman Batta.gtia, and adopted by 7 affirmative votes. 393 March 22, 1965 Atwater Investment City Attorney Edouard Robert informed the Council that Bankruptcy the trustee for Atwater Investment Company has given / notice that on April '8,. 1965,_ he will. offer for sale and l �� solicit bids for the purchase of the Refund Agreement the City of Petaluma has with Linda Del Mar. Mr. Robert said he indicated to the trustee the City might be interested in purchasing the*Refund Agreement. He .recommended the staff analyze the situation and; determine what is a reasonable offer and then make a recommendation to the Water Commis- sion and Council. Councilman Battaglia was requested to have the Water Commission consider this matter for recom- mendation to the Council prior to the deadline dater Enhance Southern Councilman Battaglia stated he had received a letter from Entrance to City Supervisor Shoemaker regarding a new service club sign of Petaluma for the subject location. Following a brief discussion and at the suggestion of Councilman Ellis for further study, f3 the matter was referred to the Director of Public Works. and City Planner, for ideas. Councilman Battaglia was asked to contact the Chamber of Commerce for possible service club participation. in the sign. Tape Recordings Adjournment Mr. Phil Joerger, 1 Jensen Drive, addressed the Council regarding accessibility of .Council meeting tape recordings: He had.Frequested retaping the recording of a meeting and was. granted permission by the- City Clerk, and later his request was delayed pending. opinion by the City Attorney, but learned before the= that his request was granted. The City Attorney stated that.he checked to find out if tape recordings are considered "public records, " which he added are not.perme nenv public, records but used by the staff as an aid in preparing the- Council meeting minutes.. He said `that tape recordings. available to all citizens if the retaping does not interfere with staff use.
