PETITIONS & COMMUNICATIONS Public Notice 57 - U.S. Army re application of City of Petaluma for ap roval of revised plans for wharf, Petaluma Creek, read and filed. TO a question by Councilman King, City Engineer Russell Ingram explained what the'-reason why this had ,come about was due to "the fact that the wharf is not buff(lo a; straight line as shown on the original, permit; also the construction, aof. a :dolphin, as requested by the River Lines, was not included on the original pernit, i opies of applications for liquor licenses .filed with the Dept. of Alcoholic Beverage Control and approved by Chief of Police Del Maestro were submitted and4 ,ilea': Tlfe applications were filed by the following businesses: Schneider's Cigar Store, 27 Washington Street; Fair- West. Mayor Schoeningh .sta:.ted that there were three resolutions before the Council:,for ,a.dopiidh at this time in regard to; the - Public Utilities Commission hearing -on the water problem. Discussion followed as to the need of employing a consultant attorney for thin; matter and also the. matter of hiring a consultant engineer in .connection . with the hearing. (cont. Councilman King. was of the opinion that thought should be given to the matter of whether or not the CiLy'would be wasting money in hiring' ah -engineer in regard to the hearing, and then hiring an engineer at alater date relative to the acquisition of the Water Company, He felt that this would be a duplication of.some of the same work. The City. Attorney explained that the .engineer r needed for work on the PUC hearing would be doing only a. small phase of the work on the entire water situation.. Hanp,uer should be obtained for : the jbb of preparing a preliminary feasibility report for '$750. 00 as they had qp6tedfor this work. He felt that the fee of Stone & Youngberg for the job of .-consultants for the acquisition. of the Water'Company would run too high and U1119'ht'not,be necessary. .... .. 'Discussion took plate as to the type of bonds which should be issued in regard the acquisition of tho.Water Company, Mayor Schoeningh it would . be necessary to obtain a preliminary feasibility report no matter what type of bonds were to be used, so that all of the facts could be presented to the Public regarding the earning power of the Vate" ,ompany. :A, poll of the Council was taken to determine whether the majority of momboi's favored the hiring of Stone & Youngberg or J. B. Hanauer. The poll eAled: 6 members of the Council were in' favor of hiring Stone and Youngb Councilman King'was not in faVor of hiring'said firm. A 10 minute recess was then called to allow time for the preparation of a resolution authorizing the hiring of Stone. &,Youngberg to prepare a financial fe-as - ibility report. and the above mentioned resolution ..!he meeting was 'called back to order, was read . and adopted as follows: Res. #18 N. GONSULTANTS TO PREPARE A PRELIMINARY -FINANCIAL FEASIBILITY REPORT IN CONNECTION .WITH THE -CITTS-CONSIDERATION OF THE PURCHASE OF THE_ CALIFORNIA WATER-SERVICE COMPANY. adopted by the following vote: -Ayes: Councilmen Adams, Bigelow, Brown, Crinella Gustafson a nd - Mayor Schoeningh.: Noes, Councilman King. :1 To a question by 'Councilman King, Mr. Frank explained that the money to pay these consultants would come from the :contingency fund as the expense fill:- would: dla be paid for out of the bond.s issued _on matter. !Gouncilman King stated - that, in accordance with one of the provisions :pf' tn.-'rules of order he would like to ask for a: reconsideration of the vote .on' the foregoing resolution at the next regular meeting. Mdyor Schoeningh stated that he was not familiar with this particular rule of order, but that he would check into the matter and, if it was in order, it -W ' 041d e be . pit on the agenda for the next regular' meeting. (3) January 14, 1957 ADOPTION. OF ORDINANCES, Salary Ordinance Councilmaii Bia&1o stated that he understood, when voting on the introduction of this ordinance;, that there were supposed to be 5 steps in every classification 'in the City, He pointed out rh the ordinance.has classifications . for a "truck driver first-class" and a. "truck driver second class ", which Ifo believed gave the class ification.of "truck driver" 10 steps. Mr.. Frank pointed out that the same ;situation exists with the classifications of - "engineering aid fr,.,.` aO "engineexing'aid, Sr. ", etc. He explained that: it was, a. matter of promotion from one classification to another. Gouncilm.an Bigelow stated that he was against this, - procedure. Councilman King expressed his objection to the ordinance stating thqtthe City of Petaluma is way over the average. city. regard to the amount ,of firei-np-n per thousand population, and. that he did not believe in the step plan, which this ordinance is based on. Councilman Crinella stated that he was in.favor of giving, the lo eT - City employees a raise, but he believed most of the other classifications were pretty closO, to what nearby cities were paying He fur. ther stated that he did not believe a. salary ordinance should go into effect in the middle of the fiscal - year. Councilman Adams stated that he .believed in giViAg the employees a raise when there is a cost- ofAivim increase. The subject ordinance was then adopted as follow$: Ord.. #468 N. C. Council explaining in `order to 'receive any surplus Federal property, the subject resolution was necess - - He went on to say that such surplus property could be obtained by- ,the authorized person for merely the cost of carrying- and transportation charges from the surplus warehouse in Oakland. Col. O'Mohundro also explained that nothing was, needed.. from the surplus warehouse at this time,. but the resolution would make' .it; possible to obtain any property that might be needed in the future for Civil Defense ;- whereupon, Res. #1815 N. O"MOHUNDRO,, ASSISTANT DIRECTOR, PETALUMA TOWNSHIP CIVIL DEFENSE TO SIGN, FOR AND ACCEPT SURPLUS FEDERAL PROPERTY., (4) : January 14, 1.957 , CO NSI DE RATION OF UNFINIS BUSINESS, Cont. L eorge Perry Application for Outside Sewer Connect City Attorney Ed Robert reported that he had not as yet prepared the agree, ment on this matter as he had none of the easements and no description as et : P where the sewer line `will. go, etc. Mr. Benelli,. representing Mr. Terry, addressed the Council stating that he could not obtain the easements until he was assured by the Council that ,the-.sewer connection would be granted. Councilman Brown wars of the opinion that an agreement would not be ,necessary; merely a permit with the stipulation that no other person may connect to :the line without the permission of, the Council and that Mr. Perry will abandon this; private line if and when a. City sewer is extended to reach his property and it is .feasible for hire to connect to the City sewer. At the suggestion of the City Attorney, it was decided that' a provisional -permit be 'granted Mr. Perry with the following :stipulations.: "(1) Prior to backfill %ng; the sewer lateral shall be inspected by the City Inspector. (2) That an agreement concerning -the said sewer line be entered into between the City of Pe.ta.- tuina..and George Perry which shall be satisfactory to the City Council. " The matter was deferred until later 'in the meeting, to allow time for the -Clerk to re -type, the resolution granting the`,permit in' accordance with the ,.,. suggestion of the City Attorney. Cherry Valley Sewed' District = -Appointment ofErigi.neer &Attorney The City Engineer reported that he ha :d' talked to several different 'engineers on the subject. - matter, and that, they had all quoted A..S. C. E. prices ':on the work. �.: � After some discussion on the matter, the Council-was in agreement that Eugene K. Sturgis should be appointed as the attorney for the District. The following. Committee was then appointed to go over the matter of app:ointiag an engineer for .the District and submit their recommendation to the °Council.�for action at the next meeting: Councilmen Brown,. Noes: Councilman Bigelow. ` Planning Commission Appointments Mayor - Schoonin , gh started that t:his matter would have to be deferred until the next meeting,. due to the fact that no, names had as yet been submitted by the Council for appointment 'to the Planning Commission. Hel felt - that this wa quite an important factor, 'The City Manager was directed to confer with Stone & Youngberg on the subject to determine when the work could be done, and report back to the; Council at the next meeting. The City Manager suggested that some consideration be given, to - removing the old pilings across the river from the Water Street parking -lot. Councilman King was of the opinion that there would not. be enough ''money in this year?'s budget to do the work. Following 'a discussion on the subject of whether or not the Council- is bound to strictly adhere to 'a .budget as set up at the beginning of each fiscal . year, and at the request of Councilman King, the City Attorney was directed to prepare an opinion stating whether 'or not it is legal for the City to authorize bills prior to the - appropriati:on of funds for the work by the Council. Councilmen Brown and Crinella expressed the opinion that, they were in favor of having the old pilings on Levee Street removed as suggested by the City Manager when funds were available for the w.orka Mr. Frank suggested that he bring the City's financial picture. up to date.; and submit it to the Council for further study of this matter, At the request, of Councilman Gustafson,-. the: City Engineer was directed to estimate the cost of a sidewdlk approximately 4' wide, on East Washington Street, along the playgrounds and fairgrounds to the new Jr., 'High School. Councilman -Brown brought up the subject of the proposed stop - signals at the crosswalk near the new Jr. High School, requesting to know what had. taken place on this matter Mayor Schoeningh reported on a. meeting, which had been held, 1 1 stating that the Divi. ibn of Highvaays' representatives: had stated that they would not install any type of mechanical. signals at the school crossing. They felt'that it wa's not their responsibility and they did not recommend a mechanical signal at this location.' The State felt that the regular school warning signs should be` erected by the City.
