Seconded by Council Member O'Brien ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PETALUMA AMENDING CHAPTER 2.70 OF THE PETALUMA MUNICIPAL CODE (SENIOR CITIZENS CENTER COMMITTEE) AND REINSTATING A SENIOR ADVISORY COMMITTEE WHEREAS, the City Council of the City of Petaluma, disbanded the Senior Center Advisory Committee in 1989 due to a lack of participation; and, WHEREAS, in 1993 members of the Petaluma Senior Center, working with the Recreation, Music and Parks Commission established a sub -committee to the Commission to represent the interests of seniors and to promote senior activities; and, WHEREAS, members of the Senior Center advisory sub -committee have been very active in working with staff to promote senior activities, classes and trips; and, WHEREAS, there has been an expressed interest from the Petaluma City Council to reinstate the Senior Citizens Center Committee, but to broaden the scope of its duties to include community -wide issues affecting seniors and rename the committee to reflect its changed scope. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. Title 2, Chapter 2.70 of the Petaluma Municipal Code is hereby amended as follows by changing the title of Chapter 2.70 as follows: Senior Advisory Committee Section 2. Title 2, Chapter 2.70 of the Petaluma Municipal Code is hereby Amended to read as follows: 2.70.010 Establishment A senior advisory committee, consisting of seven members of the community whose age shall be fifty-five or over, is established for the city. Ordinance No. 2260 N.C.S. Page 1 1 Section 3. Title 2, Chapter 2.70 of the Petaluma Municipal Code is hereby amended by 2 changing Section 2.70.040 to read as follows: 3 4 2.70.040 Duties 5 6 The committee will advise the city on issues and programs for seniors and active adults 7 including the operation of senior facilities. Such advice shall include the following matters: 8 9 a. Identifying areas of interest and need for seniors and active adults in the Petaluma 10 community. 11 b. Assist in the provision of recreational, social and health related programs for seniors 12 and active adults. 13 c. Advise the city regarding senior program operations which include recruitment of 14 volunteers and identifying and helping secure funding sources for future 15 programming opportunities. 16 d. Any other advice deemed necessary by any members of the city council and/or city 17 staff as it pertains to the well-being of seniors and active adults. 18 19 20 Section 4. The senior advisory committee as renamed herein is hereby reinstated as an 21 advisory committee for the city. 22 23 Section 5. If any section, subsection, sentence, clause, phrase or word of this ordinance 24 is for any reason held to be unconstitutional, unlawful or otherwise invalid by a court of 25 competent jurisdiction or preempted by state legislation, such decision or legislation shall not 26 affect the validity of the remaining portions of this ordinance. The City Council of the City of 27 Petaluma hereby declares that it would have passed and adopted this ordinance and each 28 and all provisions thereof irrespective of the fact that any one or more of said provisions be 29 declared unconstitutional, unlawful or otherwise invalid. 30 31 Section 6. The City Council finds that adoption of this ordinance is exempt from the 32 California Environmental Quality Act ("CEQA"), pursuant to Sections 15061(b) (3) (no possibility 33 that the activity may have a significant impact on the environment) and 15060(c) (3) (the 34 activity is not a project as defined in Section 15378) of the CEQA Guidelines (Title 14, Chapter 3 35 of the California Code of Regulations). 36 37 Section 7. This ordinance shall become effective thirty (30) days after the date of its 38 adoption by the Petaluma City Council. 39 40 Section 8. The City Clerk is hereby directed to publish or post this ordinance or a synopsis 41 for the period and in the manner provided by the City Charter and any other applicable law. 42 43 44 INTRODUCED and ordered posted/published this 5'h day of February, 2007. 45 46 ADOPTED this 26'h day of February 2007 by the following vote: 47 48 AYES: Barrett, Freitas, Harris, Vice Mayor Nau, O'Brien, Rabbitt, Mayor Torliatt 49 Ordinance No. 2260 N.C.S.
