Attendance Present: Councilmen Brainerd, Cavanagh, Jr., Colin, Gans, Joerger, Lipman, and Mayor Putnam. Absent: None. Invocation In the: absence of Reverend Clyde Tillman, the invoca- tion was given by Reverend Herbert C.. Gans: Minutes The minutes from the meeting of August 16, 1965, were approved as recorded. Financial. Report - Mr. Roberf Powell of Stone & Youngberg presented their Stone & Youngberg written report "Financing Major Sewerage Improvements ", which was submitted and filed. He said their recommen- dation is to proceed on a general obligation bond issue in the amount of $2, 35.0, 000'with the intent of issuing bonds for, $1, 75.0, - 000 after receiving the $60Q000 govern- ment grant. Because of the number of conclusions and recommendations contained in said report, he suggested meeting with the Council in a study session to discuss and consider all details, whereupon the Council agreed that the City Manager arrange a date with Stone & Young- berg and notify "the" Council accordingly. Northwest Annexation Boundary Commission resolution approving subject 2 (Kazen A hex.) annexation, submitted and filed. Director of Planning -Res, s #4353 NCS Robert Byrd .located the area on a map, stating that this is a "reasonable anhexatioh and conforms to all of the " requiremeiits *of the Local Agency Formation Commission, whereupon ResolutioiC #4353 N. C. S. giving notice of proposed annexation of the City of Petaluma of uninhabited territory designated "Northwest Annexation No. 2" and giving notice. of time -and place for hearing of protests thereto, was introduced by Councilman Joerger, seconded by Councilman Lipman, and adopted by 7 affirmative votes. • PUC Notice of Hearing Public Utilities Commission Notice of Hearing re investigation'of' electric and communication public utilities' extension rules and aesthetics and economics of facilities, submitted and filed. Director of Public Works David Young explained the. purpose of this hearing as outlined in letter dated August 25., 1965, from PUC, submitted and filed. He added that the City will be kept posted on developments in - regard to this matter. PUC Order Public Utilities Commission Order Instituting Investigation to establish procedure for making allocations to local agencies under the "Crossing Protection Maintenance Fund " and- to determine , methods for ascertaining mainten- ance costs of automatic, crossing protection, submitted and filed. . D,irector of Public Works David Young explained the,.Legislatore's `provision for establishing a "Crossing Protection Construction Fund" in 1953 which was followed up by a "Crossing Protection Maintenance Fund" this year, and that a formula for disbursing these funds will be -'7'f7 117 65, �4 September 7, 1965 PUC Order (Cont'd) determined at the hearing on November 3, 1965, He said that we will be. informed on the action taken. Sonoma County Radio Copy of letter from 'Sonoma County Radio and Television and T. V. Assn., Inc. Assn. , Inc. , to Sonoma County Board of Supervisors, dated August 18, 1965, re, zoning of sales, repair, and service of radio, television and electronic -equip - meht businesses, submitted and filed. Following a _ Pao ific; 6ervice brief discussion on this letter, and at the suggestion 1 of Councilman Brainerd, the. Director of Planning, was asked to check the list of businesses for business licenses. Petaluma City Letter, dated September 1, 1965, from Petaluma City Employees' Assn. Employees' Assn, re salary and vacation request, read . and filed. A general discussion followed in wh' Caesar Cuneo, President of the subject Association, spoke on .behalf of their request, and Norman Carpadus of the Firemans "' group addressed the Council concerning the fact that the Police and Fire groups have not made their proposals yet. It was generally agreed by the - Council that Mr. Meyer develop his recommendation for presentation to the Council as soon as possible and then followed by the necessary study sessozs. Re Hillside Standards' Letter, dated August 26, 1965,, from Eugene Miller, Pre,sident Redwood Empire Branch American Society of Civil Engineers re development of. hillside standards anion' g the cities and County of Sonoma, read and filed. Councilman Colin, who is a member of the Sonoma Co. Board of Appeals, offered some basic information on this particular problem, stating that the ultimate goal is to- develop. a satisfactory ordinance regulating cuts, fills, retaining walls, etc. Claims. and 'Bills Resolution #4354 N. Inclusion of 101 City Manager R bert Meyer read a news release from Highway into Inter- Congressman Don H. Clausen stating that the Presi- state System dent has signed into law the Federal Aid to Highway Resolution to speed work on the interstate Highway System, which measure sets the stage for the earliest possible inclusion of U. S. 101 into the Interstate System. Said news release was submitted and filed. Presentation of Awards Director of Public Works David Young informed the Council that Tom Vail, has completed a course in water treatment plant operator which was given at Marin Junior College, passed his exam. ination and has been issued a Certificate of Water - Treatment Tom Vail Plant Operator, Grade 4, _ whereupon Mayor Putnam pre - sented the certificate to Mr. Vail and commended him for his achievement. He received congratulations from the Council and audience Director of Public, Works David Young informed the Council that Art Baker- has satisfactorily completed a course in construction inspection of public im- Art Baker p.rovements sponsored by the American Public Works Assn.- ;. w.h'ereupon _Mayor. Putnam presented a certi- ficate to Mr., Baker and commended him for his good work. The Council and audience , congratulated Mr. Baker. Council Chamber _ Director of Planning Robert Byrd reported on the A,sh Trays cost of obtaining better ash tray facilities for the Council Chambers - 28 for $70 -$80 for low -grade quality, or $140- $1 50, .for better -grade quality. lt,was. suggested that thismatter;.be taken under consideration. Turn Permitted on Red' - ' signs be installed at Washington St. and Pet. Opinion re Walnut Park City Attorney opinion re holding iron- sectarian re- ,233 ligious services at Walnut Park, submitted and filed. .Status Cash Bond - City Attorney Robert stated that Fortner Bros, de- Fortner Subd- # 1 posited a cash. bond - as -a performance bond for Fortner Subdivision # 1 with the Redwood `Empire Savings and Loan Assn. , and under the terms.of the Subdivision Agreement, upon demand of the City Engineer, if the subdivider has not performed, the said Savings and Lodn is required to -turn over the money and the City then can take steps to, complete the required public (� improvements. In this particular instance, Mr. Robert continued, demand `,has been made and the City has re- ceived a notice from the Savings and Loan that a subcontractor has filed.a stop notice. against the subcontractor has filed a. stop notice against the funds in the Savings and Loan and has perfected the stop notice by -taking the other required proceedings under the law. . Mr. Robert. said he feels that the Savings and Loan will file a court action, adding that the matter was referred• to their attorney and that he has written to the attorney requesting his intentions. Discussion followed in which Mr. Robert pointed out that the subdivision ordinance permits the deposit of a cash bond instead of a performance bond, and that if the Council m shed to stop this, the subdivision ordinance would have to be re -exa- mined and changed. Mr. Meyer said that this was brought to the Council for their information and that the City Attorney, City Engineer and he will study this problem and submit a recommendation to the Couicill for their' consideration. _Lot Split - Alvin Planning Commission Resolution #23 --65A approving .and Alma Moretti lot split filed by.Alvin•C.- Moretti and Alma Moretti Res,, #4.355 NCS at the corner of Palmer and Vallejo Streets, sub- mitten and filed. Rezoning Kentucky St.- Planning Comm Resolution #Z9 =65 recommending Ord. #807 NCS amending Zoning Ord., #662 NCS to reclassify certain parcel's located westerly side of Kentucky Street between Washington and Prospect Streets from an R-M zone: to, a P -M (Professional- Medical) zone, was submitted and. fil`ed.. Director of Planning located the r.ea on a map-and gave a repo recommending the rezoning. Mr.-Byrd said that copies of the report were mailed to the Council which indicates the attitude and recommendation.of the Federal Aviation Agency. It was decided by the Council to discuss this -matter at an early study session. At the request of Councilman. Colin, City Manager Marine Parks & Harbors Meyer said he would make 'a reservation for Council- Assn. man Colin and, any other Councilman who would like to attend the subject meeting in San Francisco on September 17th, 1965 Industrial Forum Councilman Lipman said that forms were given to the Council prior to the meeting on the Industrial Forum to beheld at noon on September i4th at the Elks Club - sponsored by the Chamber of Commerce. He urged the Council to attend, adding that the San Leandro Chamber Manager and City Manager will talk about attracting industries. 'Bandstand At the suggestion of Councilman Lipman, the Director of Public Works was asked to check into the.matter of putting rubber on the iron wheels of the bandstand. Civic Center In answer to Councilman Cavanagh, Jr. , City Manager Meyer stated that the matter of beaui:tifying the Civic Center will be considered during Capital Out - lay Projects study. Petaluma River Councilman Joerger stated that the subject Committee Committee will submit. a recommendation soon - regarding pollution of the Petaluma River.
