OF CITY COUNCIL
PETALUMA, CALIFORNIA
April 5, 1965.
Council Meeting Regular meeting of the Council of the City of Petaluma
called to order by Mayor Van Bebber at the hour of 7:30
o'clock P.M.
A,ttendaice Present: Councilmen Battaglia, Brainerd, Cavanagh, Jr
Colin, Ellis, Gans, and Mayor Van Bebber.
Invocation The invocation was given by Reverend John Jaster,
St. John's Lutheran Church.
Minutes Minutes from the meetings of March 15 and March 22,
1965, were approved as recorded.
'Sectional Sewer Rodder Report dated March 31, 1965, signed by Purchasing Officer
Res. #4244. NCS Ray W. Myers, re subject bid opening on March 29, 1965,
indicating that Mr. Young recommends accepting the low
bid, submitted and filed. City Manager Robert Meyer
pointed out that this equipment is being purchased instead
of a sewer de- sanding machine originally requested in the f
budget, further adding that there are sufficient funds left
over from cleaning out the digesters to transfer to the pur-
chase of the rodder, whereupon Resolution #4244 N. C. S.
awarding contract to Southwest Flexible Company for the
purchase of sectional sewer rodder for Department of
Public Works was introduced by Councilman Brainerd,
seconded by Councilman Gans, and adopted by 7 affirmative
votes.
Ruth Maifeld Protests signed by nine citizens of use permit granted to
Nursing Home Ruth Maifeld by the Planning Commission on March 16,E
Res. #4245 KC S 1965, for nursing home at 32 Branching Way, read and.
filed. Director of Planning Robert Byrd stated that a nurs-
ing home its a conditional use in an R-1-6000 area requiring
a use permit' and that at the Planning Commission public
hearing, only one objection was voiced, and since this condi-
tional use 'is contingent upon the feeling of the adjoining
neighborhood, it was the decision of the Planning Commission
to approval of the use permit. During Council discus-
sion of this matter, members of the audience were asked to
speak. Those who spoke against the nursing home were:
Mr. George •C. Olson, 28 Branching Way,
Mr. Dale Downing, 856-6th Street,
and in answering Council `questions, Mr. Frank Matteri,
20 Branching Way, indicated his objection.
Those who spoke in favor of the nursing home were: -
Mrs. Ruth Maifeld, 2080 Magnolia Avenue,.
- Mr. George Schultzberg of Schultzberg Realty,
305 Petaluma Blvd. South,
Mr. John Utterback, 852 -1/2 Western Avenue.
Mrs.' Maifeld gave a detailed report of the operations in-
volved emphasizing that the guests in her nursing home. would
not be a detriment to the neighborhood. Following Council

Federal Notice, dated March 19, 1965, from Federal Aviation;
Agency Agency requesting comments of establishment of a proposed
heliport by "The Lodge Novato" at Novato, 'Califoriiia, sub-
mitted and .filed. ' Director of Planning .Robert Byrd .stated
that this proposed heliport would not interfere with
Petaluma's air traffic.
Division of -Highways Letter, dated March 26, 1.965, from State Highway Engineer
Program after 1972 J. C.- Womack rega -rding study for planning a continuing `high-
way program (after 1972), read and filed.. It was thedecision
of. the Council that this letter did not require any attention at
this time.

cast by Councilman G_ ans. He stated that it is ,becoming
exceedingly difficult for ambulatory people to find a place
I n which to live and believed traffic would,—not—be a
hazard and that this type of a use would not lower the
value of the property in the neighborhood, and there-.
fore voted- to sustain the Planning Commission's. action.
Councilman Battaglia suggested that the staff assist Mrs,
Maifeld in every way possible, such as locating - suitable
property, etc., and Councilman Gans .offered to pay the
filing fee of $25 for another use permit for Mrs. Mai+feld.

Robert Byrd stated that the function of the, Beard is to
attempt uniformity of Codes throughout the County and that
Building Inspector Qberto is Petaluma's representative on
the Board.

A,sses.sment District City Manager Robert Meyer reported that as a result of- a �
#9 N. S`. meeting held today with the City E City Planner,
City Manager, Mr., Whitlow, Engineer of Work, and repre-
sentatives of the Petaluma Industrial Park, Assessment
District #9 N; S. is ready to go ahead. Mr. Meyer read a
letter, dated April 5, 1965, received from said Park agree-
ing to certain inclusions and improvements in the District.
He said that Mr: Whitlow was instructed to proceed with
the work with as much speed as possible.
Council- School Board . City Manager Robert Meyer announced that'the School Board
Dinner has tentatively set the Council -Board dinner for May 10, 1965.
North Bay.Division City Manager Robert Meyer .reminded the Council to notify
League of Calif-. Cities his office re attending the subject meeting in Ukiah on
April 24, 1965.
Legislative Committee Councilman Gans referred to Assembly Bill #1461 proposing
R'eport a 40 -hour week for firemen, with which, he said, the City is
deeply concerned. He read City Manager Robert Meyer's
letter written to the Chairman of the Assembly Committee on
Industrial Relations outlining the City's position oil fl)e. matter
and requesting his support of the Council's opposition to this
bill.
Mayor Van Bebber said that he discussed Assembly Bill #946
re amendment to the Brown Act with Assemblyman Bagley
and expressed to him the Council's objection to this bill.

Lighting Proposal
Report, dated March 31, 1965, of Director of Public Works
David Young re subject application for outside sewer, sub-
mitted and filed. . Mr. Young recommended approval pro -
viding the applicant pay any refund connection charges that
may exist as a result of, any previous parties extending the
/ newer main. The City'Attoriey and City Clerk had deter- /.
mimed that such an agreement exists with Mr.. Ed Avil'la. !�
Mr. Young replied, to Council question that Mr. Stiefer is
aware of this agreement, whereupon Resolution #4249 NCS
granting permission. to Howard Stiefer to connect one resi
dential connection at 1225 Mt. Yiew Avenue to the City sewer
system, was introduced by Councilman Battaglia, seconded by
Councilman Ellis, and adopted by 7 affirmative votes. C/
Director of Public Works David Young introduced Mr. Robert
Herrerias of P. G. &, E.* who addressed the Council regarding
proposal to upgrade street `lighting as outlined in a letter,
dated March 12, 1965, from Petaluma District Manager John
L. Morgan to David Young with a street -by- street breakdown
attached showing the increased illumination and cost. Follow-
ing a discussion period with Mr. Herrerias, the Council de-
cided to consider the proposal further at a study session next
Monday night, requesting Mr. Herrerias to' be present.

Petaluma Blvd. Traffic Director of Public Works David Young reported fhat ,the
Signal Lights City''s electrical maintenance man was unable to locate: the
sync wire for the traffic signals and it was necessary to
get the'Division of Highways'maintenance man who used to
maintain , the signals to help locate the trouble. Mr. Young
stated that the sync w re , was found and the necessary re-
.pairs were made to synchronize the traffic signals on Peta-
luma Boulevard. .
Hotel -Motel Tax: Ordinance #787 N. C. S. amending Ordinance #78'1. N. C.. S.

Schuman Road -
In answer 'to Councilman Cavanagh, Director of Planning Robert
Laurel Street
Byrd reviewed the status of the subject .district, stating that at

initiated, it was the 'intention of the Council to :inclade the

Schuman portion, but at the time; the petitions were circulated
in this area, the primary concern of the people was the ;cost
of the work, with the thought they could override the dis-
trict if the costs were too high. He said that the Council
decided the Schuman area was of sufficient scope to stand on
its own merits and that following the work of Assessment
District #9, a separate district would be formed for the Schuman

area. Re - added that no further work has been since that
time. The City Manager stated that before people will go ahead
with an assessment district; ' they want to know the costs,, and
suggested that the Council i a decision whether or not to
go ahead with he expense of obtaining the necessary engineer-
ing data and costs, which would always be available at , a future
date if the district did not go ahead at this time. Following a
brief discussion, the City Engineer was requested by the
Council to prepare engineering &legal costs for fte Schu-
man -' Laurel area for consideration at budget time.-
