HomeMy WebLinkAboutMinutes 09/20/1965MINUTES OF MEETING OF CITY COUNCIL PETALUMA, CALIFORNIA September 20, 1965 Council Meeting- Regular meeting of the Council of the City of Petaluma called to order by Mayor Mrs. Helen Putnam at the hour of 7:30 o'clock p. m. Attendance Present: Councilmen Brainerd, Cavanagh, Jr. , Colin, Gans, -Joerger, Lipman, and Mavor Pi1t1 - 1arr , . Absent: None. Invocation The invocation was given. by Reverend Carl Young, Freewill Baptist Church. Minutes The minutes from the meeting of September 7, 1965, were approved as recorded. Audit - Audit, dated June 30, 1965, for Water Department Water Department prepared by Begley & Deaton, submitted and filed. The City Manager stated that due to illness, Begley and Deaton were unable to be present at this meet- ing, and in'line with his suggestion, the Council decided to consider and discuss this audit at the time the General City Audit is presented, and in the meantime, if the Council has any questions in regard to the Water audit, the staff could assist in the matter. Notice of Intention Notice of Intension to circulate initiative peti- to Circulate tion to enact City ordinance, submitted and filed. Initiative Petition Said notice stated that 21 days after publication of notice, it is, intended to circulate among the voters of Petaluma a petition to secure, either by passage of the City Council or approval by the 1 6 0 voters, the enactment of an ordinance prohibiting the City Council from 'levying a room occupancy tax. The City Manager informed the Council that if a special election is necessary, it would cost about $3; 415. Following a brief discussion, it was sug- gested by Gans that there should be pub- licity issued by the Council" or the staff and with the cooperation of the newspaper and :radio station, let the people know what sign -ng this petition means toy the community. The City Attorney also questioned the constitutionality of the petition and at this point recommended that if the petition were submitted With the.successful. number of signatures, the Council ignore it. However, he said that he has not re- searched the 'matter thoroughly yet. Certificate of Appreciation F.. I , '—Claims and Bills Res. #4363 NCS Certificate( of Appreciation for the interest, support, participation, or-contribution to the success of the Fourth Annual Old Adobe Days Diesta, read and filed. / Resolution. #4363 N. C. S. Approving claims and bills Nos. 7650 ;to 7695 inclusive and Nos. 3894 to 3920 inclusive, was introduced by Councilman Brainerd, seconded by Councilman Joerger, and adopted by 7 affirmative votes. Pedestria.n Safety Chief' of Police Del Maestro read the citation awarded Award to the-City by the California State Automobile Assn. for:not having a single.pedestrian fatality during 1964. • He noted. that this is the third consecutive year that: Petaluma has- had no pedestrian deaths. The Mayor.: commented,, that: the three plaques have been mounted on the Council Chamber wall. C:) Booth -O -Rama City Manager Robert Meyer read a letter, dated September 18, 1965, from the Chairman. of the Booth - O -Rama requesting Council approval for the use of Walnut Park on Saturci, ­T. nctnbpr I hrh, bN7 the Gamma Xi Chapter of Beta. Sigma Phi to hold a Booth- O- Rama,- 33 and that permission had been see ured from Mr.. Shollen- berger. Said letter was submitted and filed. A motion was made by Councilman Gans, and seconded by Councilman Cavanagh, Jr. , granting approval of said request. Roll Call on this motion carried by 7 affirmative votes. Petaluma Area Fire's City Manager Robert Meyer reported on the fire in the rural Petaluma and Penngrove areas September 16th through 19th. Mr Meyer told of all the outside fire department and Civil Defense units that helped and commended our local firemen, Pa -rk Director and' the many volunteers, groups, and citizens, who assisted in one way or another. The Citizen's Bald was es- pecially complimented for their patrol work and radio communication work during the fire. A list was read by Mr. Meyer of local merchants. who donated food, cigarettes,, milk and soft drinks to feed the workers-. A motion.was made by Councilman Gans, and seconded by Councilman Cavanagh, Jr. , that in recognition of this performance and contribution, the City Manager on behalf of the Council, write an individual letter of appreciation to each merchant who made a donation, and a commendation to all, including our own staff, who worked so untiringly. Roll call on this motion carried by 7 affirmative votes. Downtown Council Councilman Colin, Chairman of the subject Committee, Committee reported on the progress of the downtown project, Ord. #810 NCS which, he said, is about 907 complete. He stared that a metting was held this afternoon with the Downtown Merchants Committee and a letter, dated September 17th addressed to Mr. Robert from. Wells Fargo Bank was read outlining their general intent and they understand the City of Petaluma will undertake concerning the property on Kentucky Street held in the Estate of S`chluckebier. Copy of ,said letter. was submitted and filed. Councilman Colin acknowledged `the cooperation of Wells Fargo in ob- taining a 20 foot instead of a 10 foot walkway from Keller Street Parking Lot to Kentucky Street. Fol- lowing remarks made by Mr. Edward Fratini of Wells Fargo, Mr. Leon Rimov explained the walkway project in detail with the use of a colored plan. He added that the project has been named "The Golden Con - course.. " He said that with the $20, 000 pledged by the City for this project aiid the: $40, 000 indicated by the business community, the project wilt have approximately $60 000, and that these fun d's will be . .� used land acquisition, landscaping; lighting, and, paving of th ;e.:walkway area from, Kelte-r - Street Parki:izg Lot to Petaluma Blvd. North. Following commendation to the Downtown Committee for their fine work sand to Wells Fargo for their interest, Ordinance #810 N. 1C.'S. authorizing the contribution of $20, 000 to the Petaluma Shortcut Project; authorizing the City to accept the dedication to the City of the said project; and, authorizing and allocating the use of Parking Meter funds for the improvements to be made in the Petaluma Shortcut Project, was introduced by September 20, 1965 1 . Downtown Committee Councilman Colin, seconded by Councilman Gans, and (Cont'd.) ordered posted by 7 affirmative votes. At the, request of Mr. Rimov, the City Manager was directed to arrange a meeting next Monday afternoon with Mr. R imov and the Downtown Committee. ;Petaluma River Committee Councilman Joerger stated that his report on the Petaluma River will 'be held over until the next Council meeting. Appeal­ Planning Commission Resolution #V19 -65 denying var- Arthur .Canavan iance filed by Arthur F. Canavan to allow a location of a stable structure on a 3/4 acre site at 670 Paula Lane, submitted and filed. Appeal, dated September 1.4; 1.965, from Arthur F. Canavan on Planning Commis- sion's denial, read and filed. Following discussion on ,the; procedure to follow, it was agreed that the matter be considered at the public hearing. Public jS hearing was then set .for 7:30 o'clock p, m. on Monday, . -, ;---- 4, 1965, and the: staff was directed to develop the necessary material pertinent to this subject for the Council's information. Date was confirmed with Mr. Canavan who was in the audience. East Park'Subd. #2 Planning Commission Resolution #23 -65 approving 2 Final Map.; Extension extension of time within which to file final map of East Park Subdivision #2 (located southwest corner Elyl Road and East Washington St. ) submitted and filed. r Gilardi Subdivision Planning... Commission Resolution #24 -65 approving Tentative M,,ap tentative map of.Gilardi Subdivision (located south of Cader Subd. #3), submitted and filed. It was noted by the Director of Planning that the City Engineer's letter.requiring certain improvements was omitted from the procedure, but will be prepared and submitted soon, Lot Sp1.it - Planning Commission Resolution #25 -65 approving lot David G. Cader split filed by - (Davi& G. Cader for certain lots located Res. #4364 NC'S in Cader Subdivision• #4, submitted and filed. Direc- tor of Planning .Robert: Byrd located the lots on a map and briefly explained the .subdivider's request for said lot, split. +Ie added that the Planning Commission approved the lot split with a condition that a fence be constructed and junipers be planted, whereupon Resolution #4364 N. C.:S. approving said lot split was introduced.by Councilman Gans, seconded by Councilman Lipman, and adopted by 7 affirmative votes. Appropriation Ord. Ord. #811:N,CS' Rezoning Kentucky St.. Ord. # 807 NCS Following a brief discussion on Section 14, Ordinance #811 N. C. S. - Annual Appropriation Ordinance and capital outlay program to be completed during the fiscal year July 1, 19.65 to June 30, 1.966, , providing ' th,atithe plans and specifications for each capital outlay program be approved and be ordered commenced by resolution and naming the fund from which the particular capital outlay program shall be paid, was introduced by Councilman Gans, seconded by Councilman Brainerd, and ordered published by 7 affirmative votes. Amend Zoning Ord. rei' Public Hearings Ordinance #807 N. C. S. amending Zoning Ord. #662 NCS by rezoning certain,,parcels located on the westerly side of Kentucky St. between`W__ashington and Prospect Sts. from an R -M -1500 .zone to- a, P- M._zone, was intro- duced by Councilman Colin„ _sec'onde& by Couizcilrman. Street Resurfacing At the request of Councilman Cavanagh, Jr. , the City, Report Manager was, directed to have the Engineering (O'ept. Res. #4365 NCS prepare a :list.of streets that are dedicated but not accepted and add it.:to. the subject report. The Council complimented.the Engineering Department for an excellent report, whereupon Resolution #43'65 e - N. C.: S�.. accepting Street Resurfacing Report filed by the Director of.Public:Works Sept. 20, 1965, and adopting. the recommendations and priorities set forth..therein as• the guide and master plan for street improvements of this City was introduced by Councilman Colin, seconded by Councilman Brainerd, and adopted by 7 affirmative votes. Agreement - 'Resolution:. #4366 N.. -C. S. authorizing Richard Shollen- • Fourth District berger to execute license agreements for use of A rcultur Assn. vs Fairground facilities, was intro(d�uced by Councilman #4366 NCS Lipm-an,(. •seconded.by Councilman Joerger., and adopted by 7 affirmative votes. Petaluma Fire Councilman joer.ger referred to a letter the Council Fighters` Assn.. received (too late for the agenda) from the subject re ''On Call Time" group re abolition of "On Call Time for `Firemen, and upon his suggestion, Mr. Donovan Turner, Pre.si- dent of the group, was asked to speak on their behalf. :He said that several. meetings have - been held so they now wish to bring the matter before the Council to be.r.esolved. Following - a statement made byfCounc -il- man Gans, rand seconded by Councilman Brainerd, to end the discussion ?a'nd.hold an executive session and .then also hold a study session with the fireman's group. Motion carried unanimously. Election re In answer w.Mr. William. F'oster's question., the Sewer Bonds Council informed him that the matter of when- the election will be held on the sewer bonds will be dis- cussed at a study session after tonight's Council meeting. Personnel Ordinance Answering °nagh, Jr.`,. the City.Attorney replied that the personnel ordinance will be ready for . Council action around .the middle of October Adjournment -There being no further business to, come before the Council, -the meeting.was adjourned to a study session with Stone and,,Yo ngberg.
